WHEREAS, the City Council of the City of Miami Beach,
Florida, is considering amending and changing certain of the
regulations and restrictions established and contained in
Ordinance No. 289, commonly known as the "Zoning Ordinance of
the City of Miami Beach, Florida" , as hereinafter set forth,
to-wit:
To amend Section 16 of said ordinance by inserting
therein, immediately preceding the last paragraph thereof,
the following:
"DISTRICT NO. 45: In this District
both Collins Avenue and the Atlantic
Ocean shall be considered as front.
There shall be a front yard having a
depth of not less than 15 feet on lots
facing Collins Avenue. There shall be
a side yard having a width of not less
than 5 feet on either side of a building.
There shall be a rear yard having a
depth of not less than 5 feet. There
shall be a front yard on lots facing the
Atlantic Ocean, the eastern and western
boundaries of which shall be the lines
described as follows:
The Westerly boundary line shall be
a line described as follows:
Beginning at a point which is on the
northerly 'line of 33rd Street extended
easterly and 255 feet easterly of .the
easterly line of Collins Avenue; thence
run in a northerly direction to a point
on the southerly line of Lot 2, Block 19,
extended easterly of the Amended Hap of
the Ocean Front Property of the Miami
Beach Improvement Company and 253 feet
easterly of the said easterly line of
Collins Avenue; thence run in a northerly
direction to a point on the northerly line
of 34th Street extended easterly and 251+
feet easterly of the said easterly line
of Collins Avenue; thence run in a
northerly direction to a point on the
northerly line of 41st Street and 241
feet easterly of said easterly line of
Collins Avenue; thence run in an easterly
direction along said northerly line of
41st Street for a distance of 16 feet;
thence run in a northerly direction to a
point on the northerly line of )i1ith Street
extended easterly and 221 feet easterly
of said easterly line of Collins Avenue;
as said Collins Avenue, Streets, Lot and
Block are shown on the Amended Map of the
Ocean Front Property of the Miami Beach
Improvement Company, recorded in Plat Book
5, at pages 7 and 8, of the Public Records
of Dade County, Florida, and as said
Streets are named and designated in
City of Miami Beach Ordinance i•?o. 232.

The Easterly boundary line shall be
a line described as follows:
Beginning at a point which is on the
northerly line of 33rd Street extended
easterly and 345 feet easterly of the
easterly line of Collins Avenue; thence
run in a northerly direction to a point
on the southerly line of Lot 2, Block 19,
extended easterly of the Amended Map of
the Ocean Front Property of the Miami
Beach Improvement ComPany and 343 feet
easterly of the said easterly line of
Collins Avenue; thence run in a northerly
direction to a point on the northerly line
of 34th Street extended easterly and 344
feet easterly of the said easterly line
of Collins Avenue; thence run in a northerly
direction to a point on the northerly line
of 41st Street extended easterly and 325
feet easterly of the said easterly line of
Collins Avenue; thence run in a northerly
direction to a point on the northerly line
of 44th Street extended easterly and 311
feet easterly of said easterly line of
Collins Avenue, as said Collins Avenue,
Streets, Lot and Block are shown on the
Amended Map of the Ocean Front Property
of the Miami Beach Improvement Company,
recorded in Plat Book 5 at pages 7 and 8,
of the Public Records of Dade County, Florida,
and as said Streets are named and designated in
City of Miami Beach Ordinance No. 232."
AND to amend said Ordinance and the maps attached thereto
and made a part thereof, so as to include in Area District No. 45,
and in "RE" Multiple-Family District, as said Districts are re-
ferred to and described in said Ordinance, those certain parcels
of land situate, lying and being in Miami Beach, Dade County,
Florida, described as follows, to-wit:
"All of that certain parcel of land bounded
on the Jest by the East line of Collins
Avenue; bounded on the South by the Northerly ,
line of 33rd Street and the extension thereof
eastwardly; bounded on the North by the
Northerly line of 44th Street extended east-
wardly; bounded on the East by a line des-
cribed as follows:
Beginning at a point which is on the northerly
line of 33rd Street extended easterly and 345V
feet easterly of the easterly line of Collins
Avenue; thence run in a northerly direction
to a point on the southerly line of Lot 2
Block 19, extended easterly of the Amended'
Map of the Ocean Front Property of the Miami
Beach Improvement Company and 343 feet easterly
of the said easterly line of Collins Avenue;
thence run in a northerly direction to a point
on the northerly line of 34th Street extended

the northerly line of 41st Street ex-
tended easterly and 325 feet easterly
of the said easterly line of Collins
Avenue; thence run in a northerly di-
rection to a roint on the northerly line
of 44th Street extended easterly and 311
feet easterly of said easterly line of
Collins Avenue, as said Collins Avenue,
Streets, Lot and Block are shown on the
Amended Map of the Ocean Front Property
of the Miarii Beach Improvement Company,
recorded in Plat Book 5, at pages 7 and
8, of the Public Records of Dade County,
Forida, and as said Streets are named
and designated in City of Miami Beach
Ordinance No. 232, except those portions
thereof dedicated for use as public
streets. "
NOW, THEREFO2E, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that a public hearing be and is
hereby called to be held on the 18th day of August, A. D.
1943, at 10:00 o' clock A. E. , in the Council Chambers, in the
City Hall, Miami Beach, Florida, for the consideration of said
amendments .
BE IT FURTHER RESOLVED that the City Clerk be and he is
hereby directed to give at least fifteen days ' notice of the
time, place and object of said hearing by publishing notice
thereof in the Evening Sun and Daily Tropics, a newspaper of
general circulation in said City of Miami Beach in conformity with
Section 21 of Ordinance No. 289 of said City.
