WHITEVVAY IMPROVEMENT DISTRICT

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,FLORIDA:
That the construction of the following described improvement is hereby
ordered to be made; the City Council hereby setting forth its intention
to proceed under Sections 29 and 30 of the City Charter:
WW-106 Both sides of Indian Creek Drive from Twenty-sixth
(26th) Street to Forty-first (41st) Street, and both
sides of Twenty-sixth (26th) Street from Collins
Avenue to Indian Creek Drive.
To be improved with a whiteway lighting system of orna-
mental posts and lamps at approximately one hundred
fifty (150) feet apart on each side with underground
connections for lighting.
As said Drive and Streets are shown on Plats recorded
in Plat Book Five (5) , Pages Seven (7) and Eight (8 )
of the Public Records of Dade County, Florida, and as
said Twenty-sixth (26th) Street and Forty-first (41st)
Street are named and designated in Ordinance No. 232.
The City Engineer is hereby directed to prepare and to file with the
City Clerk, plans and specifications of said improvement and an estimate
of the cost thereof, including an estimate of the cost of the expenses
of preliminary and other surveys, the inspection and superintendence of
the work , the preparation of plans and specifications and estimates, the
printing and publication of notices and proceedings, the preparation of
bonds , interest during construction, legal services , abstracts, etc. ,
and any other expenses necessary and proper in conducting the proceedings
and work herein provided for; and the estimated amount to be assessed
against each front foot of abutting property.
The property against which assessments are to be made for the cost of
such improvement is hereby designated as District WW-106, and is described
as follows:
All of the lots or parcels of land abutting on Indian
Creek Drive and lying between Twenty-sixth (26th) Street
and rorty-first (41st) Street, and all of the lots or
parcels of land abutting on Twenty-sixth (26th) Street,
and lying between Collins Avenue and Indian Creek Drive.
In estimating the amount to be assessed against abutting property the City
Engineer is hereby directed to apportion to the City such portion of the
total cost as shall bear the same ratio to the total cost as the length of
the street intersection bears to the total street frontage within the
district.
This Improvement shall be designated in all proceedings, assessments
and bonds as Whiteway Improvement WW-106, and the property against which
assessments therefor may be made for the cost thereof shall be designated
as WW-106.
