Resolution 9080 T RESOLUTION NO. 9080 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AS TO THE NUMBER OF FREEHOLDERS LEGALLY QUALIFIED TO PARTICIPATE IN THE SPECIAL ELECTION HELD JUNE 7, 1955; AND CANVASSING THE RETURNS OF THE SPECIAL ELECTION AND DECLARING THE RESULT TO BE FOR THE ISSUANCE OF BONDS IN THE TOTAL SUM OF $4,100,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS, the City Clerk and Supervisor of Registration in the City of Miami Beach, Florida, has certified that the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in the Special Election held in said City on June 7, 1955, was 6,484, and • WHEREAS, this City Council has made a canvas, of the returns of the certificates of the Clerks and Inspectors who held and conducted said Special Election held on June 7, 1955, such canvass having been made solely, exclusively and entirely from such returns, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that we do hereby find and declare that the total number of freeholders who were qualified electors residing in said City and legally qualified to participate in the Special Election held in said City on June 7, 1955, was 6,484, and that a majority thereof participated in said election, and BE IT FURTHER RESOLVED that we do hereby find and declare that the total number of votes cast in said election in favor of the approval of the bonds and the total number of votes cast in said election against the approval of the bonds were as follows : UPON QUESTION NO. 1: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $335,000.00 with interest at a rate hereafter to be determined, not exceeding 31 per annum, for the purpose of installing a reservoir and mains in connection with its water system?" 4 404 votes were cast, of which 3,613 votes were For Bonds" and 791 votes were "Against Bonds". UPON QUESTION NO. 2: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $360,000.00 with interest at a rate to be hereafter determined, not exceeding 3 % per annum, for the purpose of constructing two sanitary sewer force main booster pumping stations and expanding existing sanitary sewer pumping facilities?" 4,371 votes were cast, of which 3,610 votes were "For Bonds" and 761 votes were "Against Bonds". UPON QUESTION NO. 3: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $1,110,000.00 with interest at a rate to be hereafter determined, not exceeding 3b6 per annum, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of constructing sanitary sewer systems on Biscayne Point, Palm, Hibiscus, Star, Rivo Alto, Di Lido, San Marino, Sunset No. 1, No. 2, No. 3 and No. 4 Islands?" 4 119 votes were cast, of which 2 674 votes were "Forr Bonds" and 1,44_2 votes wereAgainst Bonds". UPON QUESTION NO. 4 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $453,000.00 with interest at a rate hereafter to be determined, not exceeding 3N per annum, for the purpose of constructing storm sewers?" 4,367 votes were cast, of which 3,563 votes were "For Bonds" and 804 votes were "Against Bonds". UPON QUESTION NO. 5 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $150,000.00 with interest at a rate to be hereafter determined, not exceeding 3,÷;(1) per annum, for the purpose of lengthening the existing fishing pier at Biscayne Street in the Atlantic Ocean?" 4 017 votes were cast, of which 1 988 votes were For Bonds" and 2,029 votes wereAgainst ainst Bonds". UPON QUESTION NO. 6: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $450,000.00 with interest at a rate to be hereafter determined, not exceeding 3N per annum, for the purpose of constructing an auditorium in that part of the City lying north of 63rd Street?" 4,112 votes were cast, of which 2,050 votes were "For Bonds" and 2,062 votes were "Against Bonds". UPON QUESTION NO. 7: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $255,000.00 with interest at a rate to be hereafter determined, not exceeding 3N per annum, for the purpose of constructing a four lane bridge across Flamingo Waterway at Pine Tree Drive, and for the purpose of paving that portion of Pine Tree Drive extending from 246th Street to 51st Street, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments for a portion of the cost of said paving, made against abutting property, as authorized by law?" 24,156 votes were cast, of which 2,865 votes were "For Bonds" and 1,291 votes were "Against Bonds'; UPON QUESTION NO. 8: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $165,000.00 with interest at a rate to be hereafter determined, not exceeding 3o per annum, for the purpose of widening the pavement of that portion of Meridian Avenue extending from 17th Street to Dade Boulevard, and for the purpose of widening the Meridian Avenue bridge over Collins Canal?" 