Resolution 9553 RESOLUTION NO. 9553
WHEREAS, it has been duly made to appear to the
City Council of the City of Miami Beach that certain minors
committed a number of depredations to the extent of $1,500.00
upon the coin boxes of the metered parking system of the
City of Miami Beach; and
WHEREAS, it further appears that one of the said
minors appropriated $1,000.00 thereof to make a down payment
on the purchase price of an airplane from Florida Automotive,
Inc ., of Lake Worth, Florida; and
WHEREAS, it has been duly made to appear to the
City Council of the City of Miami Beach that appropriate
proceedings have been had and concluded in the Dade County
Juvenile Court as a result of said depredations; and
WHEREAS, it has been further made to appear to the
City Council of the City of Miami Beach that restitution of
the said $1,500.00 has been made to the City by a parent of
one of the minors involved; and
WHEREAS, it has been further made to appear to the
City Council of the City of Miami Beach that the said vendor
of the said airplane has already refunded $500.00 of the said
down payment to the said parent, but refuses to refund the
remaining $500.00 to the said parent by reason of a claim
made upon the said vendor by the City of Miami Beach upon
said vendor for the said sum of $500.00, and
WHEREAS, it has been made to appear to the City
Council of the City of Miami Beach that the said demand was
made prior to the restitution of the said sum of $1,500.00
to the City; and
WHEREAS, the attorney for the vendor of the said
airplane has expressed his reluctance to pay the said sum of
$500.00 by reason of the said claim of the City of Miami
Beach, but has further expressed willingness of the vendor
to pay the said sum of $500.00 to the City of Miami Beach
for payment thereof to the guardian of the said minor; and
WHEREAS, the City Council of the City of Miami Beach
has determined that it would be preferable if the said vendor
accepted a duly executed release by the City to the vendor
with authority to the vendor to make payment direct to the
guardian of the said minor, but that in view of the foregoing
and in further consideration of the fact that in the opinion
of the City Attorney there is no legal objection to the
disposition of the foregoing matter in accordance with the
preferences of the attorney for the vendor of the said airplane,
NOW, THEREFORE, BE IT DULY RESOLVED by the City
Council of the City of Miami Beach, that the duly authorized
officials of the City of Miami Beach are hereby authorized and
directed either to accept the payment of the said $500.00 from
Florida Automotive, Inc. for the purpose of deliveringthe same
to the guardian or parent of the minor who has heretofore made
restitution to the City of Miami Beach as aforesaid, and to duly
acknowledge receipt of the said payment; or in the alternative,
to execute an appropriate release for delivery to the said

Florida Automotive, Inc. authorizing it to pay the said sum
of $500.00 directly to said guardian or parent of the said
minor.
