Resolution 7159 R3SOLUTION NO. 7159
WHEREAS, the City of Miami Beach, Florida, has heretofore
entered into an agreement with E. L. Lockhart and Hildah W. Lock-
hart, his wife, Henroco Holding Co. , Inc. , a Florida Corporation,
and hase Federal Savings and Loan Association, a United States
Corporation, said agreement being dated the 14th day of November,
1949, and being recorded in Deed Book 3234, page 415, of the Public
Records of Dade County, Florida, and
WHEREAS, the work contemplated by said agreement has been
completed and paid for by said Henroco Holding Co. , Inc. , and
WHEREAS, the said City has advanced to said Henroco Holding Co. ,
Inc . , the sum of $9,677.88 representing the full cost of the construc-
tion of the seawall or bulkhead as contemplated by said agreement,
and said City by making such advance has, under the terms of said
agreement, acquired and now holds a lien for said $9,677.88 against
the lands described therein, and
WHEEAS, at the time of the execution of said agreement it was
understood between the parties that said Henroco Holding Co. , Inc. ,
would be accorded any more advantageous terms which might be given
by said City to others similarly situated, and
WHEREAS, subsequent to the date of said agreement the said City
has entered into agreements with others similarly situated, by the
terms of which agreements the maximum amount of the lien to be acquired
by said City upon the respective properties was fixed at $35.00 per
lineal foot of bulkhead constructed or to be constructed by the City,
NOW, THEREFORE, BE IT RESOLVEDby the City Council of the City
of Miami Beach, Florida, that the aggregate amount of the lien ac-
quired by said City by he terms of said agreement of November 14
1949, be and the same is hereby reduced from $9,677.88 to $5,670.00 .
PASSED and ADOPT this 19th day of April, A. D. 1950.
