A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, FOLLOWING A DULY
NOTICED PUBLIC HEARING, AS REQUIRED PURSUANT TO
SECTION 82- 93(b), OF THE CITY CODE, APPROVING A
REVOCABLE PERMIT REQUEST BY 1680 MICHIGAN
CONDOMINIUM ASSOCIATION,, IN ORDER TO ALLOW THE
INSTALLATION OF AN ADDRESS SIGN AND DECORATIVE
ALUMINUM CHANNELS ON THE FACADE OF 1680 MICHIGAN
AVENUE, WHICH SIGN AND CHANNELS SHALL PROJECT
APPROXIMATELY THREE INCHES (3 ") OVER THE PUBLIC
RIGHT -OF -WAY, AND APPROXIMATELY 10 FEET TO 37 FEET
ABOVE GRADE, WHICH REQUEST FOR A REVOCABLE
PERMIT IS CONSISTENT WITH THE CRITERIA CONTAINED IN
SECTION 82 -94, OF THE CITY CODE; AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE THE
REVOCABLE PERMIT.
WHEREAS, 1680 Michigan Condominium Association, (Applicant) is the owner of the
building, located at 1680 Michigan Avenue, and is requesting a revocable permit for the
installation of address signage and decorative aluminum channels on the fagade of the building
extending approximately three inches (3 ") over the sidewalk (into the air rights of the right -of-
way); and
WHEREAS, the Applicant is proposing to improve the appearance of the fagade of the
Condominium; and
WHEREAS, the condominium has a 40 foot high, 120 foot long parking pedestal that is a
bland expanse of stucco, flush against the property line; and
WHEREAS, the Applicant would like to install a building address sign and 44 illuminated
channels distributed in a contemporary pattern across the fagade of the parking pedestal to
make the fagade more visually attractive; and
WHEREAS, the channels will project approximately three inches (3 ") over the public
right -of -way, starting at approximately 10 feet and extending 37 feet above grade; and
WHEREAS, on March 7, 2017, the Applicant obtained a final development order from
the Design Review Board (DRB) for the property located at 1680 Michigan Avenue, under DRB
File No. 16 -0105, which order contemplated the above design, which design would require the
issuance of a revocable permit due to the projection into the City's right -of -way; and
WHEREAS, pursuant to Section 82- 93(a), of the City Code, on June 6, 2017, the City
Commission scheduled the public hearing for July 25, 2017, to consider the request for a
revocable permit and, additionally, in accordance with Section 82- 93(b), of the City Code, to
mail notice of the public hearing to owners of land lying within 375 feet of the existing permit
area at least 15 days prior to the public hearing; and
WHEREAS, pursuant to Section 82 -94, of the City Code, the City Commission shall
review the revocable permit request and determine whether the request shall be granted or
denied based upon the following criteria:
(1) That the applicant's need is substantial.
(2) That the applicant holds title to an abutting property.
(3) That the proposed improvements comply with applicable codes,
ordinances, regulations, neighborhood plans and laws.
(4) That the grant of such application will have no adverse effect on
governmental /utility easements and uses on the property.
(5) Alternatively:
a. That an unnecessary hardship exists that deprives the applicant of a
reasonable use of the land, structure or building for which the revocable
permit is sought arising out of special circumstances and conditions that
exist and were not self- created and are peculiar to the land, structures or
building involved and are not generally applicable to other lands,
structures or buildings in the same zoning district and the grant of the
application is the minimum that will allow reasonable use of the land,
structures or building; or
b. That the grant of the revocable permit will enhance the neighborhood
and /or community by such amenities as, for example, enhanced
landscaping, improved drainage, improved lighting, and improved
security.
(6) That granting the revocable permit requested will not confer on the
applicant any special privilege that is denied by this article to other owner
of land, structures or buildings subject to similar conditions located in the
same zoning district.
(7) That granting the revocable permit will be in harmony with the general
intent and purpose of this article, and that such revocable permit will not
be injurious to surrounding properties, the neighborhood, or otherwise
detrimental to the public welfare. In order to grant a revocable permit, the
city commission must make an affirmative finding with respect to each of
the criteria set forth above. These findings may be made by one motion
addressed to all findings or, at the request of any member of the
commission, a finding or findings shall be considered separately. The
findings shall be made prior to the vote on the application. The revocable
permit application shall be considered as a whole unless any member of
the city commission shall request that the application be considered in
parts, in which event the application shall be considered in such parts as
requested. In light of the particular circumstances involved with each
separate revocable permit request, the grant of any revocable permit shall
not constitute or be deemed a precedent for the grant of any other
revocable permit.

WHEREAS, the Mayor and City Commission, based upon the recommendation and
analysis completed by the Public Works Department find that the criteria of Section 82 -94, of the
City Code, have been complied with and the revocable permit request should be granted.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission, pursuant to
Section 82- 93(b), of the City Code, approving a revocable permit request by 1680 Michigan
Condominium Association, in order to allow the installation of an address sign and decorative
aluminum channels on the facade of 1680 Michigan Avenue, which sign and channel settings
shall project approximately three inches (3 ") over the public right -of -way, and approximately 10
feet to 37 feet above grade. Which request for a revocable permit is consistent with the criteria
of Section 82 -94, of the City Code; and authorizing the Mayor and City Clerk to execute the
revocable permit.

