A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AMENDMENT NO. 9 TO THE PROFESSIONAL
ARCHITECTURAL AND ENGINEERING (NE) SERVICES AGREEMENT BETWEEN
THE CITY OF MIAMI BEACH, FLORIDA AND WOLFBERG/ALVAREZ AND
PARTNERS, INC., FOR ADDITIONAL ARCHITECTURAL PROFESSIONAL
SERVICES FOR THE FLAMINGO PARK PROJECT; IN THE NEGOTIATED NOT-
TO-EXCEED AMOUNT OF $71,200; WITH PREVIOUSLY APPROPRIATED
FUNDING.
WHEREAS, on September 05, 2007, pursuant to Request for Qualifications (RFQ)
No. 15-06/07, the Mayor and City Commission adopted Resolution No. 2007-26609
approving and authorizing the Mayor and City Clerk to execute an Agreement with
Wolfberg / Alvarez and Partners, Inc., for Professional Architecture and Engineering
Services for the Flamingo Park Project (the Agreement); and
WHEREAS, the Agreement provides for the architectural, engineering, master
planning, landscape architecture and surveying, as necessary for the Flamingo Park
Project and includes the development of the Master Plan Concept; and the design, bidding
and award services, and construction administration of the Tennis Center; and
WHEREAS, the Agreement was executed for a not-to-exceed amount of
$443,000; and
WHEREAS, on July 14, 2010, the City Commission adopted Resolution No. 2010-
27427, approving Amendment No.1 to the Agreement, in the amount of $77,720, for the
provision of additional architectural and engineering services associated with revisions to the
Master Plan and Tennis Center; and
WHEREAS, on March 20, 2012, Amendment No. 2 was executed by the City in the
amount of $1,528, for the provision of additional architectural and engineering services
associated with the relocation of the FPL transformer to the south side of the Tennis Center
and associated revisions to the electrical room; and
WHEREAS, on October 2, 2012, Amendment No. 3 was executed by the City in the
amount of $2,902, for the provision of additional architectural and engineering services
associated with the partial re-design of the Tennis Center building structure due to an
unforeseen existing underground utility duct bank; and
WHEREAS, on August 15, 2013, Amendment No. 4 was executed by the City in the
amount of $2,016, for the provision of additional architectural engineering services associated
with the design of the structural support of the ornamental sphere to be installed in the
landscape planter on the west side of the Tennis Center building; and
WHEREAS, on January 15, 2014, the City Commission adopted Resolution No. 2014-
28449, approving Amendment No.5 in the amount of $403,261, for additional architectural and
engineering services associated with the planning, bidding and construction phase services of
the remaining Park improvements, which consist of a community garden, baseball field
renovation, historic lodge renovation, new park entrance, enhanced pedestrian/bike paths, new
interactive water feature, teenage activity, lighting enhancement, signage, drainage,
landscaping and irrigation; and
WHEREAS, on April 23, 2015, Amendment No. 6 was executed by the City in the
amount of $14,732, for the provision of additional architectural and engineering services
associated with scope modifications to the Master Plan concept that include an outdoor fitness
cluster, the replacement of the community garden with a butterfly garden, the relocation of the
new restroom facility, and upgrades to all playing fields (sod, drainage and irrigation); and
WHEREAS, on July 14, 2015, Amendment No. 7 was executed by the City in the
amount of $15,090, for the provision of additional architectural and engineering services
associated with professional design services to renovate the existing soccer field, including
replacing existing sod with synthetic turf and site drainage in and around the field; and
WHEREAS, on December 14, 2016, the City Commission adopted Resolution No.
2016-29672, approving Amendment No. 8 in the amount of $231,269, for the provision of
additional architectural and engineering services that included updated phases for construction
completion, revised construction cost estimates; the design, bidding and construction
administration of the renovation of the Robert C. Hass Handball Court Building, the Joe Rubin
Handball Court Building and the eight (8) existing outdoor courts; and the renovation of the
softball field with new lighting, new benches and dug out, and a synthetic turf playing field with
associated site drainage; and
WHEREAS, Amendment No. 9 to the Agreement is for additional architectural and
engineering services associated with additional scope to the Master Plan concept which
include: 1) Revisions associated to the relocation of the existing IT Room currently located
inside the soon to be renovated Historic Lodge. Due to the importance the IT Room serves to
the Flamingo Park, in collaboration with Parks and Recreation, IT Department and the Design
Team, it was decided as best option to relocate the IT Room to a separate location outside the
Historic Lodge; 2) Phase I plan revisions due to Hurricane Irma tree damages; 3) Baseball
field guy wires relocation due to the unforeseen conflict with the renovation design of ADA
ramps; 4) Separation of the softball field plans from Phase I in order for the softball field to
become a "stand-alone" project; and 5) Preparation of a new specific purpose and topographic
survey for Flamingo Park in order to comply with Building Department's comments to provide
an updated survey, in the amount of$71,200; and
WHEREAS, the proposal from Consultant was reviewed and found to be fair and
reasonable and commensurate with industry standards; and
WHEREAS, this Amendment No. 9 to the Agreement will revise the total contract sum
to the not-to-exceed total amount of$1,262,718.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission approve and authorize the Mayor and City Clerk to execute Amendment No. 9 to
the Professional Architectural and Engineering (NE) Services Agreement between the City of
Miami Beach, Florida and Wolfberg/Alvarez and Partners, Inc., for additional architectural
professional services for the Flamingo Park Project; in the negotiated not-to-exceed amount of
$71,200; with previously appropriated funding.

