Morales, City Manager t DATE: August 7, 2018 SUBJECT: North Shore Streetscape Improv:ment District Special Assessment The purpose of this LTC is to advise you of the details of the special assessment levied on the North Shore Streetscape Improvement District (the District). Recently, the City has received several inquiries regarding this special assessment. We would like to provide the Question and Answer memo attached to provide more information regarding resident inquiries. Additionally, the City will be sending courtesy letters to all past due customers. The District and special assessment was approved in 1994 and 1995 by Resolutions 94-21437 and 95-21488 which ordered the acquisition, construction and installation of the North Beach Streetscape Improvement Project to address traffic flow, drainage, signage, alley lighting and greenery to create an attractive environment which would provide enhanced property values, economic stimulus and investment, enhanced infrastructure, improved retailing and business environment, and enhance the image and character of the North Beach area. The North Beach area is generally described as Collins Avenue, from 59th Street to 76th Street: Ocean Terrace Area, from 73rd Street to 75th Street; and 71st Street— Normandy Drive, from the Ocean to Rue Notre Dame. Properties in the District benefitting from the improvements were collectively levied a special assessment of approximately $7 million. The collection of the annual assessment began in March 2000. The City bills annually over a 20-year period and the last of the billings will occur in March 2019. A special tax assessment is a funding contribution collected from property owners within a geographic arca for a special purpose. A special tax assessment is charged to all properties within a special improvement district or benefit area to defray a portion of the costs for the improvements. Why are we the only ones paying for these improvements? You arc not. You are only paying for a portion of the total cost. The City of Miami Beach pays for the balance from other funding sources such as the State of Florida's Department of Transportation. The North Shore Streetscape improvements total cost was $21.5 million. The assessments defrayed approximately $7.1 million of the cost and the City of Miami Beach pays the balance of$14.4 million from other funding sources. How is the amount of the tax calculated? In the North Shore Streetscape Improvement area, linear front footage and linear inside footage on abutting streets assessed the tax. What are the boundaries of each special assessment district? The North Shore Streetscape Improvement Special Assessment area of North Beach is generally described as Collins Avenue, from 59th Street to 76th Street; Ocean Terrace Area, from 73rd Street to 75th Street; and 71St Street—Normandy Drive, from the Ocean to Rue Notre Dame. When was a decision made to levy this special tax? Over 200 community meetings were held over several years to discuss the development of a comprehensive plan for overall redevelopment and revitalization of North Shore. Boundaries of the projects and descriptions of work to be completed, and cost estimates were identified. After public hearings were held on the special assessment, the North Shore Streetscape Improvement Special Assessment on December 21, 1994. If you were a new property owner since 1994, the tax assessment lien was disclosed in your lien statement at the time your property changed titles. If the special tax was approved in 1994, why did the City wait so long to make to send the assessment invoice? The tax assessment could not be invoiced until three months after the City accepted the completion of the improvement projects, which was in December 1999. If you cannot afford to pay the entire amount assessed before the due date, what other options are available? The City has given you the choice to either make a payment in full or make payment installments with eight-percent interest until the assessment has been paid in full. If the installment option is chosen, you will receive a yearly reminder statement for the balance. For North Shore assessment, you have 20 years to pay in full. It is your obligation to pay your portion of the special assessment. What exactly was done in my area? In the North Shore area: storm water, sanitary sewer and water main improvements, signal modifications, design of Ocean Terrace Park, redesign of Ocean Terrace from 73rd Street to 75t1' Street, beach portals, lighting, sidewalks, and streetscape beautification for a total estimated cost of $21.5 million. The assessments defrayed approximately $7.1 million of the cost and the City of Miami Beach pays the balance from other funding sources. Where do I call for more information? RESOLUTION NO. 94-21437 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CREATING A SPECIAL ASSESSMENT DISTRICT TO BE KNOWN AS THE NORTH SHORE STREETSCAPE IMPROVEMENT DISTRICT; PROVIDING FOR THE LEVYING OF SPECIAL ASSESSMENTS; INDICATING THE LOCATION, NATURE AND ESTIMATED COST OF THOSE IMPROVEMENTS WHOSE COSTS ARE TO BE DEFRAYED IN PART BY THE