Resolution 7800 RESOLUTION NO. 7800
WH1f R AS? pursuant to Resolution No. 7228 passed and
adopted by the City Council of the City of Miami Beach, Florida,
on the 12th day of July, 1950, condemnation proceedings were
instituted and are now pending in connection with the taking
by the City of that certain parcel of land situate in Miami
,Beach, Dade County, Florida, described as follows , to-wit:
That part of the westerly Portion of Lot 19
of Block 8, FIRST ADDITION TO T•IID-GOLF SUBDIVISION,
according to the Plat thereof, recorded in Plat
Book 7, page 161, of the Public Records of Dade
County, Florida, more particularly described as
follows :
Commencing at a point where the south line of West
Forty-first Street intersects the east line of
Chase Avenue as same is shown on a Plat entitled
"Forty-first Street Block" recorded in Plat Book
40, page 47, of the Public Records of Dade County,
Florida, being a subdivision of the ,Ilasterly por-
tion of said Lot 19, Block 8, First Addition to
Mid-Golf Subdivision, run in a westerly direction
across Chase Avenue, along the South line of West
Forty-first Street, a distance of 60.0 feet to a
point; thence deflecting 900-00' to the left run
z in a Southerly direction along the Westerly line
of said Chase Avenue as said Chase Avenue was dedi-
cated by the Miami Beach Bay Shore Company to the
City of Miami Beach, March 14 1935, and recorded
in Deed Book 1618 page 278, Public itecords of
Dade County, Florida, a distance of 120.0 feet to
the point of beginning of the tract of land herein
described . From point of beginning run in a wes-
terly direction along a line parallel to and 120.00
feet distance southerly from the south line of said
jest Forty-first Street, a distance of 207.7 feet,
plus or minus to the westerly face of the concrete
bulkhead situated on the easterly shore of Biscayne
Waterway; thence run in a Southerly direction along
the westerly face of said bulkhead a distance of
68.9 feet, Plus or minus, to a point which is the
southwest corner of Lot 19,. Block 8, as shown on the
above mentioned Plat of First Addition to Mid-Golf
Subdivision, thence run in an easterly direction
along the dividing line between Lots 18 and 19
Block 8, as shown on above mentioned Plat of First
Addition to Mid-Golf Subdivision, a distance of
202.7 feet to a point; thence run in a Northerly
direction along the westerly line of said Chase
Avenue a distance of 68.71 feet to Point of Beginning
containing 0,35 acre, more or less.
AND `:IHEREAS, the owner of said lands, Mr. Henry Hohauser,
has indicated his willingness to accept the sum of 433,000.00 as
the purchase price for said lands and has expressed his willingness,
in consideration of said sum, to convey said property to said City
by good and sufficient warranty deed, free and clear of all encum-
brances except restrictions of recor; zoning ordinances of the
City of Miami Beach, Florida; taxes for the year 1951 which are to
be pro-rated as of the date of closing the transaction, and

WHEREAS, the City Council deems it to be to the best
interest of said City to acquire the said lands on the terms
aforesaid, and
WHEREAS, the City Attorney has prepared and has presented
to the City Council a written agreement ,-providing for such purchase,
the City Council being familiar with the terms thereof,
NOW, THEREFORE, BE IT RESOLViD by the City Council of the
- City of Miami Beach, Florida, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute the said
agreement in the name of and on behalf of said City and that the
City Manager be and he is hereby authorized and directed to con-
summate the transaction contemplated by said agreement, when the
title to said land has been approved by the City Attorney.
BE IT FURTHER RESOLVLI) that the disbursing officers of
the City be and they are hereby authorized and directed to make
payments of the sums of money required by the terms of said agree-
ment out of funds available for such ourpose.
