2003-25154 ResoRESOLUTION NO. 2003-2515~ A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE RANKING OF PROPOSALS RECEIVED PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 67-01102, FOR THE MANAGEMENT AND OPERATION OF STREET MARKETS ON LINCOLN ROAD, ESPANOLA WAY AND NORMANDY VILLAGE; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE MARKET COMPANY FOR OPERATION AND MANAGEMENT OF WEEKEND STREET MARKETS ON LINCOLN ROAD, ESPANOLA WAY AND NORMANDY VILLAGE; SHOULD THE ADMINISTRATION NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE MARKET COMPANY, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE SECOND- RANKED FIRM, ENCORE EVENTS, FOR WEEKEND STREET MARKETS ON LINCOLN ROAD AND ESPANOLA WAY ONLY; THE ADMINISTRATION WOULD FURTHER RECOMMEND THAT THE MAYOR AND CITY COMMISSION APPROVE AND AUTHORIZE THE ADMINISTRATION TO ENTER INTO NEGOTIATION WITH ENCORE EVENTS FOR A PILOT PROGRAM, NOT TO EXCEED 12 WEEKS, FOR A SATURDAY OR WEEKDAY MARKET ON LINCOLN ROAD. WHEREAS, the City is desirous of continuing to have street markets in the Espanola Way, Lincoln Road and Normandy Village neighborhoods; and WHEREAS, street markets attract additional activity to these neighborhoods and enhance their economic vitality; and WHEREAS, various street markets have operated as special events in the City over the past several years; and WHEREAS, street markets take place on the public right-of-way; and WHEREAS, the Administration, in its continuing evaluation of street markets, has determined that, as street markets are year-round operations should no longer be governed by the short-term criteria of special events, the City should establish annual concession-type agreements with market producers; and WHEREAS, on June 21, 2002, the Community Affairs Committee recommended the issuance of a Request for Proposals for the management and operation of street markets on Lincoln Road, Espanola Way and Normandy Village; and WHEREAS, at its regular meeting on July 31, 2002, the Mayor and City Commission authorized the issuance of Request for Proposals No. 67-01/02 for the management and operation of street markets on Lincoln Road, Espanola Way and Normandy Village (the RFP); and WHEREAS, on August 20, 2002, the City issued the RFP, with a deadline of September 24, 2002, for proposals to be submitted to the City; and WHEREAS, on September 16, 2002, Addendum No. 1 to the RFP was issued, extending the deadline for proposals to be submitted to the City to October 1, 2002; and WHEREAS, twenty-eight copies of the RFP were requested by interested parties; and WHEREAS, on October 1, 2002, the City received three (3) proposals for the management and operation of street markets on Lincoln Road from the Market Company, Inc., Encore Events, and Shelly Abramowitz; and WHEREAS, on October 1, 2002, the City received three (3) proposals for the management and operation of street markets on Espanola Way from the Market Company, Inc., Encore Events, and International Multicultural Crafts Association; and WHEREAS, on October 1, 2002, the City received one (1) proposal for the management and operation of street markets in Normandy Village from the Market Company, Inc.; and WHEREAS, on February 11, 2003, an Evaluation Committee convened to evaluate the proposals for the management and operation of street markets on Espanola Way and Normandy Village; and WHEREAS, for management and operation of the Espanola Way street market, the Evaluation Committee awarded 538 points to the Market Company, Inc.; 335 points to Encore Events; and 325 points to International Multicultural Crafts Association (IMCA); and WHEREAS, the Evaluation Committee approved a motion to rank the proposers according to the points awarded and selected the Market Company, Inc. as the top-ranked firm, and Encore Events as the second-ranked firm for management and operation of the Espanola Way street market; and WHEREAS, the Evaluation Committee approved a motion to award management and operation of the Normandy Village street market to the Market Company, Inc.; and WHEREAS, on February 27, 2003, the Evaluation Committee convened to evaluate the proposals for the management and operation of street markets on Lincoln Road; and WHEREAS, for management and operation of street markets on Lincoln Road, the Evaluation Committee awarded 538 points to the Market Company (for a Farmer's Market), Inc.; 325 points to Encore Events; and 270 points to Shelley Abramowitz; and WHEREAS, the City Manager concurs with the recommendation of the Evaluation Committee; and WHEREAS, the City Manager is also desirous of beginning a pilot program on Lincoln Road with the second-ranked firm of Encore Events; and WHEREAS, to that end, the Administration recommends that the Mayor and City Commission approve and authorize the Administration to enter into negotiations with Encore Events for a pilot program, not to exceed 12 weeks, for a Saturday or weekday market on Lincoln Road. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission accept the recommendation of the City Manager pertaining to the ranking of proposals received pursuant to Request for Proposals No. 67-01/02 for the management and operation of street markets on Lincoln Road, Espanola Way and Normandy Village, and authorize the Administration to enter into negotiations with the Market Company, Inc. for operation and management of street markets on Lincoln Road, Espanola Way and Normandy Village; should the Administration not be able to negotiate an agreement with the Market Company, Inc., authorize the Administration to negotiate with the second- ranked firm, Encore Events, for operation and management of the street markets on Lincoln Road and Espanola Way only. