Resolution 6582 RESOLUTION N0. 6582
WHEREAS, the City Council of the City of Miami Beach,
Florida, is considering amending and changing certain of the
regulations and restrictions established and contained in
Ordinance No. 289, commonly known as the "Zoning Ordinance of
the City of Miami Beach, Florida," as hereinafter set forth,
to-wit:
To amend Section 13A of said ordinance so as to read as
follows:
"SECTION 13A.
USE REGULATIONS.
"Cabana and Swimming-pool" District.
In the "Cabana and Swimming-pool" District no
building or land shall be used, and no building
shall hereafter be erected, constructed, recon-
structed, or structurally altered, which is de-
signed, arranged or intended to be used or
occupied for any purpose, except for one or more
of the following uses:
1. Cabanas.
2. Swimming-pools and appurtenances.
3 . Dining Terraces.
4. Parks owned and operated by the City of
Miami Beach.
Provided, that such buildings shall not exceed
one story in height, nor in any event shall the
height of such building be in excess of eighteen
(18) feet above mean low water, aid no canvas or
other temporary construction shall be permitted
on the roofs of such buildings."
AND, to amend Section 2 of said ordinance reading as follows:
"USE DISTRICTS
1. RAA, RA, RB, and RC Estate Districts.
2. RD Singe- Family District.
3 . RDD Modified Single-Family District.
4. RDE Restricted Multiple-Family District.
5. RE Multiple-Family District.
6. BAAA, BAA, BA, BB, BC, BD, BE, BF and BG
Business Districts.
7. Cabana and Swimming-pool District.
by adding thereto, at the end thereof, the following:
"8. Two-Story Cabana District."
AIvD, to amend said ordinance by adding thereto immediately
after Section 13A thereof, the following:
"SECTION 13B.
USE REGULATIONS.
"Two-Story Cabana District"
In the "Two-Story Cabana District" no building
or land shall be used and no building shall

hereafter be erected, constructed, re-
constructed, or structurally altered which is
designed, arranged or intended to be used for
any purpose, except for one or more of the
following uses:
1. Cabanas.
2. Swimming-pools and appurtenances.
3 . Dining Terraces.
4. Parks owned and operated by the City of
Miami Beach.
Provided that cabanas shall not exceed two
stories in height nor in any event shall the
height of any cabana be in excess of twenty-
eight (28) feet above mean low water, and
provided that no building or structure, other
than cabanas, shall exceed one story in height
and in no event shall the height of such
building or structure, other than cabanas, be
in excess of eighteen (18) feet above mean
low water, and no canvas or other temporary
construction shall be permitted on the roof
of any building.
AND, to amend said ordinance and the maps attached thereto
and made a part thereof so as to include in "Two-Story Cabana
District" and in Area District No. 41, as said districts are
described and set forth in said ordinance, the following lands
situate, lying and being in Miami Beach, Dade County, Florida,
to-wit:
That certain parcel of land bounded as follows:
Bounded on the north by the northerly line of
Fifteenth (15th) Street extended easterly;
bounded on the south by the southerly line of
Lot Four (4) Harrison & Hayes Subdivision, ex-
tended easterly, Mounded on the east by a line
described as follows:
Begin at a point on the southerly line of Lot
Four (4) , Harrison and Hayes Subdivision, ex-
tended easterly, and three hundred three (303)
feet easterly of the easterly line of Ocean
Drive; thence run in a northerly direction to
a point on the northerly line of Lot Nine (9) ,
Block Fifty-six (56) , Fisher' s First Subdivision
of Alton Beach, extended easterly and one hundred
seventy-five (175) feet easterly of the easterly
line of said Block Fifty-six (56) ; bounded on
the west by a line parallel to and seventy-nine
(79) feet westerly of the above described easterly
boundary, as said Harrison and Hayes Subdivision
and Ocean Drive are shown on a plat recorded in
Plat Book Nine (9) , Page Seventy-three (73) of
the Public Records of Dade County, Florida, and
as said Fisher' s First Subdivision and Fifteenth
(15th) Street are shown on a plat recorded in
Plat Book Two (2) , at Page Seventy-seven (77) of
said Public Records, and as said Fifteenth (15th)
Street is named and designated in City of Miami
Beach Ordinance No. 232.
AND ALSO
That certain parcel of land bounded as follows:

