Resolution 9290 RESOLUTION NO. 9290
WHEREAS, the North Shore Bank is the owner of Lot 1
and Lot 18 of Block 12, of Normandy Beach South Subdivision,
recorded in Plat Book 21, page 54 of the Public Records of
Dade County, Florida , and
WHEREAS, the easterly five (5) feet of said Lot 1,
and the westerly five (5) feet of said Lot 18, are subject
to various public service and utility easements, and
WHEREAS, the owner of said lots has requested
permission to construct an overhead covered walkway from the
existing bank building on said Lot 1 to certain drive-in bank
teller booths situate on the unencumbered portion of said
Lot 18, over and above said easement, and
WHEREAS,the plans and specifications and the proposed
location of said proposed walkway have been respectively approved
by the Building Inspector and the City Engineer, and
WHEREAS, it has been represented by the owner of said
lots that no interest of the public or of the City of Miami
Beach will be impaired by the construction of said proposed
overhead walkway,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, that the construction and maintenance
of said proposed walkway be and the same is hereby approved,
provided that the construction and location thereof be subject
to the approval of the Building Inspector and City Engineer,
and further provided that the permission hereby granted for the
construction and maintenance of said walkway shall be subject
to revocation in the event that the same may hereafter be found
and determined to impair or interfere with any right or interest
of the public or the City of Miami Beach in and to said easement.
