Resolution 7598 RESOLUTION NO. 7598 A RESOLUTION FURTHER MODIFYING AND REDUCING CERTAIN OF SAID ASSESS- MENTS CONFIRMED IN RESOLUTION NO. 7;039,5iASSED AND ADOPTED ON APRIL WHITEWAY IMPROVEMENT WW-75 DISTRICT WW--75 WHEREAS, the City Council of the City of Miami Beach, Florida, .did on April 4, 1951, pass and adopt Resolution No. 7503, wherein certain prima facie assessments for the cost of Whiteway Improvement iW-75, District WW 75, as filed with the City Council on March 21, 1951, were modified and confirmed; and WHEREAS, it has subsequently been determined that a further modifi- cation and reduction in said assessments should have been made as to certain lots or parcels as hereinafter described; NOW, THEREFORE, BE IT RESOLVED by the said City Council that certain of said assessments heretofore modified and reduced by Resolution No. 7503, be and the same are hereby further modified and reduced, the amount by which said assessments are hereby further reduced being hereby charged to the City at large, so that said certain assessments shall be as follows ; it being hereby decided that the special benefits to said lots on account of the reasons given, are those benefits as stated below, after such further reduction and modification, and that said assessments as modified and reduced are in all things confirmed and sustained against said lots or parcels described therein: FURTHER MODIFICATION AND REDUCTION OF CERTAIN ASSESSMENTS IN, ASSESSMENT ROLL FOR WHITEWAY DISTRICT WW-75 DESCRIPTION REASON FOR PRELIMINARY ASSESSMENT AFTER ADJUSTMENT ASSESSMENT FURTHER MODIFICA- TION AND ADJUSTMENT Miami Ocean View Co 's. amended Plat of Blocks 117,117A, 118 & 118A as per plat recorded in Plat Book 9, Page 70, Public Records of Dade County, Florida Lots 1 thru 6, Block 117A 1/4 frontage 252.06 ' t $1.3525883 63.02 ' @ $1.3525883 $3 .9 $85.24 Lot 6 , Block 118A 1/4 frontage 126.03 ' @ $1.3525883 31.51' @ $1.3525883 $170.47 42.62 First Addition to Espanola Villas as per plat recorded in Plat Book 9 Page 147, Public Records of Dade County, Florida Lot 1, Block 5A 1/4 frontage 78. BE IT FURTHER RESOLVED that ten days after this revised confirmation of said assessment roll the same be delivered to the City Clerk, as to those certain assessments herein further modifiea and reduced, and the City Clerk is hereby ordered, thirty aays after the date of this resolution, to make collection of these certain modified and reduced assessments as required by law, provided, however, that the owner of any lot or parcel of land which shal have been assessed in excess of $25.00 may, before the lapse of said thirty days , file with the City Clerk his written undertaking, waiving all irregularities and illegality in connection with said assessments against said lot or parcel and agree to pay the same in equal instalments in each of the five succeeding years at the times in said years at which the general City taxes are due and payable, with interest upon said deferred instalments at the rate of six'per cent per annum from date of said confirmation, which said five year period is hereby fixed and determined by the City Council. - 2 - BE IT FURTHER RESOLVED that nothing herein contained shall be construed as changing the date of confirmation nor the collection instruc- tions given to the City Clerk in Resolution No. 7503 as to all lots and parcels in said assessment roll, but it is intended that this resolution shall apply only to the lots and parcels , the assessments against which are herein adjusted, as it pertains to the amending or changing of the date of confirmation of the assessments in said assessment roll and as to collection instructions given the City Clerk.