extended easterly, of Lot Six (6) , Block Fifty-
five (55) , of Fisher' s First Subdivision of
Alton Beach; bounded on the south by the north-
erly line of Fifteenth (15th) Street extended
easterly; bounded on the east by a line described
as follows:
Begin at a point on the southerly line of Lot
Four (1k) , Harrison and Hayes Subdivision ex-
tended easterly and three hundred three (303)
feet easterly of the easterly line of Ocean
Drive; thence run in a northerly direction to
a point on the northerly line extended easterly
of Lot Nine (9) , Block Fifty-six (56) of Fisher' s
First Subdivision of Alton Beach and one hundred
seventy-five (175) feet easterly of the easterly
line of said Block Fifty-six (56) ; thence run
in a northerly direction to a point on the south-
erly line extended easterly of Lot One (1) ,
Block Twenty-eight (28) of said Fisher' s First
Subdivision of Alton Beach and one hundred seventy-
five (175) feet easterly of the easterly line of
said Block Twenty-eight (28) ; bounded on the west
by a line parallel to and eighty-nine (89) feet
. westerly of the above easterly boundary,
As said Harrison and Hayes Subdivision and Ocean
Drive are shown on a Plat recorded in Plat Book
Nine (9) at Page Seventy-three (73) of the Public
Records of Dade County, Florida, and as said
Fisher' s First Subdivision of lton Beach and
Fifteenth (15th) Street are shown on a plat re-
corded in Plat Book Two (2) at Page Seventy-seven
(77) of said Public Records and as said Fifteenth
(15th) Street is named and designated in City of
Miami Beach Ordinance No. 232.
AND ALSO
That certain parcel of land bounded as follows:
Bounded on the north by the northerly line ex-
tended easterly of Lot Three (3) , Block Twenty-
nine (29) of Fisher' s First Subdivision of Alton
Beach; bounded on the south by the northerly
line extended easterly of Lot Six (6) , Block
Fifty-five (55) of said Fisher' s First Subdivision
of Alton Beach; bounded on the east by a line
parallel to and one hundred seventy-two and five
tenths (172.5) feet easterly of the easterly line
of said Blocks Twenty-nine (29) and Fifty-five
(55) ; bounded on the west by a line parallel to
and ninety-eight and six tenths (98.6) feet
easterly of the said easterly line of Blocks
Twenty-nine (29) and Fifty-six (56) .

of Alton Beach; bounded on the east by a line
described as follows:
Begin at a point on the said northerly line of
Lot Three (3) , Block Twenty-nine (29) extended
easterly and one hundred seventy-five (175)
feet easterly of the easterly line of said
Block Twenty-nine (29) ; thence run in a north-
erly direction to a point on the southerly line
of Lot One (1) , Block Twenty-eight (28) of said
Subdivision extended easterly and one hundred
seventy-five (175) feet easterly of the said
easterly line of said Block Twenty-eight (28) ;
thence run in a northerly direction to a point
on the centerline of Eighteenth (18th) Street
extended easterly and six hundred two and two
tenths (602.2) feet easterly of the easterly
line of Collins Avenue; bounded on the west by
a line eighty-nine (89) feet westerly of and
parallel with the above said easterly boundary.
As said Fisher' s First Subdivision of Alton
Beach, Eighteenth (18th) Street and Collins
Avenue are shown on a Plat recorded in Plat
Book Two (2 ) at Page Seventy-seven (77) of
the Public Records of Dade County, Florida,
and as said Eighteenth (13th) Street and Collins
Avenue are named and designated in City of Miami
Beach Ordinance No. 232.
NOW, THN.R'ORE, be it resolved by the City Council of the
City of Miami Beach, Florida, that a public hearing be and is
hereby called to be held on the 16th day of June A.D.
1948, at 10:00 o' clock A. II. , in the Council Chambers, in the City
Hall, Miami Beach, Florida, for the consideration of said amend-
ments.
BE IT FURTHER RESOLVED, that the City Clerk be and he is
hereby directed to give at least fifteen days ' notice of the time,
place and object of said hearing by publishing notice thereof in
the Evening Sun and Daily Tropics, a newspaper of general circula-
tion in said City of Miami Beach in conformity with Section 21 of
Ordinance No. 289 of said City.