SPECIAL ASSESSMENTS; PROVIDING THE PORTION OF THE ESTIMATED COST OF THE IMPROVEMENTS TO BE PARTIALLY DEFRAYED BY THE SPECIAL ASSESSMENTS;PROVIDING THE MANNER IN WHICH SUCH SPECIAL ASSESSMENTS SHALL BE MADE; PROVIDING WHEN SUCH SPECIAL ASSESSMENTS SHALL BE MADE; DESIGNATING LANDS UPON WHICH THE SPECIAL ASSESSMENTS SHALL BE LEVIED; PROVIDING FOR PUBLICATION OF THIS RESOLUTION; AND AUTHORIZING RELATED ACTIONS. WHEREAS,the North Beach Development Corporation(NBDC)has been working closely with the City of Miami Beach, Florida (City) in developing a comprehensive plan for the overall redevelopment and revitalization of the North Beach area, located within the corporate limits of the City(Area); and WHEREAS, the purpose of NBDC and the City's revitalization efforts is to maintain the redevelopment momentum which has been generated in the Area and to realize the promise that many business and property owners are beginning to experience, as well as to increase the sense of pride and community that the citizens of Miami Beach have for the Area; and WHEREAS,in order to continue to stimulate and ultimately realize the City and NBDC's revitalization plan for the Area, the Mayor and City Commission have determined to make and acquire, or cause to be made and acquired, the public improvements set forth in Exhibit "A", attached and incorporated herein(Improvements), for that area of North Beach generally described as Collins Avenue, from 59th Street to 76th Street; Ocean Terrace area, from 73rd Street to 75th Street; and 71st Street -- Normandy Drive, from the ocean to Rue Notre Dame (District); and WHEREAS,the Mayor and City Commission wish to defray a portion of the cost of the Improvements by special assessments (Assessments); and WHEREAS,Chapter 170, Florida Statutes,as amended(Act),provides that a municipality may levy and collect special assessments against property benefited for the purpose of making public improvements, and the City wishes to proceed in accordance with the Act by creating a special assessment district to be known as the "North Beach Streetscape Improvement District", for the Purpose of making the Improvements within the District; and WHEREAS, the Mayor and City Commission have further determined that benefits will accrue to the property improved within the District,and that Assessments will be made in proportion to the benefits received,all as set forth in Exhibit "B",attached and incorporated herein; and WHEREAS,the Mayor and City Commission have further determined that the Assessments to be levied will not exceed the benefits to the property improved thereby. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA THAT: SECTION 1. All findings and recitals contained in this Resolution are hereby adopted and incorporated herein. SECTION 2. The City hereby determines to make the Improvements. Assessments shall be Ievied in accordance with the provisions of the Act, and as described herein, to defray a portion of the cost of the Improvements. SECTION 3, In accordance with Ordinance No. 92-2782, adopted by the City on June 17, 1992(Home Rule Ordinance),it is hereby determined that the provisions of the Home Rule Ordinance shall not apply to the Assessments levied and imposed pursuant to the provision of this 2 • Resolution. Resolution No. 93-20699, as adopted by the Mayor and City Commission on January 20, 1993, pursuant to the Home Rule Ordinance, is hereby repealed. SECTION 4, The nature of the Improvements is set forth in Exhibit "A",attached and incorporated herein, and more specifically described in the plans and specifications on file with the City Clerk. SECTIONS. The District upon which the Assessments shall be levied shall incorporate the total area as set forth in the map attached and incorporated herein as Exhibit"C",and reflecting the Iegal description as set forth in Exhibit "D",attached and incorporated herein. SECTION 6. The estimated cost of the Improvements, including, without limitation, costs of construction, labor and materials, cost of plans, specifications and surveys, engineering and legal expenses, financing charges, capitalized interest and contingency, is approximately $18.25 million($18,250,000.00) (Estimated Cost). SECTION 7, The Assessments will defray approximately $7,341,631.20 of the Estimated Cost, the balance to be paid by the City from other available funds. SECTION 81 The Assessments with respect to all properties within the District shall be made on the basis of linear front footage and linear inside footage, all as more particularly described in Exhibit "E", attached and incorporated herein. SECTION 9. In the event the actual cost of the Improvements exceeds the Estimated Cost, such excess shall also be paid by the City from other available funds. SECTION 1 0. The Assessments shall be levied on all lots and lands which are adjoining,contiguous,bounding or abutting upon the Improvements or specially benefited thereby, and further designated on the Assessment plat referenced below within the boundary of the District. 