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS: On July 17, 2001, the Mayor and the City Commission referred a discussion regarding special events policies regarding markets to the Community Affairs Committee. On July 25, 2001, the Community Affairs Committee voted to direct Legal and the Administration to work on a concession agreement for recurring markets. On January 29, 2002, the Community Affairs Committee requested that the Administration research how other cities handle permitting of markets and to bring options for permitting of markets to the next meeting. On February 9, 2002, a report on other market operations was made to the Community Affairs Committee, and they requested that the Administration seek additional input from the neighborhood associations wherein the markets are currently located and Commission Memorandum March 19, 2003 Page 2 seek their recommendations regarding events, or market operations in the various business districts. In April and May of 2002, the Administration held meetings in the business districts to gain input on how the markets should operate, and to determine if the community wanted market operations to continue to occur. These meetings focused on frequency, hours of operation, location, selection criteria and process, exclusivity of product, entertainment, operating and management standards, and resolution of vendor complaints. LOCATION: · Espanola Way: Good location, possible extension north on Drexel Avenue, and explore the potential use of the area between Collins and Washington Avenues. · Normandy Village: Good location, possible extension west along Harding Avenue. · Lincoln Road: Address the entire road by spreading out vendors; possibly alternate street ends so that every store has exposure to the patrons that visit the markets. FREQUENCY AND HOURS OF OPERATION: Both of these criteria are working well with the markets. It was recommended that the markets be kept as consistent as possible throughout the year, and with as little disruption from special events as possible. If the market maintains consistent hours, location and frequency, patrons begin to depend on it and are more likely to visit the business district. The markets should continue operating in the mornings, in order to maintain a neighborhood feel. SELECTION CRITERIA AND PROCESS: This was one of the most widely discussed topics at the meetings. It was recommended that the City establish guidelines for selection criteria in order to provide clear definition, and the business districts and/or merchants associations monitor the implementation of the criteria and serve in an advisory capacity. EXCLUSIVITY OF PRODUCT: In the case of the farmers markets, there was concern expressed by some businesses that too many of the products being sold make the market appear more like a flea market rather than a green market. As it relates to other types of products, the businesses would like to see more competition between the vendors within the market, rather than between the vendors and the merchants. Competition between vendors will enhance the quality of the overall market, as long as a standard is put in place. Merchants strongly expressed their opposition to competition with market vendors. Therefore, non-compete provisions will be incorporated into the requirements of any future market award. Commission Memorandum March 19, 2003 Page 3 OPERATING AND MANAGEMENT STANDARDS: Businesses felt that an oversight committee should be established to monitor the market operations as it relates to selection criteria, fees, and product standards. MUSIC/ENTERTAINMENT: The merchants like the idea of music and entertainment to attract additional activity to the districts. They feel that it should be spread throughout the district as much as possible, and be performed at various intervals to allow patrons to listen and shop. RFP Process: On June 21, 2002, the Community Affairs Committee reviewed and commented on the proposed scope of services, and r~commended that a Request for Proposals for the market operations be issued. At its regular meeting on July 31, 2002, the Mayor and City Commission authorized the issuance of Request For Proposals No. 67-01/02 for the management and operations of street markets on Lincoln Road, Espanola Way and Normandy Village. The Scope of Services is attached. On February 11,2003, an Evaluation Committee met to evaluate proposals for Espanola Way from the Market Company, Encore, and International Multicultural Crafts Associations (IMCA), and a single proposal for Normandy Village from the Market Company. Members of the Evaluation Committee were: Lilliam Janata, Chair, CDAC member. Vanessa Zabaleta, Psycologist and Miami Beach resident. Gail Butcher, Miami Beach resident. Ramon Duenas, CMB Expenditure/Treasury Manager, Finance Department. Tom Weschler, Major, Police Department (Interim Director of ACE when appointed). Mercedes Lamazares, CMB Principal Planner, Planning Department. The Evaluation Committee convened for a second meeting to evaluate three proposals for Lincoln Road on February 27, 2003. Both meetings provided for a period of public input in addition to the vendor presentations. Espanola Way Three proposals were submitted for management and operation of market activities on Espanola Way. The Market