A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE AMENDMENT NO. 3 TO THE
DESIGN /BUILD AGREEMENT BETWEEN THE CITY OF MIAMI BEACH,
FLORIDA, AND RIC -MAN CONSTRUCTION, INC. FOR THE STORMWATER
PUMP STATION ON 19TH STREET BETWEEN CONVENTION CENTER
DRIVE AND MERIDIAN AVENUE PROJECT; SAID AMENDMENT NO. 3
PROVIDING FOR THE DESIGN AND CONSTRUCTION OF THE SEA WALL
ALONG THE COLLINS CANAL IN THE VICINITY OF THE CARL FISHER
CLUBHOUSE, TO REPLACE THE EXISTING DILAPIDATED SEA WALL, AS
PART OF THE STORMWATER PUMP STATION IMPROVEMENTS FOR THE
CONVENTION CENTER, IN AN AMOUNT NOT TO EXCEED $593,000, PLUS
OWNER'S CONTINGENCY IN THE AMOUNT OF $59,300, FOR A TOTAL
AMOUNT OF $652,300; WITH PREVIOUSLY APPROPRIATED FUNDING.
WHEREAS, on January 17, 2017 the City entered into a Design /Build Agreement with
Ric -Man Construction, Inc. (Ric -Man) to develop, design, and construct the Stormwater Pump
Station on 19th Street between Convention Center Drive and Meridian Avenue in the amount of
$6,332,389.80; and
WHEREAS, on February 9, 2018, Amendment No. 1, to the Design /Build Agreement
was executed for $630,013.00, as adopted by the City Commission under Resolution No. 2017-
30020, to incorporate a permanent emergency generator as part of the Project; and
WHEREAS, Amendment No. 1 revised the total contract amount to $6,962,402.80; and
WHEREAS, on March 23, 2018, Amendment No. 2 to the Design /Build Agreement was
executed for $387,124.00, plus $38,712.00 owner's contingency, as adopted by the City
Commission under Resolution No. 2018- 30220, to proceed with the design and construction of
the improvements for the extension of the Botanical Garden north of its current border and up to
the swale along the Collins Canal; and
WHEREAS, Amendment No. 2 revised the total contract amount to a not -to- exceed total
of $7,388,238.80; and
WHEREAS, proposed Amendment No. 3 will provide for the design and construction of a
portion of the sea wall in the vicinity of the Carl Fisher Club House, in order to replace the
existing dilapidated sea wall, complete the seawall system for the Convention Center project, and
will facilitate the City with proceeding with the Carl Fisher Club House renovations; and
WHEREAS, the duration of this work is 136 days, which is expected to be concurrent
with the remaining duration of the work on the 19th Street Pump Station Project; and
WHEREAS, this Amendment No. 3, in the amount of $593,000, plus $59,300.00
Owner's Contingency, will revise the total contract amount to a not -to- exceed total of
$8,040,538.80; and
WHEREAS, as part of the 2015/16 Capital Budget adoption, the Convention Center -
Collins Canal Seawall was funded through Resolution No. 2014 - 28836.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission approve and authorize the City Manager to negotiate and execute Amendment No.
3 to the Design /Build Agreement between the City of Miami Beach, Florida, and Ric -Man
Construction, Inc. for the stormwater pump station on 19th Street between Convention Center
Drive and Meridian Avenue Project; said Amendment No. 3 providing for the design and
construction of the sea wall along the Collins Canal in the vicinity of the Carl Fisher ClubHouse,
to replace the existing dilapidated sea wall, as part of the stormwater pump station
improvements for the Convention Center, in an amount not to exceed $593,000, plus owner's
contingency in the amount of $59,300, for a total amount of $652,300; with previously
appropriated funding.

RECOMMENDATION
The Administration recommends adopting the Resolution.
ANALYSIS
On January 17, 2017 the City entered into a Design /Build Agreement with RicMan Construction, Inc.
(Ric -Man) to develop, design, and construct the Stormwater Pump Station on 19th Street between
Convention Center Drive and Meridian Avenue in the amount of $6,332,389.80.
On February 9, 2018, Amendment No. 1 to the Design /Build Agreement was executed for