3 • • SECTION 11, At the time of adoption of this Resolution,there is on file with the City Clerk, an Assessment plat showing the area to be assessed, with plans and specifications,and an estimate of the cost which is open to inspection by the public. SECTION 12% The City Administration is hereby authorized and directed to cause to be made a preliminary assessment roll, as promptly as possible, which shall show the lots assessed,the amounts of benefit to and the Assessments against each lot and the number of annual installments into which the Assessments are divided. SECTION 13. Assessments shall be payable at the Office of the Finance Director of the City over a period of twenty(20)years, in equal annual principal installments, plus interest thereon at a rate of interest equal to eight percent(8%)per annum computed on the unpaid balance thereof from the date of acceptance of the Improvements by the City. The annual installments and interest payments shall be due and payable on the first day of the month occurring three(3)months after acceptance of the Improvements by the City, and on the same day of each year thereafter until paid in full. Annual installments not paid when due shall become due and payable in accordance with the provisions of the Act. Assessments with respect to any property may be prepaid in whole, but not in part,on any date after the Improvements have been completed and accepted by the City, by presenting to the Finance Director of the City monies sufficient to pay the remaining unpaid balance of the Assessments plus interest to accrue to the next succeeding annual installment due date (or to the second succeeding annual installment due date if such prepayment is made within forty- five(45)calendar days of the next succeeding annual installment due date);provided,however, that Assessments with respect to any property may be prepaid in whole, but not in part,without interest (other than interest which is part of the Estimated Cost),at any time within thirty (30)days after the 4 Improvements are completed and accepted by the City,by presenting to the Finance Director of the City monies sufficient to pay the unpaid balance of such Assessments. The Finance Director of the City shall mail to each property owner within the District bills for each annual installment at least thirty(30) days before their due date. SECTION 14. Upon completion of the preliminary assessment roll,the Mayor and City Commission shall adopt a subsequent resolution to fix a time and place at which the owners of the property to be assessed or any other persons interested therein may appear before the Mayor and City Commission and be heard as to the propriety and advisability of the Assessments or the making of the Improvements,the costs thereof,the manner of payment therefor,or the amount thereof to be assessed against each lot as improved, all in accordance with the Act. SECTION 15. The City Clerk is hereby directed to cause this Resolution to be published once in a newspaper of general circulation within the City. SECTION 16, The City Administration is hereby authorized and directed to take all actions necessary to carry out the intent of this Resolution. SECTION 17. This Resolution shall take effec •pon its adoption. WHEREAS, Chapter 170 , Florida Statutes, as amended (Act) , provides that a municipality may levy and collect special assessments against property benefitted for the purpose of making __ --_ --public improvements; and WHEREAS, on December 21 , 1994 , by Resolution No. 94-21437, the Mayor and City Commission of the City of Miami Beach, Florida, declared the creation of a special assessment district known as the North Shore Streetscape Improvement District , for that area of North Beach generally described as Collins Avenue, from 59th Street to 76th Street;, Ocean Terrace area, from 73rd Street to 75th Street ; and 71st Street - Normandy Drive, from the ocean to Rue Notre Dame (District) , for the provision of those certain public improvements as set forth in Exhibit "A" of Resolution No. 94-21437 (Improvements) , attached and incorporated as Exhibit No. 1, all in accordance with the applicable provisions of the Act; and WHEREAS, a preliminary assessment roll has been filed with the Office of the City Clerk indicating the lots and lands to be assessed, the amount of the benefit to and the assessment against each lot and/or parcel of' land, and the number of annual installments in which the assessments are divided, all as required by the Act; and WHEREAS, pursuant to Resolution No. 94-21438 , the Mayor and City Commission held a public hearing on February 1, 1995 to hear testimony from all property owners and any other interested persons regarding the propriety, advisability and- cost of making the Improvements in the District; and 1 • WHEREAS, all affected property owners have received appropriate notice of the public hearing, as prescribed by the Act ; and WHEREAS, all complaints, comments and objections by interested persons and affected property owners were received at the hearing and thereafter treated on the basis of justice and right, as reflected herein with regard to the Improvements and the assessments . NOW, THEREFORE, BE IT DULY