Company, Encore Events and the International Multicultural Crafts Association (IMCA) submitted these proposals. Eleven individuals provided public comment to the Evaluation Committee before the vendor presentations. There was consensus from the public that market operations should continue on Espanola Way, although there continues to be concern about the size, location and hours of operation that market activity should occur. The majority of the public comment was in support of the current operator, the Market Company. Some of the public comment Commission Memorandum March 19, 2003 Page 4 included an overview of the history of how the market has developed by some property and business owners. The majority of the public also felt that the market's primary function is to attract customers to the street and to the permanent tenants that operate their businesses every day throughout the year. There was concern about competition with the existing businesses and a suggestion that vendors must create the product that they sell. Following the vendor presentations, the Evaluation Committee deliberated and offered the following observations: Although Encore has experience in markets, the Committee was concerned that that experience was not in Miami Beach, and that while they had experience as vendors in a market, they did not have experience running a market. The Evaluation Committee confirmed that they heard comments that the public is mostly happy with how the current market is being run, and that neither the presentation by Encore nor I MCA demonstrated that the market would operate at more efficient or optimum levels. The Committee also discussed the price proposal, in which two firms (Encore and IMCA) provided a 10% return to the City with unclear financial projections. The Committee noted that the Market Company not only proposed a 15% return to the City, but they also provided line item financial projections that included the revenue amount that they anticipated would be remitted to the City. The Evaluation Committee expressed concern and the need to develop a process to handle disputes relative to the operations of the Markets, regardless of which proposer ultimately is awarded the contract for market operations. This should be addressed in the contract negotiations. The ranking of the proposals was based on the following criteria: Experience Quality of the proposed operation Financial return to the City 40 points 40 points 20 points The Evaluation Committee awarded the following total points: The Market Company Encore ICMA 538 points (5 first place votes) 335 points (4 second place, 2 third place votes) 325 points (3 second place, 3 third place votes) The Evaluation Committee approved a motion to rank the firms in the order that they scored and recommend the Market Company as the top-ranked bidder for the management and operation of street markets on Espanola Way, and further recommending that if the City is unable to negotiate a contract with the Market Company, Commission Memorandum March 19, 2003 Page 5 to proceed with negotiations with the second-ranked bidder, Encore Events. Normandy Village Only one proposal was submitted for the operation of the market that occurs in Normandy Village. The only public comment provided was a resolution submitted by Christina Fernandez, Marketing Director, on behalf of the Board of Directors of the North Beach Development Corporation, which read as follows: Whereas, weekly and/or other periodic markets held within commercial districts and in cooperation with area business owners can be beneficial to those businesses, commercial districts and to the economic development of the entire North Beach area. The Board of Directors of North Beach Development Corporation hereby resolves it support in concept for weekly or other periodic markets and directs its staff to work with the City of Miami Beach and local area businesses to promote successful markets in the North Beach area. Claire Tomlin, President of the Market Company, made a presentation to the Evaluation Committee. The Committee then approved a motion to recommend that the management and operation of the Normandy Village Market be awarded to the Market Company. Lincoln Road Three proposals were submitted for management and operation of market activities on Lincoln Road. The Market Company, Encore Events, and Shelley Abramowitz, submitted these proposals. Twelve individuals provided public comment to the Evaluation Committee following the vendor presentations. Public comment was provided by current and former vendors of the existing market operation, Lincoln Road property and business owners, and other citizens. Comments from the vendors ranged from positive comments about the professionalism of the existing market operator, to concern about the authenticity of the market. One vendor felt that the market had lost the 'feel' of a farmers market, and made a comparison to the market in West Palm Beach. There was concern that the future market not be approached as a flea market, and that the products must be limited to organic/green products. There were also comments that there are a large number of growers in Miami-Dade County that would love to be in the Lincoln Road Farmer's Market, and that more diversity of fruits and vegetables be available. As set forth in the RFP, the business and property owners agreed that entertainment should not be included as part of the market. They felt that entertainment is something that should be explored between