WHEREAS, on Ju1y 10, 20d2, the City Commissian approved revisions ta the rental rate structure for the Jackie Gleason Theater of the Perfarming Arts, allawing far a"black box" canfiguratian rent structure af $15Qp far approximately 804 seats in a cut-dawn configuration of the Theatsr; and WHEREAS, since the closing of the Colony Theater for renavations, certain arganizatians with a history of use at the Colony have been displaced and greatly affected financially in their venus availabilities, with even the reduced rate apparkunity at the Gleason Theater praving financially difficult for these groups to affard said rental costs; and WHEREAS, in an effort to accommodate these groups during this time of canstructian, the Administratian, and SMG, as managing agent far the Gleason Theater, are requesting additional pricing discretion in the negotiatic�n of rentaf rates at the Theater with regard to these displaced Calony Theater users, in order ta accommadate their needs; and WHEREAS, the exact pricing wauld be addressed on a case by case basis, taking inta accaunt previous users of the Calony Theater wha are now displaced by the construction; previous rental rates incurred by them at the Colony; duration of the proposed use at the Gleason 7heater and number of performances; and other associated financial variables; and WHEREAS, it is the intent #hat this plan would be in place during the construction periad af the Golony Theater, with the additional understanding that SMG will continue to use its best efforts, per its Management Agreement with the City, to maximize revenues at the facility while accommodating these special temporary circumstances; and WHEREAS, on Februaryr 11, 2Q03, the Community Affairs Gommittee met ta discuss this issue, specifically as it relates to the upcoming Gay and Lesbian Film Festival, and adopted a motion that reduced rates {equivalent to the Colony Theater rates) be offered at the Jackie Gleason Theater of the Performing Arts to any group who has been using the Colany Theater and is now displaced because of the cans#ruction of the Colony, as we11 as any group who may not have a track record but who meet the Visitor and Convention Authority's criteria for an approved event. All requests must be presented ta the Convention Center Advisory Board (CCAB) for its review. This rate reduction at the Jackie Gleason would be in effect only while the Colony Theater is under construction. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve revisions to the rental rate structure of the Jackie Gleason Theaterof the Performing Arts to allow for certain defined pricing discretion in negotiation of rates with users of the Colony Theater, which users are displaced during the Colony Theater construction. Issue: Shall the City Commission allow for certain defined pricing discretion negotiability for users of the Colony Theater during the Colony Theater construction? Item Summary/Recommendation: Since the closing of the Colony Theater for renovations, certain organizations have been affected financially in their venue availabilities proving financially difficult for these groups to afford the rental costs. Therefore, in an effort to accommodate these groups during this time of construction, the Administration, and SMG, as managing agent for the Gleason Theater, are requesting additional pricing discretion neqotiability with regard to these smaller capacitv users in order to accommodate their needs. ADMINISTRATION RECOMMENDATION: Approve the Resolution. ANALYSIS On July 10, 2002, the City Commission approved revisions to the rental rate structure for the Jackie Gleason Theater, allowing for a"black box" configuration rent structure of $1500 for approximately 800 seats in a cut-down configuration of the theater. Since the closing of the Colony Theater for renovations, certain organizations with a history of use at the Colony have been greatly affected financially in their venue availabilities, with even this reduced rate opportunity at the Gleason Theater proving financially difficult for these groups to afford the rental costs. Therefore, in an effort to accommodate these groups during this time of construction, the administration, and SMG, as managing agent for the Gleason Theater, are requesting additional pricing discretion negotiability with regard to these smaller capacity users in order to accommodate their needs. The exact pricing would be addressed on a case by case basis, taking into account previous rental rates incurred at the Colony, number of performances, and other associated financial variables. It is the intent that this discretion would be in place during the construction period of the Colony Theater, with the additional understanding that SMG will continue to use its best efforts, per its agreement with the City, to maximize revenues at the facility while accommodating these special temporary circumstances. On February 11, 2003, the Community Affairs Committee met to discuss this issue, specifically as it relates to the Gay and Lesbian Film Festival. The Committee adopted the following motion: That reduced rates (equivalent to the Colony Theater rates) be offered at the Jackie Gleason Theater of the Performing Arts to any group who has been using the Colony Theater and are now displaced because of the construction of the Colony, as well as any group who may not have a track record but who meet the Visitor and Convention Authority's criteria for an approved event all requests must be presented to the Convention Center Advisory Board (CCAB) for review. This rate reduction at the Jackie Gleason would be in effect only while the Colony Theater is under construction. The proposed resolution was favorably approved by the Committee and recommended the Convention Center Advisory Board (CCAB) also favorably consider and review the proposed request. The CCAB meeting is scheduled on Monday, February 24, 2003. CONCLUSION: The Mayor and Commission should approve the recommendations.
