A RESOLUTION REQUESTING THE FLORIDA RAILROAD AND PUBLIC
UTILITIES COMMISSION TO DENY THE APPLICATION OF ROCKANA
CARRIERS, INC. WHEREIN SAID COMPANY SEEK A CERTIFICATE
OF PUBLIC CONgNIENCE AND NECESSITY AUTHORIZING THE
TRANSPORTATIO /FERTILIZER, FERTILIZER MATERIALS AND
INGREDIENTS IRRESPECTIVE OF HOW USED AND INCLUDING
SPECIFICALLY ALL COMMODITIES DEFINED AS FERTILIZER
UNDER RULE 11 RAILROAD RULES OF THE FLORIDA RAILROAD
AND PUBLIC UTILITIES COMMISSION AND IN ADDITION THEREOF,
DO.LEMITE, CALCIUM, LIME AND LIKE MINERALS; INSECTICIDES,
SALTS, SODA, ASH, SAND, SULPHUR, CLAY, ROCK AND GRAVEL;
COAL, COAL PRODUCTS AND BY-PRODUCTS, IN BULK (IN OTHER
THAN LIQUID FORM) AND IN BAGS, TO AND BETWEEN ALL POINTS
AND PLACES IN THE STATE OF FLORIDA.
WHEREAS, the City Council of the City of Miami Beach, Florida,
has been advised that there is pending before the Florida Railroad
and Public Utilities Commission an application of the Rockana Carriers,
Inc. , in Docket #4753-CCT of said commission for a certificate of
public convenience and necessity to operate an auto transportation
company as a common carrier of the commodities set forth in their
petition within the State of. Florida generally, the effect of which
if granted, will amount to the authorization of said company to
transport over the highways of the State of Florida dry chemicals
and minerals; and,
WHEREAS, any favorable action by the Florida Railroad and
Public Utilities Commission permitting the transportation of heavy
materials by truck or other motor vehicle facilities would create
irreparable injury and damage to Florida highways and public ways
which would result in an increase in taxes upon the property owners
of Florida for the care and maintenance of such highways and public
ways.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach, Florida, that it does hereby oppose the granting of
the application of Rockana Carriers, Inc. , as shown in the Docket
No. 4753-CCT of said commission, for authority to transport minerals
and chemicals within the State of Florida, and hereby authorizes
and directs the officials of the City of Miami Beach, Florida, to
do and perform everything within their power to resist said application.
