Resolution 6435 RESOLUTION NO. 6435
WHEREAS, the City Council of the City of Miami Beach,
Florida, is considering amending and changing certain of the
regulations and restrictions established and contained in
Ordinance No. 289, commonly known as the "Zoning Ordinance of
the City of Miami Beach, Florida, " as hereinafter set forth,
to-wit:
To amend said ordinance and the maps attached thereto
and made a part thereof, so as to create three new area districts
to be known as Area District No. 41, Area District No. 42 and
Area District No. 43 , the requirements within which shall be as
follows:
"DISTRICT NO. 41: There shall. be a
front yard having a depth of not less
than 75 feet when measured from the
bulkhead line described and established
by Ordinance No. 832 of the City of
Miami Beach, Florida. Adequate provisions
shall be made within the building for
the storage and handling of garbage cans
and refuse. "
"DISTRICT NO. 42: There shall be a
front yard having a depth of not less
than 90 feet when measured from the
bulkhead line described and established
by Ordinance No. 832 of the City of
Miami Beach, Florida. There shall be
a rear yard having a depth of not less
than five ( 5) feet and there shall be
a side yard having a width of not less
than five (5) feet on either side of a
build.inn."
"DISTRICT NO. 43 : There shall be a
side yard having a width of not less
than five (5) feet on either side of a
building ."
AND, to amend Section 2 of said ordinance, reading as
follows:
"USE DISTRICTS
1. RA,_, RA, RB, and RC Estate Districts.
2. RD Single-Family District.
3. RDD Modified Single-Family District.
4. RDE Restricted Multiple-Family District.
5. RE Multiple-Family District.
6. BAAA, BAA, BA, BB, BC, BD, BE, BF and BG
Business District "
by adding thereto, at the end thereof, the following:
"7. Cabana and Swimming-pool District. "
AND, to amend Section 13 of said ordinance, by adding thereto,
immediately after said section 13 thereof, the following:
(1)
"Section 13A.
USE REGULATIONS
"Cabana and Swimming-pool" District.
In the "Cabana and Swimming-pool" District
no building or land shall be used, and no
building shall hereafter be erected, con-
structed, reconstructed, or structurally
altered, which is designed, arranged or intended
to be used or occupiedfor any purpose, except
for one or more of the following uses:
1. Cabanas.
2. Swimming-pools and appurtenances.
3. Dining Terraces.
Provided, that such buildings shall not exceed
one story in height, nor in any event shall
the height of such building be in excess of
eighteen (18) feet above mean low water, and
no canvass or other temporary construction
shall be permitted on the roofs of such
buildings."
AND, to amend said ordinance and the maps attached thereto
and made a part thereof, so as to include in "BA" Business District
and in Area District No. 41, as said districts are described and
set forth in said ordinance, the following described lands, lying
and being in Miami Beach, Dade County, Florida, to-wit:
That certain parcel of land bounded on the West
by the easterly line of Collins Avenue; bounded
on the south by the northerly line of 22nd Street
produced eastwardly to the bulkhead line described
and established by Ordinance No. 832 of the City
of Miami Beach; bounded on the east by said bulk-
head line; bounded on the north by the southerly
line of 24th Street produced eastwardly to said
bulkhead line;
AND ALSO
That certain parcel of land bounded as follows:
Begin at the northwest corner of Lot 3 of Block 11
of Ocean Front Property of Miami Beach Improvement
Company, according to the Plat thereof, recorded
in Plat Book 5, at pages 7 and 8, of the Public
Records of Dade County, Florida; thence run southerly
along the westerly line of lots 1, 2 and 3 of said
block 11, to the southwest corner of said Lot 1;
thence southwardly along the westerly line of said
Lot 1 produced to its intersection with Miami Beach
Drive; thence southeastwardly, following the curves
of Miami Beach Drive to the point of intersection
with a line parallel to the southerly line of Lot
5 of Block 8 of said subdivision anddrawn through
the northernmost point of said Lot 5; thence along
said line parallel to the southerly line of said

Lot 5 to a point on the bulkhead line described
and established by Ordinance No. 832 of the City
of Miami Beach; thence northerly zl.ong said bulkhead
line to its intersection with the northerly line
of said Lot ;, Block 11, produced eastwardly; thence
westwardly along the northerly line of said Lot 3 ,
Block 11 produced as aforesaid to point of beginning.
