SUMMARY OF TENANTS' RIGHTS •UNDER THE
RENT STABILIZATION LAW
1. Unless the rent is adjusted by an order of the Rent Administration, a
tenant is only to pay that rent which had been in effect for his accommo-
dation on the freeze date of October 16, 1974.
2. A tenant is entitled to receive the same minimum services which had been
provided or were required to be provided to his individual housing accommo-
dation or the premises as a whole on the freeze date.
j No increase in the maximum rent may be obtained because a new lease has
been entered into by either the tenant in occupancy or by a new tenant.
4. Housing accommodations in boarding houses, hotels, motels or rooming houses
are not subject to rent control except where the occupant of an accommodation
on the freeze date had been occupying the unit pursuant to a lease with a
term of not less than one year; had been in continuous occupancy of the unit
for one year or had rent paid for one continuous year. Upon vacating the
accommodation, it no longer is subject to rent control.
5. So long as the tenant continues to pay the legal maximum rent for his
accommodation, he may not be evicted, even if no lease is in existence,'
unless he is using his accommodation for illegal or immoral purposes. Should
the landlord seek to obtain the accommodation for his own use or occupancy
or that of a member of his immediate family or if the landlord wishes to
demolish the property or if the landlord wishes to permantently withdraw
the housing accommodations from the housing market, the landlord must first
it apply to the Rent Administration office for permission to evict the tenant
or tenants.
6. A tenant or tenants may apply for a reduction in the maximum rent of their
accommodations on the grounds that there has been a reduction in the mini-
mum service standards affecting the individual housing accommodation or the
premises as a whole. The necessary forms are available at the Rent Adminis-
tration office.
7. All parties will be apprised of any proceedings brought before the Rent
Administration and copies of all orders issued by the Rent Director
will be served upon all parties.
8. Any dispute or disagreement concerning the rent being charged should be
brought to the attention of the Rent Administration.
