97-22410 RESO RESOLUTION NO. 97-22410 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING TO CONSIDER THE ADOPTION OF A RESOLUTION CREATING A RESIDENTIAL PARKING PERMIT AREA WITHIN THE AREA . BOUNDED BY MICHIGAN A VENUE ON THE EAST, LENOX COURT ON THE WEST, 12TH STREET ON THE SOUTH, AND 15TH STREET ON THE NORTH, PURSUANT TO SECTION 44-84 OF THE MIAMI BEACH CITY CODE. WHEREAS, the residential community in the Flamingo Park (Lenox and Michigan) single family neighborhood ha 'e expressed their interest in the creation of a Residential Parking Permit Area to increase the level of available parkiJg during evening hours; and WHEREAS, pursuant to Section 44-84 of the Miami Beach City Code, the City Manager is authorized to detelmi Ie if a residential area is impacted by commuter vehicles in accordance with the criteria set forth in Sections 44-81 and 44-83 thereof, and after making such a determination may initiate the creation of a Residential- Parking Area; lind WHEREAS, a public hearing shall be held on the matter following the mailing of notices to every household th,t c m reasonably be established within the area(s) under consideration fifteen (15) days prior to the hearing date; and WHEREAS, the residents of the Flamingo Park (Lenox and Michigan) single family neighborhood have requeste:i it at the boundary of the proposed Residential Parking Zone include: Michigan A venue between 12th and 15th Streets Lenox Avenue between 12th and 15th Streets 12th Street between Michigan A venue and Lenox Court 13th Street between Michigan A venue and Lenox Court 14th Street between Michigan Avenue and Lenox Court City of Miami Beach Parks Department parking lot on Michigan Avenue at the baseball field NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE ell Y OF MIAMI BEACH, FLORIDA, that a public hearing to consider the adoption of a resolution creating a Resid ~nt al Parking Permit Area within the area bounded by Michigan Avenue on the east, Lenox Court on the west, 12th :;tnet on the south, and 15th Street on the north, pursuant to section 44-84 of the Miami Beach City Code, is hereby sche :lul .:d on July 2, 1997, at 5:00 P.M. in the City Commission Chambers at 1700 Convention Center Drive, 3rd Floor, 1\liaJ1i Beach, Florida, and the City Clerk is hereby authorized and directed to public and . tribute the appropriate p lie Iloti;e of said public hearing at which time and place all interested parties will be h d. ADMINISTRATION RECOMMENDATION: Approve the resolution. BACKGROUND: On May 22, 1997, the Parking Department, Parks and Recreation Department, and Pol: ce Department held a "Joint Workshop" at the Flamingo Park Police Athletic League (PAL) facillty to ascertain the viability and demand for a residential parking permit program. Several alternatiyes for implementation were discussed including: areas to be restricted by signage, hours of restrictio.1S, fee structure, and visitor permit availability. The residents of the single family neighborhood reached consensus on the boundaries of the proposed residential zone and the hours of restriction. and have asked for a public hearing to be scheduled to consider implementation of a new restric1ed residential zone. CONCLUSION: The Administration recommends that the Mayor and City Commission approve the resolution in order to set a time and.place for a public hearing at a time certain (5:00 P.M.) at the Clty Commission Meeting of July 2, 1997, to assure full opportunity for public comment.