RECOMMENDATION
The Administration recommends that the City Commission approve the resolution.
ANALYSIS
On September 5, 2007, pursuant to Request for Qualifications (RFQ) No. 15-06/07, the Mayor and
City Comrrission adopted Resolution No. 2007-26609 approving and authorizing the Mayor and City
Clerk to execute an Agreement with Wolfberg/Alvarez and Partners, Inc. (Consultant), for the
Flamingo Park Project. The scope included architectural, engineering, master planning, landscape
architecture and surveying, as necessary for the Project, including development of the Master Plan
Concept; and the design, bidding and award services, and construction administration of the Tennis
Center.
Amendments No.'s 1 through 4 included additional architectural and engineering services associated
with changes to the scope and the design of the Tennis Center Project in a total amount of$84,166.
On January 15, 2014, the City Commission adopted Resolution No. 2014-28449, approving the
Mayor and City Clerk to execute Amendment No. 5 for a total amount of$403,261. This Amendment
provided for the planning, design, bidding and construction phase services of the remaining Park
improvements.
On April 23, 2015, Amendment No. 6 was executed by the City, for a total amount of $14,732. This
amendment provided for scope modifications to the Master Plan concept that included an outdoor
fitness cluster, the replacement of the community garden with a butterfly garden, the relocation of the
new restroom facility and upgrades to all playing fields, inclusive of sod, drainage and irrigation.
On July 14, 2015, Amendment No. 7 was approved by the City, for a total amount of $15,090 for
additional design services associated with the renovation of the existing soccer field, including

replacing existing sod with synthetic turf and site drainage in and around the field.
On December 14, 2016, the City Commission adopted Resolution No. 2016-29672, approving
Amendment No. 8 in the amount of $231,269, for the provision of additional architectural and
engineering services that included updated phases for construction completion, revised construction
cost estimates; the design, bidding and construction administration of the renovation of the Robert C.
Hass Handball Court Building, the Joe Rubin Handball Court Building and the eight (8) existing
outdoor courts; and the renovation of the softball field with new lighting, new benches and dug out,
and a synthetic turf playing field with associated site drainage.
The City requested a proposal from Wolberg/Alvarez and Partners for the provision of professional
services associated with additional scope to the Master Plan concept as defined in Amendment No. 9
(Attachment A). The Consultant will be providing additional architectural and engineering services
which include: 1) Revisions associated to the relocation of the existing IT Room currently located
inside the soon to be renovated Historic Lodge. Due to the importance the IT Room serves to the
Flamingo Park, in collaboration with Parks and Recreation, IT Department and the Design Team, it
was decided as best option to relocate the IT Room to a separate location outside the Historic
Lodge. 2) Phase I plan revisions due to Hurricane Irma tree damages. 3) Baseball field guy wires
relocation due to the unforeseen conflict with the renovation design of ADA ramps. 4) Separation of
the softball field plans from Phase I in order for the softball field to become a "stand-alone" project. 5)
Preparation of a new specific purpose and topographic survey for Flamingo Park in order to comply
with Building Department's comments to provide an updated survey.
Wolfberg/Alvarez and Partners presented the City with a fee proposal for the additional professional
services. Staff negotiated and reached an agreement in the not-to-exceed amount of $71,200. The
negotiated fee is con.nensurate with the level of improvements contemplated in the scope of services
for this project.
This Amendment No. 9 will revise the total not-to-exceed contract sum to$1,262,718.
CONCLUSION
The Administration recommends that the City Commission approve the resolution.

consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No.9.
2. MODIFICATIONS
The Agreement is amended as defined in Schedule "A-9", attached herein.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 9.

