SAID LEASE HAVING A TERM OF FIFTY (50) YEARS, COMMENCING ON

BACKGROUND
On February 7, 1986, the city entered into Sovereignty Submerged Land Lease No. 26674(3486-

the construction and operation of a 12-inch watermain crossing across a parcel of sovereignty
submerged land in Biscayne Bay between DiLido Island and Rivo Alto Island for a period of 30
years. The lease expired on February 7, 2016 and can therefore no longer be extended.
A new sovereign submerged land lease is required to maintain and operate the 12-inch watermain
crossing in its current location. The Administration negotiated a new 50-year submerged land
lease with the State to continue to operate the existing watermain, a lease which will be
retroactively applied from February 7, 2016 and end on February 7, 2066 (Attachment A).
CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the resolution to
execute a new Sovereignty Submerged Land Lease (BOT File No. 130883466) by the City of
Miami Beach, as Lessee, and the Board of Trustees of the Internal Improvement Trust Fund of
the State of Florida, as Lessor, for a watermain crossing between DiLido Island and Rivo Alto
Island.
