280-97 RDA RESOLUTION NO. 280-97 A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, AUTHORIZING THE MIAMI BEACH REDEVELOPMENT AGENCY AND THE CITY ADMINISTRATION TO MAKE OFFERS TO ACQUIRE ADDITIONAL PROPERTIES FOR THE CUL TURAL CENTER PROJECT DURING THE SUMMER RECESS, SUBJECT TO RATIFICATION BY THE MIAMI BEACH REDEVELOPMENT AGENCY ON SEPTEMBER 10, 1997. WHEREAS, the City of Miami Beach (the "City") and the Miami Beach Redevelopment Agency ("RDA") are proceeding with their goal of economic stimulation and development by assisting in the development of a cultural center, consisting of a Metro-Dade Regional Library, the site for the Miami City Ballet facility, a parking garage, and other related facilities (the "Cultural Center") within the City Center/Historic Convention Village Redevelopment and Revitalization Area; and WHEREAS, for the purpose of realizing the Cultural Center project, the Chairman and Members of the RDA, have heretofore approved the acquisition by purchase, donation or eminent domain, each of the properties (the "Properties") having street addresses of 340 23rd Street ("Property 1 "), 300 23rd Street ("Property 2"), 313 22nd Street ("Property 3 "), 224 23rd Street ("Property 4"), 227 and 245 22nd Street ("Property 5"), and 211 22nd Street ("Property 6"), Miami Beach, Florida, each being legally described on Exhibit "A" attached hereto and incorporated by reference herein; and WHEREAS, it would be advantageous for the Agency to avoid the expense of eminent domain and to acquire said Properties as expeditiously as possible by purchase. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY that the RDA and the City Administration are hereby authorized to negotiate the purchase of any or all of the Properties and to make offers thereon subject to ratification by the Chairman and Members of the RDA on September 10, 1997, or as soon as possible thereafter. BACKGROUND: The Administration is pursuing acquisition of the remaining parcels. While we are able to work with some owners, others will probably end up as eminent domain cases. In the event that another opportunity arises to acquire a property outside of eminent domain, the Administration wants the ability to negotiate and make additional offers subject to ratification by the Commission at its September 10, 1997 meeting. ANALYSIS: The Administration believes that the ability to negotiate and make offers subject to Commission ratification would facilitate assemblage of the Cultural Center site and may provide cost savings in light of attorney fees, other fees and costs, and the potential of higher prices for acquisition that could be associated with the takings by eminent domain.
