AN ORDINANCE OF THE CITY (DtKlSSION OF THE CITY OF
KIAMI BEACH, FLORIDA, AMENDING ORDINANCE 1901, WHICH
CREATED A RETI:RmfENT SYSTEM FOR GENERAL l!MPLOYKES OF
THE CITY OF KIAMI BEACH, AMENDING SECTION 5.09 ENTITLED
"POST RETIRHHENT ADJUSTMENTS" OF ARTICLE 5 ENTITLED
"BENEFITS" BY ADDING A NEW SUBPARAGRAPH (n).. PROVIDING
FOR A COST - OF - LIVING INCREASE OF FIVE PERCENT FOR
RETIRANTS AND PENSIONERS WHO HAVE BEEN RETIRED FOR OVER
FIVE YEARS; REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; PROVIDING FOR SEVERABILITY;AND PROVIDING FOR
AN EFFECTIVE DATE.
Be it ordained by the City COIIIIlission of the City of Miami Beach,
Florida:
Section 1
That Section 5.09 entitled "Post Retirement Adjustments" of
Article 5 entitled "Benefits" of City of Miami Beach Ordinance
No. 1901 creating a Retirement System for General Employees is
hereby amended by adding the following:
(n) Effective October 1, 1989, Retirants and Pensioners
who were on the Retirement Payroll prior to October
1, 1984, and Pensioners entitled to receive a
pension allowance as the result of the death of a
Retirant who retired prior to October 1, 1984, shall
receive a special cost-of-living increase in their
retirement allowance or pension in addition to the
allowances previously provided under paragraph (e)
through (m) of this Section 5.09. The increase
shall be five percent of the normal retirement
allowance as adjusted in accordance with the
preceding paragraphs of Section 5.09.
Section 2. Repealer
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
Section 3. Severability
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then the same holding shall in no way affect the
validity of the remaining portions of this ordinance.
Section 4. Effective Date
This Ordinance shall take effect ten (10) days after its adoption
on December 16, 1989.

COST-OF-LIVING INCREASE FOR RETIREES OF THE GENERAL EMPLOYEES
PENSION SYSTEM
This Ordinance will grant to retirees, who have been retired five
or more years, of the General Employees Pension System a five per-
cent increase in their monthly pension allowance. The last such
increase was in 1987. This Ordinance is recommended by the Pension
Board.
Administration Recommendation:
The Administration recommends that the City Commission adopt this
Ordinance on first reading and schedule the public hearing and second
reading on December 6, 1989.
