Resolution 6432 RESOLUTION NO. 6432
WHEREAS, the City of Miami Beach, its hotels, apartments,
its business men, and a large portion of its citizens, depend for
their very existence upon the winter visitors, and
WHEREAS, the noises caused by building construction have been
found to cause intolerable annoyance to the winter visitors and
the continuance thereof throughout the winter months would result
in a disastrous loss of revenue from the tourist trade, and
WHEREAS, in the year 1937, the City Council passed and adopted
Ordinance No. 497 which, among other things, prohibited, throughout
the winter season, the disturbing and annoying noises which accom-
pany the construction of buildings where such noises occurred with-
in fifty feet of the nearest point of any building occupied as a
hotel or apartment, and
WHEREAS, the Circuit Court of Dade County, Florida, has
recently ruled that portions of said ordinance are unreasonable and
void, and
WHEREAS, notwithstanding such ruling, it appears to the City
Council that it is of vital importance to the City and the civic
duty of the contractors, builders and owners, that the peace and
quiet of the guests of our hotels and apartment houses be protected,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach, Florida, that the contractors, builders and owners,
of said City, be and they are hereby requested and urged to comply
with the provisions of Ordinance No. 497 of said City (known as the
anti-noise ordinance) as fully as though the validity of the pro-
visions of the ordinance had not been questioned or ruled upon.
BE IT FURTHER RESOLVED that the City Clerk be and he is here-
by directed to furnish a certified copy of this resolution to each
of the building contractors doing business in the City of Miami
Beach, Florida.