RECOMMENDATION
The Administration recommends that the Mayor and City Commission approve the Resolution on
Second Reading Public Hearing.
ANALYSIS
1680 Michigan Condominium Association, Inc., (Applicant) owns and manages the Condominiums
located at 1680 Michigan Avenue.
The Applicant is proposing to improve the appearance of the facade of the Condominium and is
requesting a revocable permit for the installation of a building address sign and forty four (44)
illuminated channels, distributed in a contemporary pattern across the facade of the parking pedestal
in an attempt to make the facade more visually attractive. The proposed channels will project
approximately three inches (3 ") over the public right -of -way, starting at approximately 10 feet, and
extending 37 feet above grade.
On March 7, 2017, the Applicant obtained a final development order from the Design Review Board
(DRB) for the property located at 1680 Michigan Avenue, under DRB File No. 16- 0105, which order
contemplated the above design, which design would require the issuance of a revocable permit due
to the projection into the City's right -of -way.
Pursuant to Section 82 -93(a) of the City Code, on June 6, 2017, the City Commission scheduled the
public hearing for July 25, 2017, to consider the request for a revocable permit and, additionally, in
accordance with Section 82 -93(b) of the City Code, to mail notice of the public hearing to owners of

land lying within 375 feet of the existing permit area at least 15 days prior to the public hearing.
The City Code provides the ability to obtain a revocable permit for encroachment into the public right -
of -way. The Applicant satisfies the revocable permit criteria stated in Section 82 -94 of the City Code
as follows:
• The Applicant's need is substantial.
The Applicant respectfully requests that a revocable permit be granted for the proposed address
signage and decorative aluminum channels. The revocable permit will allow the Property to maintain
its current function, and improve visibility and appearance.
• The Applicant holds title to an abutting property.
The Applicant owns the Property.
• The proposed improvements will comply with applicable codes, ordinances, regulations,
neighborhood plans and laws.
The proposed improvements will comply with applicable codes, ordinances, regulations,

• The grant of the application will have no adverse effect on governmental /utility easements and uses
on the property.
The proposed improvements will be installed per applicable codes under a separate Building
Department permit and does not obstruct the right -of -way. The improvements will have no adverse
effect on governmental /utility easements.
• That the grant of the revocable permit will enhance the neighborhood and /or community by such
amenities as, for example, enhanced landscaping, improved lighting, and improved security.
The proposed improvements will promote visibility and appearance of the building. The introduction
of the improvements will increase the value of the Property, and in turn that of the neighborhood.
Furthermore, it will be desirable to visitors by enhancing the facade.
• That granting the revocable permit requested will not confer on the applicant any special privilege
that is denied by this article to other owner of land, structures or buildings subject to similar conditions
located in the same zoning district.
Granting the revocable permit will not confer any special privilege upon the Applicant. Any property
owner within the City of Miami Beach can apply for a revocable permit; provided that the application
meets the criteria stated in the Code does not interfere with the utilization of public property, and
enhances the community.
• That granting the revocable permit will not devalue any of the adjacent properties and will not have
a detrimental effect on the public welfare. In fact it will improve the historic character of the property
and the surrounding area.

CONCLUSION
The Public Works Department has confirmed that the criteria of Section 82-94.of the City Code, has
been complied with, and due to the foregoing, the Administration recommends that the Mayor and
City Commission approve the Resolution authorizing the revocable permit for 1680 Michigan Avenue,
be granted at the second reading/public hearing.

IN RE: The application requesting Design Review Approval for exterior
alterations to the facade of an existing six -story building, including the
installation of decorative non - structural lighting channels and building
signage.
ORDER
The City of Miami Beach Design Review Board makes the following FINDINGS OF FACT,
based upon the evidence, information, testimony and materials presented at the public hearing
and which are part of the record for this matter:
L Design Review
A. The Board has jurisdiction pursuant to Section 118- 252(a) of the Miami Beach Code.
The property is not located within a designated local historic district and is not an
individually- deaigtrated historiu-slteT
B. Based on the plans and documents submitted with the application, testimony and
information provided by the applicant, and the reasons set forth in the Planning
Department Staff Report, the project as submitted is inconsistent with Design Review
Criteria 2 and '3 in Section 118.251 of the Miami Beach Code.
C. The project would remain consistent with the criteria and requirements of Section
118-251 if the following conditions are met:
1. Revised elevation, site plan and floor plan drawings for the proposed modification
to 1680 Michigan Avenue shall be submitted to and approved by staff; at a
minimum, such drawings shall incorporate the following:
a, The proposed LED lighting of the exterior decorative lighting channels on the
east elevation shall be permitted as proposed, with a minimal LED wattage
and shall be monochromatic and non - flashing. In the event Code
Compliance receives complaints of visual distraction or light nuisance from
the LED lighting, and determines the complaints to be valid, even if the
equipment is operating pursuant to manufacturer specifications, the

