RESOLUTION NO.
285-97
A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY APPROVING THE
NEGOTIATED SETTLEMENT REACHED IN MIAMI BEACH
REDEVELOPMENT AGENCY v. AZCUI. ET AL, 11TH CIRCUIT
COURT CASE NO. 89-23516, CONCERNING PARCEL NO.6
THEREIN.
WHEREAS, Attorney John C. Lukacs, outside counsel representing
the Miami Beach Redevelopment Agency, has negotiated with Robert N.
Reynolds, Esquire, representing Parcel No. 6 ln Miami Beach
Redevelo~ment Agency v. Azcui. et aI, with regard to the
outstanding issue of full compensation arising out of the
condemnation by the Agency of said parcel; and
WHEREAS, the negotiated sum for said compensation is in the
amount of $200,000, contingent upon approval by the Agency; and
WHEREAS, payment of the $145,000 into the Registry of the
Court has previously occurred; and
WHEREAS, an additional deposit in the amount of $55,000 will
be required to complete the settlement; and
WHEREAS, in light of the above, the Agency's Executive
Director and General Counsel recommend approval of the negotiated
settlement in the amount of $200,000, which requires an additional
$55,000 to be deposited into the Registry of the Court.
NOW, THEREFORE, BE IT DULY RESOLVED by the Chairman and
Members of the Miami Beach Redevelopment Agency that the
recommendation of the Executive Director and General Counsel
regarding approval of the negotiated settlement in the amount of
$200,000 concerning Parcel No. 6 in Miami Beach Redevelo~ment
Agency v. Azcui. et aI, 11th Circuit Court Case No. 89-23516, is
hereby accepted, and said negotiated sum is hereby approved.

Reached for MERDA v. Azcui, et aI, Parcel No.6, South
pointe Paint & Body Shop, in the South Pointe
Redevelopment Area.
RECOMMENDATION:
Approve the Resolution.
BACKGROUND:
At the executive session held on September 24, 1997, John C.
Lukacs, outside counsel to the Redevelopment Agency (Agency),
reported on the negotiations for settlement of MBRDA v. Azcui, et
aI, Parcel No.6, South pointe Paint & Body Shop. The attached
correspondence from Mr. Lukacs recommends a settlement amount of
$200,000, exclusive of reasonable fees and costs. The Miami Beach
. Redevelopment Agency previously deposited $145,000 in the Registry
of the Court. A deposit of $55,000 will be required to complete
this settlement.
ANALYSIS:
The negotiated settlement as presented and approved at the above-
referenced executive session is being brought to the Agency Board
for formal action.