AND, to amend said ordinance and the maps attached thereto
and made a part thereof, so as to include in "Cabana and Swimming-
pool" District and in Area District No. 43, as said districts are
described and set forth in said ordinance, the following described
lands situate in Miami Beach, Dade County, Florida, to-wit:
That certain strip of land bounded on the
west by the easterly line of Miami Beach Drive;
bounded on the south by the southerly line
of 24th Street produced eastwardly to the
bulkhead line described and established by
Ordinance No. 832 of the City of Miami Beach;
bounded on the east by said bulkhead line;
bounded on the north by a line parallel with
the southerly line of Lot 5 of Block 8 of
Ocean Front Property of the Miami Beach Im-
provement Company, according to Plat thereof,
recorded in Plat Book 5, at pages 7 and d of
the Public Records of Dade County, Florida,
said line extending from the most northerly
point of said Lot 5 to said bulkhead line.
AND, to amend said ordinance and the maps attached thereto
and made a part thereof, so as to include in "R ;" Multiple-Family
District and in Area District No. 42 as said districts are des-
cribed and set forth in said ordinance, the following described
lands situate, lying and being in Miami Beach, Dade County, Florida,
to-wit:
That certain parcel of land bounded as follows:
Begin at the northwesterly corner of Lot 4,
Block 13 of Ocean Front Property of Miami
Beach Improvement Company, according to Plat
thereof, recorded in Plat Book 5, at pages 7
and 8 of the Public Records of Dade County,
Florida; thence southwardly along the westerly
line of lots 1, 2, 3 and 4 of said Block 13 to
the southwesterly corner of said Lot 1; thence
eastwardly along the southerly line of said Lot 1
produced eastwardly to the point of intersection
with the bulkhead line described and established
by ordinance No. 832 of the City of Miami Beach;
thence northwardly along said bulkhead line to
the point of intersection with the northerly
line of said Lot 4 produced eastwardly; thence
westwardly along the northerly line of said
Lot 4 produced as aforesaid to point of beginning.
AND ALSO
That certain parcel of land bounded as follows:
Begin at the northwesterly corner of Lot 4,
Block 15 of Ocean Front Property of Miami
Beach Improvement Company, according to the

Plat thereof, recorded in Plat Book 5, at pages
7 and 8 of the Public Records of Dade County,
Florida; thence southwardly along the westerly
line of lots 1, 2, 3 and 4 of said Block 15 to
the southwesterly corner of said Lot 1; thence
eastwardly along the southerly line of said Lot
1 produced eastwardly to the point of intersection
with the bulkhead line described and established
by Ordinance No. 832 of the City of Miami Beach;
thence northwardly along said bulkhead line to
the point of intersection with the northerly line
of said Lot 4 produced eastwardly; thence west-
wardly along the northerly line of said Lot 4
produced as aforesaid to point of beginning.
AND ALSO
That certain parcel of land bounded as follows:
Begin at the northwesterly corner of Lot 4,
Block 17 of Ocean Front Property of Miami Beach
Improvement Company, according to the Plat
thereof, recorded in Plat Book 5, at pages
7 and 8 of the Public Records of Dade County,
Florida; thence southwardly along the westerly
line of lots 1, 2, 3 and ± of said Block 17
to the southwesterly corner of said Lot 1;
thence eastwardly along the southerly line of
said Lot 1 produced eastwardly to the
point of intersection with the bulkhead line
described and established by Ordinance No. 832
of the City of Miami Beach; thence northwardly
along said bulkhead line to the point of inter-
section with the northerly line of said Lot 4
produced eastwardly; thence westwardly along
the northerly line of said Lot 4, produced as
aforesaid to point of beginning.
NOW, THEREFORE, be it resolved by the City Council of the
City of Miami Beach, Florida, hat a public hearing be and is
hereby called to be held on he 28th day of January, A.D.
1948, at 10:00 o'clock -''l. M. , in the Council Chambers, in the City
Hall, Miami Beach, Florida, for the consideration of said amendments.
BE IT FURTHEa RESOLVED, that the City Clerk be and he is
hereby directed to give at least fifteen days' notice of the time,
place and object of said hearing by publishing notice thereof in
the Evening Sun and Daily Tropics, a newspaper of general circula-
tion in said City of Miami Beach in conformity with Section 21 of
Ordinance No. 289 of said City.
