Resolution 6574 RESOLUTION NO. 6574 WHEREAS, the City Council of the City of Miami Beach, Florida, did heretofore, to-wit: on the 4th day of June, 1947, canvass the returns of the General Election held in said City on June 3rd, 1947, and as the result thereof de- clared that for the offices of City Councilman 4,384 votes were cast for Ralph Pole and 4,357 votes were cast for Harold Turk and that by virtue thereof Ralph Pole had been elected to said office for a term of Two (2) years, and that Harold Turk had failed of election; and WHEREAS, the returns of the Certificates of the Inspec- tors and Clerks who conducted said General Election showed that the said votes so cast for Ralph Pole and for Harold Turk were made up of votes cast upon the voting machines and votes cast on absentee ballots, respectively, as follows: For Ralph Pole on the voting machines, a total of 4,061 votes For Ralph Pole on absentee ballots, a total of 323 votes For Harold Turk on the voting machines, . a total of 4,091 votes For Harold Turk on absentee ballots, a total of 266 votes and WHEREAS, the Circuit Court in and for Dade County, Florida, a court of competent jurisdiction, has by its judg- ment in a cause before it lately pending, held that all votes cast on absentee ballots in said election were null and void, and WHEREAS, the Supreme Court of Florida has affirmed said judgment, and WHEREAS, said City Council has re-canvassed the returns of the Certificates of the Inspectors and Clerks who conducted said General Election and in said re-canvass has taken into consideration only those votes certified to have been cast on the voting machines, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that as a result of said re-canvass said City Council does hereby find and declare the true result of said election as to said Ralph Pole and said Harold Turk, to be as follows: 4,061 votes were cast for Ralph Pole 4,091 votes were cast for Harold Turk and that said Ralph Pole failed of election and that said Harold Turk was elected for a term of Two (2) years.