RESOLVED by the Mayor and City y Commission of the City of Miami Beach, Florida: Section 1 : All recitals contained in this Resolution are hereby adopted and incorporated herein. Resolution No. 94-21437, which ordered the creation of the North Shore Streetscape Improvement District is confirmed and it is hereby determined that the Improvements set forth be provided to the District . Section 2 : A final assessment roll shall be filed forthwith in the Office of the City Clerk in accordance with this Resolution and the applicable provisions of the Act . Such assessments contained in the final assessment roll are hereby levied and stand confirmed and remain legal, valid and binding special assessment liens upon properties against which such assessments are made, until paid. These assessments shall be recorded in the Improvement Lien Book and the final assessment roll shall show the lots or lands assessed, the amount of benefit as to each such lot or land, and the manner of payment of such assessment . ADMINISTRATION RECOMMENDATION It is recommended that the Mayor and City Commission adopt the above captioned resolution which determines that certain services be provided and levies special assessments against properties in the North Shore Streetscape Improvement District to be benefitted by the provision of such services. BACKGROUND On December 21, 1994, the City Commission adopted Resolution No. 94-21437. creating a Special Assessment District to be known as the North Shore Streetscape Improvement District. At that time the assessment formula, district's boundaries, services and improvements to be provided, related budgets and preliminary assessment rolls were established. In legal compliance with Chapter 170 of the Florida State Statute. notices of the final hearing, including,assessment information, were mailed to all property owners of record on Friday, January 13, 1995. The North Beach Development Corporation has been working closely with the City of Miami Beach to develop a comprehensive plan for the overall redevelopment and revitalization of the North Beach area. � � AGENDA ITEM + 1— DATE 2- - 9.5 _ Commission Memorandum Page 2 February 1, 1995 The "North Shore Revitalization Plan" was published in March of 1986. As a result of this publication an extensive planning phase and public information process was undertaken for the North Shore Public Area Capital Improvements Project. which has now come to be known as the foundation and plan for the proposed North Shore Streetscape Improvements District herein. The Administration and City Staff have worked closely with the North Beach Development Corporation and the business and residential community affected in the area. In December 1990, after a competitive selection process, the City Commission entered into a contract with the consulting firm of Kimley-Horn & Associates. Inc. to develop, under Phase I, a conceptual streetscape plan graphically depicting the locations of sidewalk, curb, gutter, street furniture, lighting and other miscellaneous items. On April 22, 1992, the Mayor and the City Commission of the City of Miami Beach, Florida approved Resolution No. 92-20495 allowing for the reimbursement of expenses incurred on behalf-of the-North Shore Area Improvements Project from the proceeds of debt to be incurred by the City; up to a maximum reimbursable amount of S10 million. On November 4, 1992, the City Commission approved, under Resolution No. 92-20657,Phase II (Final Design) of the project consisting of the preparation of final construction plans and specification documents. On January 20, 1993, the City Commission approved Resolution No. 93-20699 ordering the acquisition,construction and installation of the North Beach Streetscape Improvement Project to address traffic flow, drainage, signage, alley lighting and greenery to create an attractive environment which should provide enhanced property values, economic stimulus and investment, enhanced infrastructure, an improved retailing and business environment, and enhance the image and character of the North Beach area. While it was the City's original intention, in the adoption of Resolution No. 93-20699, to proceed with the creation of such a District under the City's Home Rule Ordinance, it has now been determined by the Administration, the City Attorney's Office, and Bond Counsel that, in order to provide consistency with the creation of similar districts as currently in existence on Ocean Drive and Lincoln Road, and to be able to use the same financing mechanism as is being used in the Lincoln Road Capital Improvements District No. 1. that 1 the City repeal Resolution No. 93-20699 and herein proceed with the creation of the District pursuant to Chapter 170 of the Florida Statutes. Initially, this project was being developed under a City Home Rule Ordinance. As a result of litigation concerning the use of Home Rule Ordinances for special assessments by the City of Boca Raton, it was decided that this project should be developed under the provisions of Florida Statute Chapter 170; however, in order to proceed under Chapter 170, the City had to get the State Legislature to amend Chapter 170 to broaden the eligible project components thereunder. The foregoing resulted in substantial time delays. 