Resolution 8658 RESOLUTION NO . 8658
WHEREAS, by the terms of that certain Plat of LAKE VIEW
SUBDIVISION, recorded in Plat Book 14 at Page 42 of the Public
Records of Dade County, Florida, there was reserved for the
use of wire lines, pipe lines, poles, sewers, water mains,
etc . the following described lands :
The Southeasterly five (51 ) feet of
Lot d and the Northeasterly five (5' )
feet of Lot 7 of Block 31, LAKE VIEW
SUBDIVISION, according to the Plat
thereof, recorded in Plat Book 14,
page 12 of the Public Records of
Dade County, Florida;
and
WHEREAS, the owners of said lands have requested the
City of Miami Beach to relinquish and surrender all rights
conferred upon or granted to said City by virtue of said
Instruments as to the lands hereinbefore described, and
WHEREAS, said owners have offered, in consideration of
such relinquishment and surrender, to grant to the City of
Miami Beach, and to the holders of public utilities franchises,
their successors and assigns, the perpetual right and easement
over, under and across the following described lands, situate,
lying and being in Dade County, Florida, to-wit :
The Southwesterly ten (10 ' ) feet of that
certain parcel of land described as
follows, to-wit :
Lots 7 and 6 and a northerly portion of
Lot 6, Block 31, LAKE VIEW SUBDIVISION,
as recorded in Plat Book 14, at Page 42,
of the Public Records of Dade County,
Florida, said northeasterly portion of
said Lot 6 being more particularly des-
cribed as follows :
{ Begin at a point, which is the point of
intersection of the dividing line be-
tween Lots 6 and 7, Block 31, with the
easterly line of Lakeview Drive as shown
on a plat entitled, "Lakeview Subdivision",
recorded in Plat Book 14, at Page 42, Pub-
lic Records of Dade County, Florida. Run
in a southeasterly direction along the
dividing line between said Lots 6 and 7,
Block 31, a distance of 203.6 feet, plus
or minus, to a point; said point being
the intersection of the dividing line
between said Lots 6 and 7, Block 31,
with the face of the concrete bulkhead
situated on the westerly shore of Fla-
mingo Waterway, as said Flamingo Water-
way is shown on above mentioned record-
ed plat; thence run in a southwesterly
direction meandering the face of the
said concrete bulkhead situated on the
westerly shore of Flamingo Waterway,
a distance of 10 feet to a point;

thence run in a northwesterly direction
along a line passing through the last
mentioned point on the face of said
concrete bulkhead and the point of
intersection of the dividing line be-
tween said Lots 6 and 7, Block 31, and
the easterly line of Lakeview Drive,
a distance of 204.3 feet, plus or minus,
to the point of beginning of the tract
of land hereinafter described, contain-
ing 0.02 acres, more or less,
for the purpose of constructing and maintaining thereon wire
lines, pipe lines, poles, sewers, water mains, etc . , and
WHEREAS, the City Attorney has prepared and submitted
instruments for execution by said City accomplishing the ex-
change of easements as above set forth,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that the Mayor and the City
Clerk be and they are hereby authorized and directed to exe-
cute said instruments in the name of and on behalf of said
City.
BE IT FURTHER RESOLVED that the City Attorney be and he
is hereby authorized and directed to deliver said executed
instruments if, as and when there has been delivered to him
a good and sufficient grant unto the City of Miami Beach,
Florida, and to the holders of public utilities franchises,
their successors and assigns, of a perpetual easement over,
under and across the hereinabove described Southwesterly
Ten (10' ) feet of said Lot 7 and 8, and portion of Lot 6,
Block 31, LAKEVIEW SUBDIVISION, Plat Book 14, page 42.
PASSED and ADOPTED this 3rd day of February
