Resolution 9199 RESOLUTION NO. 9199
WHEREAS, a liquor license was formerly issued for a
place of business located at 2200 Park Avenue in Miami Beach,
= Florida; and
WHEREAS, the City Council permitted and allowed said
beverage license held by Birdland Operating Company, Inc. , the
lessee of the premises at 2200 Park Avenue, to transfer said
liquor license on April 20, 1955, to a place of business located
at 2228 Park Avenue in accordance with Section 15.6 of the City
Code; and
WHrRiAS, the premises at 2200 Park Avenue have been
operated where liquor was sold for the past fifteen (15) years; and
WHEREAS, said premises are not well adapted to anything
other than a combination restaurant and cocktail bar; and
WHEREAS, Mrs. Florence Halper has applied for a
special liquor license under the provisions of Section 561,20,
subsection (2) of the Florida Statutes, as amended by Chapter
29786, Laws of Florida, Acts of 1955, in that her place of
business, to wit, 2200 Park Avenue, is a restaurant and contains
the conditions set forth in said statute, including space for
service of 200 or more patrons at tables, and occupies more
than 4,000 square feet of space; and
WHEREAS, the City of Miami Beach has an ordinance
that is more restrictive than said statute, and the ordinance
should be construed in the light of this statute, and under
the particular facts of this case the ordinance should be
waived so as to comply with the said Florida Statute, and
particularly since a special license issued under the above
statute cannot be transferred from the place of business,
NOW, THEREFORE
BE IT RESOLVED by the City Council of the City of
Miami Beach, Florida that the provisions of the Code of said
City, insofar as they prohibit the issuance of a special liquor
license to Mrs. Florence Halper at 2200 Park Avenue in the City
of Miami Beach, are hereby waived, and a special license by the
City of Miami Beach is hereby authorized, and the same shall
be issued upon the surrender of the regular liquor and alcoholic
beverage license heretofore issued, to wit: License No. 338.
No additional compensation need be paid by the said Floronce
Halper for said special license for the year 1955-1956,
