Resolution 7369 RESOLUTION NO. 7369 WHEREAS, on September 12, 1950, Alcoholic Beverage License #15 was issued unto Old Forge, Inc. , by the City Clerk of the City of Miami Beach, Florida, for the sale of liquors at its restaurant at 432 Forty-first Street, Miami Beach, Florida, in which license it is among other things recited that said selling of liquors is always "subject however to all provisions of City Ordinances and all State and Federal Laws for the regulation of said business, and particularly Ordinance No. 391 of the City of Miami Beach as amended" , and "issued subject to the restrictions imposed by the Liquor Zoning Ordinance" , said ordinance being numbered 402, and WHEREAS in Section 8 of said City of Miami Beach Ordinance No. 402, it is provided as follows: "Section 8: In "F" District the sale of liquors is pro- hibited except from service bars in bona fide restaurants." and WHEREAS, complaint has been made before the City Council of the City of Miami Beach that on the premises of the Old Forge Restaurant, located at 432 Forty-First Street, Miami Beach, Florida, which said location is within "F" District as created and defined by City of Miami Beach Ordinance No. 402, are being operated a bar and cocktail lounge and package store whereat liquors are being sold in violation of Section 8 of the City of Miami Beach Ordinance No. 402, and WHEREAS, at its regular meeting on November 15, 1950, the City Council of the City of Miami Beach gave a full hearing to all persons desiring to be heard upon the said subject, and did receive and consider the statements of the complainants and also the statements of the representatives and operators of the bar and package store now being conducted upon the Old Forge Restaurant premises, in the course of which said statements, Mr. Goldworm, the said representative of the operators of the said bar and package store admitted the sales of liquors at said bar, (cocktail lounge) and package store at 432 Forty-First Street, Miami Beach, which said sales admittedly do not constitute the sale of liquors from service bars in bona fide restaurants as defined ay the ordinances of the City of Miami Beach, and WHEREAS the application of counsel for the licensee for further consideration of the matter at a later date was granted and the City Council did pursuant to such request fix the Council meeting of Wednesday, December 13, 1950 as the time for the re- ception and consideration of any and all additional facts and arguments, if any, to be at such time, and date presented by the parties in interest and due notice was given the parties, and the counsel for the respective parties in interest were at such time and place ful]y heard upon the subject, and NOW, THEREFORE, BE IT RESU-JTED by the City Council of the City of Miami Beach, Florida, that said Liquor and Alcoholic Beverage License No. 15, issued on September 12, 1950, by C. W. Tomlinson, City Clerk, unto Old Forge, Inc. , be and the same hereby is revoked for reason of the violation by the said licensee of the provisions of City of Miami Beach Ordinance No. 402.