applicant shall take such steps to mitigate the brightness, frequency of
change, wattage and dimness subject to the review and approval of staff
based upon the Design Review Criteria and /or the directions from the Board
b. The final design and details of all exterior lighting shall be provided, in a
manner to be reviewed and approved by staff consistent with the Design
Review Criteria and /or the directions from the Board.
c. A copy of all pages of the recorded Final Order shall be scanned into the
plans submitted for building permit, and shall be located immediately after
the front cover page of the permit plans.
d. Prior to the issuance of a Certificate of Occupancy, the project Architect
shall verify, in writing, that the subject project has been constructed in
accordance with the plans approved by the Planning Department for
Building Permit.
In accordance with Section 118 -262, the applicant, or the city manager on behalf of the
city administration, or an affected person, Miami Design Preservation League or Dade
Heritage Trust may seek review of any order of the Design Review Board by the city
commission, except that orders granting or denying a request for rehearing shall not be
reviewed by the commission,
II. Variance(s)
A. No variance(s) were filed as part of this application.
III. General Terms and Conditions applying to both 1. Design Review Approval and 'IL
Variances' noted above.
A. If required, the applicant shall obtain a revocable permit for the building lighting channels
and /or signage proposed to project over the sidewalk along Lincoln Lane and Meridian
Court, to approval the City Commission, prior to the issuance of a building
permit.
B. A Construction Parking and Traffic Management Plan (CPTMP) shall be approved by the
Parking Director pursuant to Chapter 106, Article II, Division 3 of the City Code, prior to
the issuance of .a Building Permit,
C. The final building plans shall meet all other requirements of the Land Development
Regulations of the City Code.
D. The Final Order shall be recorded in the Public Records of Miami -Dade County, prior to
the issuance of a Building Permit.
E, Satisfaction of all conditions is required for the Planning Department to give its approval
on a Certificate of Occupancy; a Temporary Certificate of Occupancy or Partial
Certificate of Occupancy may also be conditionally granted Planning Departmental
approval.
F. The Final Order is not severable, and if any provision or condition hereof is held void or
unconstitutional in a final decision by a court of competent jurisdiction, the order shall be

returned to the Board for reconsideration as to whether the order meets the criteria for
approval absent the stricken provision or condition, and /or it is appropriate to modify the
remaining conditions or impose new conditions
G. The conditions of approval herein are binding on the applicant, the property's owners,
operators, and all successors in interest and assigns.
H Nothing in this order authorizes a violation of the City Code or other applicable law, nor
allows a relaxation of any requirement or standard set forth in the City Code.
IT IS HEREBY ORDERED, based upon the foregoing findings of fact, the evidence, information,
testimony and materials presented at the public hearing, which are part of the record for this
matter, and the staff report and analysis, which are adopted herein, including the staff
recommendations, which were amended and adopted by the Board, that the application is
GRANTED for the above- referenced project subject to those certain conditions specified in
Paragraph I, 11,111 of the Findings of Fact, to which the applicant has agreed.
PROVIDED, the applicant shall build substantially in accordance with the plans, entitled " 1680
Michigan Avenue Facade Illumination and Building ID Signage ", as prepared by Mossccrop
Associates dated, signed and sealed January 05, 2017, and as approved by the Design
Review Board, as determined by staff.
When requesting a building permit, the plans submitted to the Building Department for permit
shall be consistent with the plans approved by the Board, modified in accordance with the
conditions set forth in this Order. No building permit may be issued unless and until all
conditions of approval that must be satisfied prior to permit issuance, as set forth in this Order,
have been met.
The issuance of the approval does not relieve the applicant from obtaining all other required
Municipal, County and /or State reviews and permits, including final zoning approval. If adequate
handicapped access is not provided on the Board - approved plans, this approval does not mean

the plans submitted to the Building Department for permit shall be consistent with the plans
approved by the Board, modified in accordance with the conditions set forth in this Order,
If the Fuli Building Permit for the project is not issued within eighteen (18) months of the meeting
date at which the original approval was granted, the application will expire and become null and
void, unless the applicant makes an application to the Board for an extension of time, in
accordance with the requirements and procedures of Chapter 118 of the City Code; the granting
of any such extension of time shall be at the discretion of the Board, If the FuII Building Permit
for the project should expire for any reason (including but not limited to construction not
commencing and continuing, with required inspections, in accordance with the applicable
Building Code), the application will expire and become null and void.
In accordance with Chapter 118 of the City Code, the violation of any conditions and safeguards
that are a part of this Order shall be deemed a violation of the land development regulations of
the City Code. Failure to comply with this Order shall subject the application to Chapter 118 of
the City Code, for revocation or mo•' 'Cation of the application.