4,097 votes were cast, of which 2 822 votes were "For Bonds" and 1,275 votes were � ainst bonds". UPON QUESTION NO. 9: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $265,000.00 with interest at a rate to be hereafter determined, not exceeding 3 -% per annum, for the purpose of widening and paving that portion of Collins Avenue extending from 44th Street to the north line of Lot 12 of Indian Beach Corporation's Subdivision and for the construction of a seawall and sidewalks in connection with said widening and paving, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments for the cost of said sidewalks, made against abutting property, as authorized by law?" 4 064 votes .were cast, of which 2,598 votes were "For Bonas" and 1,466 votes were Against Bonds". UPON QUESTION NO. 10: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $470,000.00 with interest at a rate to be hereafter determined, not exceeding 31,E per annum, for the purpose of paving that portion of Alton Road extending from 19th Street to Biscayne Waterway and for the purpose of constructing a four lane bridge across Biscayne Waterway at Alton Road?" 4 090 votes were cast, of which 2 815 votes were or Bonds" and 1,275 votes wereAgainst ainst Bonds". UPON QUESTION NO. 11 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $465,000.00 with interest at a rate to be hereafter determined, not exceeding 31% per annum, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of paving (including sidewalks) the following highways : Carlyle Avenue from 73rd Street to 80th Street; 75th Street from Dickens Avenue to Harding Avenue; Byron Avenue from 73rd Street to 81st Street; Bay Drive from Calais Drive to Rue Granville; 74th Street from Dickens Avenue to Harding Avenue; 78th Street from Tatum Waterway Drive to Dickens Avenue, and for the purpose of paving the following highways : Hawthorne Avenue from 77th Street to 86th Street; Tatum Waterway Drive from 77th Street to 79th Street; 85th Street from Hawthorne Avenue to Tatum Waterway; Marseille Drive from Rue Notre Dame to Bay Drive; Bay Drive easterly from Rue Versailles to 71st Street; South Shore Drive from Ray Street to North Shore Drive?" 4,065 votes were cast, of which 2,578 votes were "For Bonds" and 1,487 votes were "Against Bonds". UPON QUESTION NO. 12: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $110,000.00 with interest at a rate to be hereafter determined, not exceeding 31% per annum, for the purpose of widening the bridge across Collins Canal at Alton Road?" 4,138 votes were cast, of which 2,973 votes were "For Bonds" and 1,165 votes were "Against Bonds". UPON QUESTION NO. 13: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $112,000.00 with interest at a rate to be hereafter determined, not exceeding 31/, per annum, for the purpose of constructing two two-lane bridges on 77th Street, one across Tatum Waterway and one across the canal at the easterly extremity of Biscayne Point?" 4 083 votes were cast, of which 2 608 votes were "For Bonds" and 1,475 votes were Against Bonds". and WHEREAS, a majority of the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in said Special Election, did vote therein, and WHEREAS, a majority of the votes cast on Questions Nos. 1, 2, 3, 4, 7, 8, 9, 10, 11, 12 and 13 were in favor of the approval of the bonds, and WHEREAS, a majority of the votes cast on Questions Nos. 5 and 6 were against the approval of the bonds; NOW, THEREFORE, BE IT RESOLVED that we do hereby declare that the issuance of bonds in the aggregate sum of $4,100,000.00, as set forth and provided for in Questions Nos. 1, 2, 3, 4, 7, 8, 9, 10, 11, 12 and 13, as described in this resolution, has been duly and legally approved by the voters, as provided by law. BE IT FURTHER RESOLVED that the issuance of bonds in the sum of $600,000.00, as set forth and provided for in Questions Nos. 5 and 6, as described in this resolution, has not been approved by the voters. PASSED and ADOPTED this 8th day of June, A.
