Resolution 8628 RESOLUTION NO. 8628
WHEREAS, the City Council of the City of Miami Beach, on
the 4th day of April, 1952 did duly pass and adopt Resolution
No . 7971, and
WHEREAS, in and by said Resolution No . 7971, it was deemed
necessary for the welfare of said City and the inhabitants
thereof, to acquire, for public park purposes, certain parcels
of land situate, lying and being in Miami Beach, Dade County,
Florida, said parcels of land being particularly described in
said Resolution No . 7971 including the following, to-wit :
"PARCEL NUMBER ONE
Lot Six (6) of The Indian Beach Corporation 's
Subdivision, according to the Plat thereof,
recorded in Plat Book 8, at page 61, of the
Public Records of Dade County, Florida, to-
gether with all riparian rights appurtenant
thereto .
AND ALSO a strip of land lying west of Collins
Avenue and adjoining Indian Creek on the East-
erly side thereof, the northerly boundary line
of which is the northerly line of said Lot Six
(6) extended westerly to Indian Creek and the
Southerly boundary line of which is the Southerly
line of said Lot Six (6) extended Westerly to
Indian Creek, together with riparian rights and
water privileges appurtenant and adjacent thereto . "
WHEREAS, it was then and there duly resolved that the City
Attorney be authorized and directed to institute condemnation
proceedings for the acquisition of the said land for said
purposes, and
WHEREAS, the City Attorney did institute such proceedings
and the same are now pending, and
WHEREAS, subsequent to the institution of said proceedings
it has been duly determined by the City Council of the City of
Miami Beach that it is to the best interest of the City of Miami
Beach to dismiss from the said condemnation proceedings the
following described parcel of land:
PARCEL NUMBER ONE
Lot Six (6) of The Indian Beach Corporation 's
Subdivision, according to the Plat thereof,
recorded in Plat Book 8, at page 61, of the
Public Records of Dade County, Florida, to-
gether with all riparian rights appurtenant
thereto .
AND ALSO a strip of land lying west of Collins
Avenue and adjoining Indian Creek on the East-
erly side thereof, the northerly boundary line
of which is the northerly line of said Lot Six
(6) extending westerly to Indian Creek and the
southerly boundary line of which is the Southerly
line of said Lot Six (6) extended Westerly to
Indian Creek, together with riparian rights and
water privileges appurtenant and adjacent thereto .

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA that the City Attorney be and he
is hereby authorized and directed to dismiss from the said
pending condemnation proceedings the following described parcel
of land:
PARCEL NUMBER ONE
Lot Six (6) of The Indian Beach Corporation' s
Subdivision, according to the Plat thereof,
recorded in Plat Book 8, at page 61, of the
Public Records of Dade County, Florida, to-
gether with all riparian rights appurtenant
thereto .
AND ALSO a strip of land lying west of Collins

of which is the northerly line of said Lot Six

and the City Attorney be and he is hereby further authorized
and directed to dismiss H. GERTRUDE HOGAN, the owner of the
hereinabove described parcel of land as a party defendant
in the said condemnation proceedings .
PASSED and ADOPTED this 30th day of December, A. D. 1953 .
