Resolution 7162 RESOLUTION NO. 7162 A RESOLUTION AMENDIN^ RESOLUTION NO. 7122, PASSED AND ADOPTED ON MARCH 1, 1950. SIDEWALK IMPROVEMENT DISTRICT SK-136 SK-136 WHEREAS, the City Council of the City of Miami Beach, Florida, did on March 1, 1950, pass and adopt Resolution No. 7122, wherein certain prima facie assessments for the cost of Sidewalk Improvement SK-136, District SK-136, as filed with the City Council on February 15, 1950, were confirmed; and WHEREAS, it has subsequently been determined that a modification and reduction in said assessments should have been made as to one certain lot or parcel as hereinafter described; NOW, THEREFORE, BE IT RESOLVED by the said City Council that Resolution No. 7122 be and the same is hereby amended to read as follows: "WHEREAS, the City Council of the City of Miami Beach, Florida, met on March 1, 1950, pursuant to the notice under Sections 29 and 30 of the Charter of the said City to hear all written objections to the con- firmation of the preliminary assessment roll of Sidewalk Improvement SK-136, District SK-136, by any person whose property is described in said preliminary assessment roll, which rollwas filed with said City Council on February 15, 1950, and "WHEREAS, the City Council, having received no written objections filed to the confirmation of said preliminary assessment roll by any per- son whose property is described in said roll, "NOW, THEREFORE, BE IT RESOLVED by the City Council of Miami Beach, Florida, that the assessments as indicated on said preliminary assessment roll, be and the same are hereby modified and reduced, the amount by which said assessments are hereby reduced being hereby charged to the City at large, so that the assessments shall be as follows, it being hereby decided that the special benefits to said lots on account of the reasons given, are those benefits as stated below, after such reduction and modification, and that said assessments as modified and reduced are in all things con- firmed and sustained against said lots and/or parcels described therein: MODIFICATION AND REDUCTION OF ASSESSMENTS IN ASSESSMENT ROLL FOR SIDEWALK DISTRICT SK-136 DESCRIPTION REASON FOR PRELIMINARY ASSESSMENT AFTER ADJUSTMENT ASSESSMENT MODIFICATION AND ADJUSTMENT NORMANDY BEACH SOUTH, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 21, AT PAGE 54, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA Lot 5, Block 12 Constructed by 50.0' @ 2.202393 a $110.12 .00 owner "BE IT FURTHER RESOLVED that the sums and amounts assessed against each of the lots or parcels of ground described in said preliminary assess- ment roll, after modification as above set forth, and the sums and amounts against each of the lots or parcels of ground therein set forth, after - 1 - said modification has been made, are less than the amounts each lot or par- cel of ground is benefited by said improvement and that the total assess- ments as indicated on said assessment roll in the sum of One Thousand, One Hundred Four Dollars and Twenty-eight Cents ($1,104.28) , are hereby approved and confirmed . "BE IT FURTHER RESOLVED that ten days after this confirmation of said assessment rollthe same be delivered to the City Clerk and the City Clerk is hereby ordered , thirty days after the date of this resolution, to make collection of the assessments therein as required by law, provided, however, that the owner of any lot or 'carcel of land which shall have been assessed in excess of $25.00 may, before the lapse of said thirty days, file with the City Clerk his written undertaking, waiving all irre- gularities and illegality in connection with said assessments against said lot or parcel and agree to pay the same in equal instalments in each of the five succeeding years at the times in said years at which the general City taxes are due and payable, with interest upon said deferred instal- ments at the rate of six per cent per annum from date of said confirma- tion, which said five year period is hereby fixed and determined by the City Council." BE IT FURTHER RESOLVED that nothing herein contained shall be construed as changing the date of confirmation, nor the collection in- structions given to the City 2lerk in Resolution No. 7122 as to all lots and parcels in said assessment roll with the exception of the one lot adjusted herein, but it is intended that this resolution shall apply only to Lot 5, Block 12, Normandy Beach South, the assessment against which is herein adjusted.
