Resolution 9543 RESOLUTION NO. 9543
WHEREAS, by the terms of that certain Plat recorded
in Plat Book 46 at page 2 of the Public Records of Dade
County, Florida, there was reserved for storm sewers the
following described land situate, lying and being in Dade
County, Florida, to wit :
The southwesterly 5 feet of Lot 9 and the
northeasterly 5 feet of Lot 10, of Block 1,
TATUM WATERWAY SUBDIVISION, according to the
Plat thereof, recorded in Plat Book 46 at
page 2 of the Public Records of Dade County,
Florida;
and
WHEREAS, the owner of the said land has requested
the City of Miami Beach to relinquish and surrender all
rights conferred upon or granted to said City by virtue of
said Plat as to the lands hereinbefore described, and
WHEREAS, the said owner has offered, in consideration
of such relinquishment and surrender, to grant to the City of
Miami Beach a storm sewer easement over, under and across the
following described lands, situate, lying and being in Dade
County, Florida, to wit:
The northeasterly 5 feet of the southwesterly
36 feet of Lot 9, less the southeasterly 21
feet thereof, and the southwesterly 5 feet of
the northeasterly 24 feet of Lot 9, less the
southeasterly 22 feet thereof, of Block 1,
TATUM WATERWAY SUBDIVISION, according to the
Plat thereof recorded in Plat Book 46 at page 2
of the Public Records of Dade County, Florida;
and
WHEREAS, the City Attorney has prepared and
submitted instruments for execution by the said City
accomplishing the exchange of easements as above set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach, Florida, that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute said instruments in the name of and on behalf of the
said City.
BE IT FURTHER RESOLVED that the City Attorney be
and he is hereby authorized and directed to deliver said
executed instruments if, as and when there has been delivered
to him good and sufficient grant unto the City of Miami Beach,
Florida, of a perpetual easement over, under and across the
northeasterly 5 feet of the southwesterly 36 feet of Lot 9,
less the southeasterly 22 feet, and the southwesterly 5 feet
of the northeasterly 24 feet of Lot 9, less the southeasterly
22 feet thereof, of Lot 9, Block 1, TATUM WATERWAY SUBDIVISION,
according to the Plat thereof recorded in Plat Book 46 at
page 2 of the Public Records of Dade County, Florida.
PASSED and ADOPTED this 17th day of July, A.D. 1957.
