RECOMMENDATION: Approve the Resolution. BACKGROUND: At the executive session held on March 20, 1996, John C. Lukacs, outside counsel to the Redevelopment Agency (Agency), reported on the negotiations for settlement of fees and costs for two parcels. The attached chart summarizes his report. Due to the reduction in fees agreed to by each of the parties, we are requesting that the Agency Board approve these settlements. The total compensation for MBRDA v. Azcui, et el. will be $147,000 and the total compensation for MBRDA v. Butnis, et ale will be $125,000. ANALYSIS: The negotiated settlements for each of these cases is significantly less than the original request for fees and costs, and results in a total savings to the Agency of $112,000. Following the Board's recommendation at the above-referenced Executive Session, this matter is being brought to you for formal approval. CONCLUSION: It is recommended that the Agency Board approve the settlements as listed on the attached summary. Sf)UTIi f)f)I/ll{f"1: Iledevelvpment f)lstrlct JGP/MSn/jm /\~ CIIT CI:/ll{f"t:l?
