Resolution 8827 RESOLUTION NO. 8827 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD ON DECEMBER 14, 1954. WHEREAS, this City Council has made a canvass of the returns of the Certificates of the Inspectors and Clerks who held and conducted the Special Municipal Election held on December 14, 1954, such canvass having been made solely, exclusively and entirely from such returns; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that we do hereby find and declare that the total number of votes cast in said election for the approval of the questions and the total number of votes cast in said election against the approval of the questions were as follows: Upon Question No . 1: "SHALL THE MEASURE KNOWN AS ORDINANCE NO. 1140, PASSED AND ADOPTED ON ITS THIRD AND FINAL READING ON THE 5TH DAY OF NOVEMBER, 1954, AND ENTITLED: "AN ORDINANCE GRANTING TO THE MIAMI BEACH RAILWAY COMPANY, A FLORIDA CORPORATION, AND TO ITS SUC- CESSORS AND ASSIGNS, THE RIGHT TO USE ALL PRESENT AND FUTURE STREETS, AVENUES AND OTHER PUBLIC HIGHWAYS IN THE CITY OF MIAMI BEACH AND ITS SUC- CESSORS AND IN THE PRESENT OR FUTURE CORPORATE LIMITS THEREOF FOR AND DURING A PERIOD OF TWENTY (20) YEARS, FOR THE PURPOSE OF ESTABLISHING, OPERATING AND MAINTAINING A BUS SYSTEM FOR TRANS- PORTING PASSENGERS FOR COMPENSATION, IN CONFORMITY WITH AND SUBJECT TO ALL PROVISIONS, TERMS AND CONDITIONS HEREIN RECITED", BE APPROVED OR DIS- APPROVED?" 1795 votes were cast, of which 1474 votes were "For the Ordinance" and 321 votes were "Against the Ordinance" . Upon ,4uestion No. 2: "SHALL THE MEASURE KNOWN AS CHAPTER 29289, LAWS OF FLORIDA, ACTS OF 1953, ENTITLED: "AN ACT AMENDING SECTION 40 OF CHAPTER 7672, LAWS OF ELORIDA, ACTS OF 1917, ENTITLED 'AN ACT TO ABOLISH THE PRESENT MUNICIPAL GOVERNMENT OF THE TOWN OF MIAMI BEACH, IN THE COUNTY OF DADE AND STATE OF FLORIDA, AND TO ESTABLISH, ORGANIZE AND INCORPORATE A CITY GOVERNMENT FOR THE CITY OF MIAMI BEACH, TO DEFINE ITS TERRITORIAL BOUNDARIES, TO PRESCRIBE ITS JURISDICTION, POWERS AND PRIVILEGES, AND FOR THE EXERCISE OF SAME, AND TO AUTHORIZE THE IMPOSITION OF PENALTIES FOR THE VIOLATION OF ITS ORDINANCES ' , RELATING TO THE METHOD OF ELECTING MEMBERS OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH BY PROVIDING FOR PRIMARY AND REGULAR ELECTIONS; PROVIDING THAT A CANDIDATE WHO RECEIVES A MAJORITY IN THE PRIMARY SHALL BE DECLARED ELECTED; PROVIDING FOR A REFERENDUM", BE APPROVED OR DISAPPROVED?" 1613 votes were cast, of which 1209 votes were "For the Measure" and 404 votes were "Against the Measure". BE IT FURTHER RESOLVED that we do hereby declare that the measure known as Ordinance No. 1140, and the measure known as Chapter 29289, Laws of Florida, Acts of 1953, were both legally approved by the voters as provided by law.
