Resolution 7277 RESOLUTION NO. 7277 WHEREAS, a certain building has heretofore been erected upon that certain parcel of land situate in the City of Miami Beach, Florida, described as follows: Lot 6 of Block 3 of HAYNSJORTH BEACH SUBDIVISION, according to the Plat thereof recorded in Plat Book 4+1, at page 2, of the Public Records of Dade County, Florida, and WHEREAS a survey was made on April 6th, 1950, by Ray Gordon? Registered Land Surveyor No. 557, State of Florida, a copy of which survey is attached hereto, which survey reveals that said'building encroaches a distance of one (1) foot upon a certain public easement, six (6) feet in width, along the easterly end of the above-described lot, and .IHi 2AS, it is the opinion of the City Council that said en- croachment was unintentional and does not materially affect and interfere with the contemplated use of said easement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that insofar as said City Council has the power to bind the City of Miami Beach in the premises, no action of any kind whatsoever shall be taken by the said City to require the owners of the said property, their heirs, successors and assigns, to move, or remove, the portion of the structure encroaching upon said easement as aforesaid.
