RESOLUTION NO. 9049
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, CALLING AN
ELECTION AT WHICH THERE SHALL BE SUBMITTED
TO A VOTE THE MATTER OF ISSUANCE OF BONDS
OF SAID CITY IN THE SUM OF ;4,700,000.00
FOR THE PURPOSES IN THIS RESOLUTION STATED.
WHEREAS, the City Council of the City of Miami Beach, Florida,
deems it advisable to issue bonds of said City in amounts and for
the municipal purposes set forth in the election notice provided
for in Section 6 of the following resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA:
SECTION 1 : That, subject to the authorization of the duly
registered and qualified voters of said City,
who are freeholders therein, participating in the election ac-
cording to law, which is hereinafter called, negotiable coupon
bonds of the City of Miami Beach, Florida, shall be issued in
the sums and for the purposes stated in the Notice of Election
provided in Section 6 of this resolution.
SECTION 2: That a special election is hereby called and
directed to be held in the City of Miami Beach,
Florida, from seven o 'clock A.M. until seven o'clock P.M. on the
7th day of June, A.D. 1955, for the purpose of submitting to a
vote of the duly registered and qualified voters of said City
who are freeholders therein, the questions whether bonds of said
city shall be issued in the sums and for the purposes stated in
the Notice of Election provided for in Section 6 of this resol-
ution.
SECTION 3: That the City Clerk, who is also the Supervisor
of Registration, open the books of said City
from nine o 'clock A.M. until five o 'clock P.M. , each day, Sundays
and Holidays excepted, from May 5, 1955 to June 1, 1955, both in-
clusive, for the purpose of registering those electors who are
qualified to register for this election, and after said June 1,
1955, no elector shall be registered for said election.
SECTION 4: For the purpose of holding and conducting said
election, the City of Miami Beach has been
divided into voting precincts or election districts with polling
places therein, as follows :
PRECINCT NO. 25-A: Being the area within the City of Miami
Beach lying between the North line of the
corporate limits of the City of Miami Beach ON THE NORTH and a
line ON THE SOUTH running westerly from the Atlantic Ocean along
the center line of 71st Street to the center line of Indian Creek;
thence northerly along the center line of Indian Creek to the
center line of Normandy Waterway; thence westerly along the center
line of Normandy Waterway to Biscayne Bay, the Polling Place of
which shall be at the NORTH SHORE PARK RECREATION CENTER BUILDING
at 72nd Street and Byron Avenue .

PRECINCT NO. 25-B: Being the area within the City of Miami
Beach lying between the South line of
Precinct No . 25-A ON THE NORTH and the center line of 51st
Street ON THE SOUTH, the Polling Place of which shall be at
the 69TH STREET FIRE STATION, situated at 6860 Indian Creek
Drive.
PRECINCT NO. 26: Being the area within the City of Miami
Beach lying between the South line of
Precinct No . 25-B ON THE NORTH and a line ON THE SOUTH running
westerly from the Atlantic Ocean along the center line of 34th
Street to Biscayne Waterway, thence westerly along the center
line of Biscayne Waterway to Biscayne Bay, the Polling Place
of which shall be at the NORTH BEACH ELEMENTARY SCHOOL, situated
on the northeast corner of the intersection of 41st Street and
Chase Avenue .
PRECINCT NO. 27: Being the area within the City of Miami
Beach lying between the South line of
Precinct No. 26, ON THE NORTH, and a line ON THE SOUTH running
westerly from the Atlantic Ocean along the center line of 23rd
Street to Dade Boulevard, thence along the center line of Dade
Boulevard to Biscayne Bay, also including Belle Isle, Rivo Alto
Island, Di Lido Island and San Marino Island, the Polling Place
of which shall be at the DADE BOULEVARD FIRE STATION, situated
on the northwest corner of the intersection of Dade Boulevard
and Pine Tree Drive .
PRECINCT NO. 28: Being the area within the City of Miami
Beach lying between the South line of
Precinct No. 27 ON THE NORTH and a line ON THE SOUTH running
westerly from the Atlantic Ocean along the center line of 15th
Street to Bay Road, thence South along the center line of Bay
Road to 14th Street, thence West along the center line of 14th
Street to Biscayne Bay, the Polling Place of which shall be at
the east entrance of the MUNICIPAL OFFICE BUILDING at 17th Street
and Drexel Avenue.
PRECINCT NO. 29 : Being the area within the City of Miami
Beach lying between the South line of
Precinct No. 28 ON THE NORTH and a line ON THE SOUTH running
westerly from the Atlantic Ocean to Biscayne Bay along the
center line of 11th Street and said line produced, the Polling
Place of which shall be at the FIRE STATION IN THE CITY HALL
BUILDING, situated on 12th Street between Washington Avenue and
Drexel Avenue .
PRECINCT NO. 30: Being the area within the City of Miami
Beach lying between the South line of
Precinct No. 29 ON THE NORTH and a line ON THE SOUTH running
westerly from the Atlantic Ocean along the center line of 7th
Street to Alton Road, thence South along the center line of
Alton Road to 6th Street, thence westerly along the center line
of 6th Street to Biscayne Bay, the Polling Place of which shall
be at the OCEAN FRONT AUDITORIUM at 10th Street and Ocean Drive .
PRECINCT NO. 31: Being the area within the City of Miami
Beach lying between the South line of
Precinct No . 30, ON THE NORTH and a line ON THE SOUTH running
westerly from the Atlantic Ocean along the center line of 3rd
Street to Alton Road, thence along the south line of Lot 32
in Block 111 of Ocean Beach Addition No . 3, to Biscayne Bay,
also including Star Island, Palm Island and Hibiscus Island,
the Polling Place of which shall be at the SOUTH BEACH ELEMENT_
ARY SCHOOL, situated between Third and Fourth Streets on Alton
Road.

