Resolution 7089 RESOLUTION NO. 7089 WHEREAS, the City of Miami Beach, Florida, has heretofore complied with all provisions and reouirements of Chapter 22645, Laws of Florida, Acts of 1945, as amended by Chapter 26320, Laws of Florida, Acts of 1949, for the imposition of a municipal tax upon the retail sale of cigarettes within its territorial limits, and WHEREAS, by virtue of Section 210.21 of the said Act, certain formulae are provided, in the alternative, for the methods of couputation of the reduction of the operating ad valorem tax millage to be levied by the municipality, and WHEREAS, upon due consideration it is deemed to be in the best interest of the City of Miami Beach, and it is the intent and desire of the City Council of the City of Miami Beach, that this City adopt the method hereinafter set forth, NOW, THEREFORE, BE IT RESOLVED b; the City Council of the City of Miami Beach, Florida, that the reduction of the municipal ad valorem tax in and for the City of Miami Beach Florida, shall be by the method described in Section 210. 21 (1) ( e) of Chapter 22645, Laws of Florida, Acts of 1945, as amended by Chapter 26320, Laws of Florida, Acts of 1949, which reads as follows: "As an alternative to the, orovisions and recuirements of the foregoing paragraphs (a)-(d) , inclusive, fifty per cent of the additional cigarette tax revenue received by any municipality during any twelve month period subsequent to November 1, 1949, under the provisions of this chapter over any cigarette tax revenue which it received during the twelve months ending November 1, 1949 or so much thereof as shall be neces- sary for the purpose, shall be placed in the sinking fund of the municipality to reduce the ad valorem deLt service millage or appropriation required to provide the annual debt service reouirements of said municipality for its general obligation bonds issued for the functions and ourposes set forth in sub-section ( 5) of Section 210.03 of this chapter, and the balance of said revenue shall be used for the said purposes set forth in said paragraph Pf said sub-section. " BE IT FURTHER RESOLVED that the City Clerk be and he is hereby authorizedand directed to transmit certified copies of this resolution to the Director of the Beverage Department of the State of Florida and to Clarence iii.
