WHEREAS, the City Council of the City of Miami Beach,
Florida, desires to secure the services of Attorney Sidney
S. Hoehl in connection with action to be taken to effect a
reduction in the rates being charged for gas service by
Peoples Water and Gas Company, and
WHEREAS, Attorney Hoehl has, at the request of the City
Manager, consented to render such services to the City on the
terms set forth in letter dated January 2nd, 1948, and addressed
to City Manager Claude A. Renshaw, copy of which is hereto
attached and made a part hereof,
NOW, THEREFOR, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that Sidney S. Hoehl be and
he is hereby employed by the City of Miami Beach, Florida,
pursaant to the terms of said letter.

Dear Mr. Renshaw:
During my conference with r. r. Shepard and you in your office
on December 17 , 1947 , you asked that I inform you as to the fees which
I shall charge for legal services to be rendered to the City of Miami
Beach in connection with action to be taken to effect a reduction of
the rates being charged for gas service by Peoples :ater and Gas Company.
I believe that I should receive a fee of 42 ,000 for all services
to be performed which do not involve litigation, pluF a fee of 1;100 per
day for attendance at and participation in the public hearing before the
City Council.
The fee of "`,: ,00C will cover all work which I have done to date ,
the preparation of the resolution requiring Peoples Water and Gas Company
to show cause why its rates should not be reduced, conferences with
members of the City Council as to their regulatory duties and functions
and with the engineering and the accounting witnesses for the City, advice
and assistance to such witnesses in the preparation of their testimony
and exhibits, the study and analysis of all evidence submitted by the
Company' s witnesses, conferences after the hearing with the City' s
rppresentat3v .s for the purpose of determining the findings to be made
and the rates to be established, and the preparation of the appropriate
resolutions and rate ordinance to be adopted by the City Council.
The per diem charge of 100 for attendance at the hearing will,
of course , include the cross-examination of the Company' s witnesses
and the presentation of evidence by the witnesses for the City.
s I have stated above , the fees mentioned do not pertain to any
services which might become necessary should Peoples water and Gas Company
take legal action to enjoin or otherwise prevent the effectiveness of the
rate ordinance which the City Council will adopt. Should litigation in-
volving the City of `Sia:iii Beach develop as a result of the adoption of
such ordinance , and should the City desire to employ me in connection
with such litigation, I am confident that we shall bu able to reach a
mutually satisfactory agreement as to the fees for my further services.