Lincoln Road and the City. There was the suggestion that an annual meeting be conducted between the market vendors and Lincoln Road business Commission Memorandum March 19, 2003 Page 6 owners, and that the market should be uniform, look nice, be clean, and not compete with the Lincoln Road merchants. The business and property owners spoke favorably of the existing market operator, and expressed that "the market is not broken, and therefore, does not need to be fixed." However, they did feel that some good ideas for improvement were brought out during the RFP process and presentations. There were also comments that Lincoln Road does not want the market expanded to Saturday; however, there were comments from Lincoln Road property and business owners that some of them would like to see the market expanded to a weekday. One suggestion was to continue with the existing operation, but Encore Events does have good ideas, and maybe they should be allowed to conduct a market on Tuesday, as they proposed during their presentation. The largest concern expressed during the public comment period was for high quality product that complements rather than competes with the existing merchants. In addition, a petition signed by Lincoln Road businesses was submitted in favor of the current market operator. (See attached) The ranking of the proposals was based on the following criteria: Experience Quality of the proposed operation Financial return to the City 40 points 40 points 20 points The Evaluation Committee awarded the following total points: The Market Company Encore Shelley Abramowitz 438 points (5 first place votes) 325 points (3 second place, 2 third place votes) 270 points (2 second place, 3 third place votes) The Evaluation Committee approved a motion to rank the firms in the order that they scored and recommend the Market Company as the top-ranked bidder for the management and operation of the Farmer's Market on Lincoln Road, and recommending that if the City is unable to negotiate a contract with the Market Company, to proceed with negotiations with the second-ranked bidder, Encore Events. CONCLUSION: The Administration recommends that the Mayor and City Commission authorize the Administration to enter into negotiations with the Market Company for the management and operation of the Sunday market on Lincoln Road, the weekend market on Espanola Way and the Saturday market on Normandy Village. Additionally, the Administration recommends that negotiations be conducted with Encore Events for a 12-week pilot program for a farmer's market on Lincoln Road on either Saturday or a weekday. All proposals included creative ideas that may provide additional value for the community, and the Administration will incorporate these and the ideas from the public comment session into the negotiated agreement, including provisions set forth in the RFP previously set forth Commission Memorandum March 19, 2003 Page 7 by the Mayor and City Commission. The RFP requires substantial detail on the type of market operation, including experience, booth presentation, parking, signage, coordination with the neighborhood associations, logistics, and vendor regulations. Additionally, the RFP addresses other issues that will impact the proposals. The proposers must be the operating and management entity, not an organization that will subcontract with a third party. The operations of the successful bidders will be subject to periodic audit by the City, and a process for vendor complaints will be included in the final negotiated contract. The proposals will be based on three criteria: experience, quality, and financial return to the City. 1. Espanola Way 2. Normandy Village 3. Lincoln Road Farmers Market Specify location, day(s) of the week, and times. Proposed operations shall not go beyond 11 p.m. PROPSALS MAY BE SUBMITTED FOR ONE OR MORE LOCACTION. Proposals for street markets in other areas of the City will be subject to positive recommendation by the neighborhood that the market is proposed to take place in, followed by a public bidding process with an evaluation process as proposed herein, with final approval by the Mayor and City Commission. FEE SCHEDULE All proposers must submit a fee schedule for vendor/booth locations and the basis for those fees. OTHER ALL PROPOSERS MUST INCLUDE A PROPOSED SITE PLAN. Respondents to this Request for Proposals must be the proposed operating & management organization for the market. Market operations & management may not be subcontracted to a third party. 3. Market Operator and any and all vendors must have all applicable licenses and tax certificates, as may be required by municipal, county, state and Federal law. While financial return to the City of Miami Beach is important, the most important criteria for market operations is the quality of the market and the impact of the market on the neighborhood. A process for the resolution of vendor complaints about the market operations will be included in the final negotiated contract. We, the tenants, merchants and property owners on Lincoln Road are very pleased with the way The Market Company has handled the Farmers Market. From the very beginning The Market Company has dealt with difficult issues efficiently and promptly. They have built the Farmers Market from virtually nothing to the success it is today, attracting more people to the Lincoln Road area and businesses. The Market Company has always forged through problems and participated in helping in the growth of Lincoln Road.
