PROVIDING FOR THE ELECTION OF A REGULAR EMPLOYEE
OF THE CITY OF MIAMI BEACH AS A MEMBER OF THE
BOARD OF TRUSTEES FOR THE RETIREMENTT AND PENSION
SYSTEM REPRESENTING GROUP TWO.
WHEREAS, pursuant to the provisions of Chapter 18691, Laws of Florida,
Acts of 1937, as amended, and Ordinance No. 845 enacted pursuant thereto,
it is provided that there shall be three employees of regular status
elected to the Board of Trustees of the City of Miami Beach Employees Re-
tirement System, and
WHEREAS, the term of DAVID J. CLEARY, a Trustee of the City of Miami
Beach Employees Retirement System, as provided by Ordinance No. 84.5, and
representing employees in Group 2, expires August 31, 1955
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Miami Beach, Florida as follows :
SECTION 1: That a Primary and an Election are hereby called for the pur-
pose of electing a Trustee from Group 2 to succeed DAVID J.
CLEARY, to serve for a term of three years, or until his successor is duly
elected and qualified, said Primary to be held between the hours of 9 :00 A.M.
and. 5:00 P.M. , on Tuesday, August 9, 1955, and said Election to be held
between the hours of 9 :00 A.M. and 5:00 P.M. , on Tuesday, August 16, 1955.
SECTION 2: That the City Clerk be and he is hereby instructed to notify
the members of Group 2 of said Primary and Election by posting
a notice stating the time, place and purpose of said Primary and Election,
in a conspicuous place in each department of the City wherein members of
Group 2 are employed.
ISECTION 3 : That for the purpose of holding and conducting said Primary
and Election, the City Clerk is hereby authorized to appoint
k three (3) employees to serve as Clerk and Inspectors.
SECTION 4: That the City Clerk be and he is hereby appointed as Super-
visor of said Primary and Election, and is hereby further
instructed to provide ballots and all necessary paraphernaliato the In-
spectors and Clerk herein, to enable them to properly hold and conduct said
Primary and Election.
SECTION 5 : That the two ( 2) members receiving the highest number of votes
cast at the Primary on August 9, 1955, shall be the only can-
didates for Trustee at the Election on August 16, 1955, provided, however,
that should any member receive a majority of the votes cast at the Primary,
he will be thereby declared elected as a Trustee and the Election as herein
planned be omitted.
SECTION 6: That immediately after the polls are closed in the Primary and
in the Election herein called, the Inspectors and Clerk shall
proceed to open the ballot box and count the ballots cast, tabulating the
result, and upon completion of said count they shall promptly certify the
result of said Primary or Election, as the case may be, to the City Clerk,
in duplicate, on forms to be supplied them by the said City Clerk.
SECTION 7: That the City Clerk be and he is hereby instructed to present
to the City Council, at their first meeting following the
holding of said Election, the Certificate of said Inspectors and Clerk, as
to the result of said Election, whereupon this Body shall declare the Trustee
elected as indicated in said Certificate.