1 • Commission Memorandum Page 3 February 1, 1995 Various improvements were additionally authorized by the City Commission after approval of Phase II. including the following: • Stormwater Improvements - • Signal Modifications • Design of Ocean Terrace Park • Sanitary Sewer Evaluations and Improvements • Redesign of Ocean Terrace from 73rd Street to 75th Street • Acquisition of required Permits • Beach Portals • Design of Electrical circuits for ornamental and special events lighting • • Water Main Improvements y y • Traffic Capacity Analysis north of 75th Street • Submittal Preparation of National Pollution Discharge Elimination System Permit - - - - _ - - (NPDES) Acquisition • Extension of Project Limits north to 76th Street and South to Indian Creek Drive Phase II (Final Design) has been completed in accordance with the contract documents. The Project Cost Estimate, Plans, Specifications for Construction and the Preliminary Assessment Roll have been filed with the City Clerk by the Director of Public Works. ANALYSIS • .1 The Project is estimated to have a design and construction cost of S14.8 Million. Additional expenses have been incurred by the City, such as permitting fees, advertisement expenses, tax roll preparation, bond counsel fees, water meter boxes, painting of mast arm assemblies and municipal bond insurance expenses. These expenses are legally assessable. Administrative expenses' as well as interest during construction incurred the City are also legally assessable. The total cost of the project, including these fees, is estimated to be $18,250,000 as follows: Construction and Design S14,800,000 Interest During Construction 2,250,000 Public Works Administrative Fees 250.000 Billing Administrative Fees 250,000 Maintenance of Traffic 250.000 Expenses Previously Incurred 250,000 Relocation of FPL facilities 100,000 On-Site City Inspector 100,000 Total S 18.250,000 Commission Memorandum Page 4 February 1, 1995 The FDOT, under the Joint Participation Agreement which was authorized by Resolution No. 92-20686 on December 16, 1992, is currently being amended to provide for progress payments during the construction period,will provide $6,213,000 of the project cost. The City for its participation in the basic levels of service provided to all residents plus the work to be done on the water, sewer and storm water systems will fund $4,695,369. This leaves the value of the special benefit to the property owners in the District, $7,341,631, to be assessed. These sources total the complete anticipated project cost of $18,250,000. The Special Assessment District's share of these costs will be assessed to the 2.061 abutting property owners at a rate of $285 per front linear foot payable over twenty years at an 8% interest rate. Corner properties with frontage on two streets to be improved will be assessed at a 100% rate on the larger frontage and at 50% on the secondary frontage. Properties with multiple ownership (i.e. condominiums) will be assessed based on percentage of ownership -in the same-manner as ad-valorem property taxes are assessed. Each property owner will be billed separately. The combined project cost to the City and the District of S12 million has been financed through a loan from the Sunshine State Municipal Loan Pool. The State will fund its share of the costs with progress payments billed to FDOT. The repayment of the City's share of the project will come from the Gas Tax funds, Water/Sewer funds and Storm Water funds. Costs of the project not fundable from these revenues, if any, will be paid out of the General Funds non-ad valorem revenues. The City will be paid back for the advance of the funding cost of the project by the property owners in the District at the $285 per front linear foot rate which is the subject of this public hearing. The project consultants, Kimley-Horn and Associates, Inc., and bond counsel. Squire, Sanders & Dempsey, will make a presentation at the City Commission Public Hearing meeting. y MAINTENANCE OF TRAFFIC In order to minimize the impact of this two year construction project on the community, a maintenance of traffic plan will be included with the bid documents. The plan was presented before the North Beach Development Corporation directors at their January 23, 1995 meeting. The maintenance of traffic plan will be deliberated by the North Beach Development Corporation in a public meeting long before its implementation occurs. ' • Commission Memorandum Page 5 February 1, 1995 CONCLUSION It is appropriate for the City of Miami Beach to provide basic infrastructure improvements for this project as well as the assessment for the municipal property within the project boundary. This innovative approach will ensure that this North Shore Streetscape Improvement District effort creates long-term success. The Mayor and the City Commission should adopt the attached resolution in accordance with the final assessment roll to be filed forthwith with the City Clerk.
