WHITE WAY IMPROVEMENT DISTRICT
WW-85 WW-85
WHEREAS, the City Council, by Resolution passed and adopted
on the 20th day of April, 1949, ordered White ',Jay Improvement
WW-85, District WW-85 , and has caused to be prepared and filed
with the City Clerk plans and specifications of such improvement
and an estimate of the cost thereof, including an estimate of
the cost of the incidental expenses of said improvement, and
WHEREAS, due notice by publication as required by the City
Charter has been made that the City Council would on the 4th
day of May, 1949, at the City Hall in said City of Miami Beach,
at 10:00 o' clock A. M. , receive and hear objections of all
persons interested to the confirmation of said Resolution order-
ing said improvement, and no objections having been presented at
the time and place aforesaid,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the said Resolution of said
City Council ordering said White Way Improvement WW-85, District
W- 5, be and the same is hereby confirmed; that the City Council
does hereby declare its intention to have the work necessary to
the accomplishment of said Improvement done by the City forces
without contract; that the City Council does hereby declare its
intention to issue bonds of the said City to the amount required
for such Improvement, to levy a special annual tax for the payment
of the principal and interest of said bonds, reducing the amount
of the special annual tax levy therefor by the amounts collected
from special assessments levied against properties abutting the
highway where said Improvement shall be made and by any other
amount then contained in the local Improvement Bond Fund, and to
levy special assessments against the properties abutting the high-
way to be improved in accordance with the above mentioned reso-
lutions for the cost thereof, not including intersections of
highways the cost of which shall be apportioned to the City of
Miami Beach; and
BE IT FURTHER RESOLVED that the City Council declares its
intention to advance the cost of said Improvement from the pro-
ceeds of the sale of its bonds, to collect said special assess-
ments and place the proceeds thereof, together with the amount
collected from such special tax, in its local Improvement Bond
Fund to pay the interest and principal of its bonds, paying said
principal and interest, so far as possible, from collections of
said special assessments and paying any balance from the proceeds
of such special tax; and
BE IT FURTHER RESOLVED that the sum of$15,158.00 is hereby
appropriated for the cost of said ImproVement from the proceeds
of the sale of said bonds as and when the same shall be accom-
plished and the sum of $151.58 is hereby appropriated from the
General Fund for preliminary expenses incidental to the carrying
out of this Resolution.

The attached resolution is a copy of one used on numerous whiteway
assessments financed temporarily from Current Fund Surplus, which would be
later reimbursed from whiteway bond monies .
Twelve new whiteway improvements were confirmed on September 19, and
the Accounting Department now advises us that it is no longer necessary to
borrow from Current Fund Surplus, as the appropriation can be made directly
from the whiteway bond fund.
Will you kindly advise us the form of resolution we should use? I am
also attaching a resolution setting up an appropriation from whiteway bonds .

WHEREAS, the City Council, by resolution passed and adopted

Improvement , District , and the City Engineer has
prepared and filed with the City Clerk plans and specifications
of such improvement and an estimate of the cost thereof, includ-
ing an estimate of the cost of the incidental expenses of said
improvement, and whereas due notice by publication as required
by the City Charter has been made that the City Council would on
the day of , 19 , at the City Hall in said
City at 1000 o ' clock A. M. , receive and hear objections of all
persons interested to the confirmation of said resolution ordering
said improvement, and no objections having been presented at the
time and place aforesaid,
THEREFORE, BE IT RESOLVED by the City Council of the City of
Miami Beach, Florida, that the said resolution of said City Council
ordering said Whiteway Improvement , District , be
and the same is hereby confirmed, and the City Council does hereby
declare its intention to levy a special assessment against the lands
comprising said District for the payment of the costs and
expenses of said improvement, and for the purpose of advancing such
costs and expenses , $ is hereby temperecfily appropriated
from Current Fund rplus , to he reimbursed fyei the unexpended
balance of proceeds from the sale of the "Whiteway Lighting System
Bonds" dated August 1st, 1949 and sold September 28th, 1949, after
all cost and incidental expense of construction of Whiteway Improve-
ments designated WW-62 to WW-95, both inclusive, have been fully
paid out of said proceeds of sale; that the City Council does here-
by declare its intention to have the work necessary to the accom-
plishment of said improvement done by the City Forces without
contract; that the City Council declares its intention to collect
said special assessments and place the proceeds thereof in its
local Improvement Bond Fund .
