A RESOLUTION OF THE CHAIRMAN .AND MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY APPROVING THE
SETTLEMENT REACHED REGARDING ATTORNEYS' FEES .AND
COSTS FOR TWO PARCELS (BLOCKS 78/80 AND BLOCK 53)
IN THE SOUTH POINTE REDEVELOPMENT AREA.
WHEREAS, negotiations took place regarding the settlement of
attorneys' fees and costs on two parcels in the South Pointe
Redevelopment Area; and
WHEREAS, an approved settlement for fees and costs was reached
in MBRDA v. Azcui, et aI, in the amount of $147,000; and
WHEREAS, an approved settlement for fees and costs was reached
in MBRDA v. Butnis, et aI, in the amount of $125,000.
NOW, THEREFORE, BE IT DULY RESOLVED by the Chairman and
Members of the Miami Beach Redevelopment Agency that the above
settlement amounts be approved.

SUBJECT: A Resolution of t Chairman and Members of the Miami
Beach Redevelopm t Agency Approving the Settlement
Reached Regarding Attorneys' Fees and Costs for Two
Parcels (Blocks 78/80 and Block 53) in the South Pointe
Redevelopment Area.
RECOMMENDATION:
Approve the Resolution.
BACKGROUND:
At the executive session held on March 20, 1996, John C. Lukacs,
outside counsel to the Redevelopment Agency (Agency), reported on
the negotiations for settlement of fees and costs for two parcels.
The attached chart summarizes his report.
Due to the reduction in fees agreed to by each of the parties, we
are requesting that the Agency Board approve these settlements.
The total compensation for MBRDA v. Azcui, et el. will be $147,000
and the total compensation for MBRDA v. Butnis, et ale will be
$125,000.
ANALYSIS:
The negotiated settlements for each of these cases is significantly
less than the original request for fees and costs, and results in
a total savings to the Agency of $112,000. Following the Board's
recommendation at the above-referenced Executive Session, this
matter is being brought to you for formal approval.
CONCLUSION:
It is recommended that the Agency Board approve the settlements as
listed on the attached summary.