PRECINCT NO . 32: Being all the area within the City of
Miami Beach lying South of the South line
of Precinct No. 31, also including the Causeway property and the
islands south of the County Causeway, the Polling Place of which
shall be at the SOUTH SHORE PARK RECREATION CENTER BUILDING on
Biscayne Street at Biscayne Bay.
All being places where elections are usually held in said munici-
pality.
All electors shall vote at the Polling Places in the voting pre-
cincts in which the City Registration Books show that said elect-
ors reside .
SECTION 5: That Thirty Days ' notice of said election shall
be given by publication in the Miami Beach Sun,
a newspaper published in the City of Miami Beach, Florida. Such
publication shall be made at least once each week for four conse-
cutive weeks during said period of Thirty days .
SECTION 6: That the Notice of Election shall be substantially
in the following form:
"CITY OF MIAMI BEACH, FLORIDA,
NOTICE OF SPECIAL ELECTION.
NOTICE is hereby given that an election has been called by the City
Council of the City of Miami Beach, Florida, and will be held in
said City from seven o 'clock A.M. until seven o 'clock P.M. on the
7th day of June, A.D. 1955, at which there shall be submitted to
the duly registered and qualified voters of said City who are free-
holders therein, the following questions :
1 . Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of $335,000.00 with interest
at a rate hereafter to be determined, not exceeding 3 '
per annum, for the purpose of installing a reservoir and
mains in connection with its water system?
2. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of $360,000.00 with interest
at a rate to be hereafter determined, not exceeding 3%
per annum, for the purpose of constructing two sanitary
sewer force main booster pumping stations and expanding
• existing sanitary sewer pumping facilities?
3. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of $1,110,000.00 with interest
at a rate to be hereafter determined, not exceeding 3-
per annum, for the payment of which a special annual tax
will be levied, the amount of which levy will be reduced
by collections from special improvement assessments made
against abutting property, as authorized by law, for the
purpose of constructing sanitary sewer systems on Biscayne
Point, Palm, Hibiscus, Star, Rivo Alto, DiLido, San Marino,
Sunset No . 1, No . 2, No. 3 and No. 4 Islands?
4. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of $453,000.00 with interest
at a rate hereafter to be determined, not exceeding 3e
per annum, for the purpose of constructing storm sewers?
5. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of $150,000.00 with interest
at a rate to be hereafter determined, not exceeding 34%
per annum, for the purpose of lengthening the existing
fishing pier at Biscayne Street in the Atlantic Ocean?

6. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of 0450,000 .00 with interest
at a rate to be hereafter determined, not exceeding 3
per annum, for the purpose of constructing an auditorium
in that part of the City lying north of 63rd Street?
7. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of 0255,000 .00 with interest
at a rate to be hereafter determined, not exceeding 3 %
per annum, for the purpose of constructing a four lane
bridge across Flamingo Waterway at Pine Tree Drive, and
for the purpose of paving that portion of Pine Tree Drive
extending from 46th Street to 51st Street, for the pay-
ment of which a special annual tax will be levied, the
amount of which levy will be reduced by collections from
special improvement assessments for a portion of the cost
of said paving,made •against abutting property,as authori-
zed by law?
8. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of x;165,000 .00 with interest
at a rate to be hereafter determined, not exceeding 3t%
per annum, for the purpose of widening the pavement of
that portion of Meridian Avenue extending from 17th
Street to Dade Boulevard, and for the purpose of widen-
ing the Meridian Avenue bridge over Collins Canal?
9 . Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of '465,000.00 with interest
at a rate to be hereafter determined, not exceeding 3N
per annum, for the purpose of widening and paving that
portion of Collins Avenue extending from 44th Street to
the north line of Lot 12 of Indian Beach Corporation' s
Subdivision and for the construction of a seawall and
sidewalks in connection with said widening and paving,
for the payment of which a special annual tax will be
levied, the amount of which levy will 'De reduced by
collections from special improvement assessments for
the cost of said sidewalks ,made against abutting pro-
perty,as authorized by law?
10. Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of 070,000.00 with interest
at a rate to be hereafter determined, not exceeding 3u5
per annum, for the purpose of paving that portion of Alton
Road extending from 19th Street to Biscayne Waterway and
for the purpose of constructing a four lane bridge across
Biscayne Waterway at Alton Road?
11 . Shall the City of Miami Beach, Florida, issue negotiable
coupon bonds in the amount of 0b5,000 .00 with interest
at a rate to be hereafter determined, not exceeding 3
per annum, for the payment of which a special annual tax
will be levied, the amount of which levy will be reduced
by collections from special improvement assessments made
against abutting property,as authorized by law, for the
purpose of paving (including sidewalks ) the following
highways: Carlyle Avenue from 73rd Street to 80th Street;
75th Street from Dickens Avenue to Harding Avenue; Byron
Avenue from 73rd Street to 81st Street; Bay Drive from
Calais Drive to Rue Granville; 74th Street from Dickens
Avenue to Harding Avenue; 78th Street from Tatum Water-
way Drive to Dickens Avenue, and for the purpose of
paving the following highways: Hawthorne Avenue from
77th Street to 86th Street; Tatum Waterway Drive from
77th Street to 79th Street; 85th Street from Hawthorne
Avenue to Tatum Waterway; Marseille Drive from Rue Notre
Dame to Bay Drive; Bay Drive easterly from Rue Versailles
to 71st Street; South Shore Drive from Ray Street to North
Shore Drive?
12. Shall the City of Miami Beach, Florida, issue negotiable

SECTION 8: That there shall be apportioned and levied as
special improvement assessments against the
abutting property on a front foot basis such portion of the cost
of the construction of the sanitary sewer systems referred to in
Question "3" hereinabove set forth as is by law authorized to be
apportioned and levied.
SECTION 9: That there shall be apportioned and levied as
special improvement assessments against the
aubtting property on a front foot basis such portion of the cost
of construction of the paving referred to in Question "7" herein-
above set forth as is by law authorized to be apportioned and
levied.
SECTION 10: That there shall be apportioned and levied as
special improvement assessments against the
abutting property on a front foot basis such portion of the cost
of the construction of the sidewalks referred to in Question "9"
hereinabove set forth as is by law authorized to be apportioned
and levied.
SECTION 11 : That there shall be apportioned and levied as
special improvement assessments against the
abutting property on a front foot basis such portions of the
cost of the construction of the highway improvements referred
to in Question "10" hereinabove set forth as is by law authorized
to be apportioned and levied.

SECTION 12: That the collections upon the special improve-
ment assessments against abutting properties
shall be deposited in the City' s local improvement bond fund
for application to interest and principal payments on the bonds
hereby authorized and hereafter to be sold for the purpose of
paying in the first instance the cost of said improvements.
SECTION 13: That a special annual tax upon all taxable
property within the City of Miami Beach, over
and above all other taxes authorized or limited by law, or by
the Charter of the City, sufficient to pay the interest and the
principal of the bonds hereby authorized, at their several dates
of maturity, shall be and is hereby levied, provided that the
amount of such special annual tax levy shall be reduced by the
amount then contained in the local improvement bond fund, and
by the amount of special improvement assessments collected and
then remaining in the local improvement bond fund, and by the
amount of any other funds applicable to said bonds .
SECTION 14: That the special improvement assessments against
abutting property herein provided for, for high-
way improvements (including sidewalks) are hereby pledged for the
payment of principal and interest of the bonds hereby authorized
for the purpose of such highway improvements, and the special
improvement assessments against abutting property herein provided
for, for the sanitary sewer system, are hereby pledged for the
payment of principal and interest of the bonds hereby authorized
for the purpose of constructing said sanitary sewer system, and
the proceeds of the special annual tax hereby provided for shall
be used for no other purpose than the payment of principal and
interest of the bonds hereby authorized, at their several dates
of maturity, and any balance collected at any time upon such
special annual tax after the payment of principal and interest
upon the bonds hereby authorized shall be deposited in the local
improvement bond fund.
SECTION 15: This resolution shall be effective immediately
upon its passage and adoption, as required by
law.