SCOPE OF SERVICES
Schedule "A" entitled, "Scope of Services", is amended as follows:
Add the following under Task 5—ADDITIONAL SERVICES
Task 5.8 -Additional Design Services:
The scope of services included herein is as follows:
• Existing IT Room Relocation Revisions
Provide architectural and engineering services associated with the relocation of existing
IT Room from Historic Lodge to Shed east of basketball courts, which consists of
removal of existing louvers and door, installation of new hollow metal door, new ductless
mini split unit, new card reader access control, new 110V quad outlet, two (2) L630 twist
lock 220V and new exterior light fixture. Perform site visiUmeeting.
• Phase 1 Revisions
Provide architectural and engineering services associated with revisions to walkways
design as a result of tree loss due to Hurricane Irma, including relocation of light
poles/fixtures and new photometric study, removal of estate fencing west of Butterfly
Garden and Outdoor fitness Center along Michigan Avenue. Modify landscaping and
irrigation design. Attend meeting with City and staff to review field conditions resulting
from Hurricane Irma.
• Baseball Field Guy Wires Relocation
Provide architectural and engineering services associated with the relocation of two (2)
existing tension wires supporting the back-screen as required to accommodate ADA
ramps introduced to comply with FBC-ADA.
• Separate Package for Softball Field
Prepare construction documents and permitting services for softball field as a "stand-
alone" project.
• Survey
Prepare a new specific purpose and topographic survey for the Flamingo Park.
Please refer to the attached spreadsheet for breakdown of anticipated effort. WA proposes to
perform the above-noted services for a not-to-exceed fee of$71,200.
PAYMENT AND COMPENSATION
The total fee proposed for this Scope of Work is a not-to-exceed amount of $71,200 (refer to
Exhibit A-9 attached herein).

& Associates for $27,610.00 (See attached the proposal and a detailed scope of work to be
performed)
Please refer to the attached spreadsheet for breakdown of required effort. WA proposes to perform the
above-noted services for a stipulated fee of$71,200.00.

Prolect Description
The two tension wires,helping to laterally support the vertical poles for the foul ball baseball net,require relocation due to
a proposed new ramp,on both sides of the bleachers.
We have presented a concept for bringing the support wires all the way back,over the proposed stairs,and connect them

1. Standardof Care: BNI will endeavor to perform services In a manner consistent with the degree of care and skill ordinarily exercised by members of
our profession currently practicing In the same locality under similar conditions. No other representation,warranty or guarantee is made,Included or

of 1.5%per month and we reserve the right to stop work and withhold documents.
6. Contractor Means and Methods: BNI has no control over and shall not be responsible for construction means,methods,techniques,sequences,
procedures,or safety precautions and procedures,since these are solely the Contractor's responsibility. BM shall not have control over acts or
omissions of the Contractor,subcontractors,their agents or employees or other persons performing portions of the work.
7. Mediation: The Client and BNI agree that all disputes between them arising out of or relating to this Agreement or the Project shall be submitted to
formal mediation unless the parties mutually agree otherwise.Anything contained In any other contract document notwithstanding,BNI shall not be
bound by any provision requiring arbitration of disputes or controversies arising out of BNI's work.
8. Applicable Law: This Agreement shall be governed by the laws of the State of Florida.
9. Aydgns: Neither the Client nor BM may delegate,assign,sublet or transfer their duties or interest in this Agreement without the written consent of
the other party.
10. Third Parties; Nothing contained in this Agreement shall create a contractual relationship with or a cause of action In favor of a third party against
either the Client or BNI.
11. Severability; In the event any of the provisions of these General Provisions should be found to be unenforceable, it shall be stricken and the
remaining provisions shall be enforceable.
12. Termination of Servlre% This Agreement may be terminated upon 10 days written notice by either party should the other fail to perform its
obligations hereunder. In the event of termination,the Client shall pay BNI for all services rendered to the date of termination,all reimbursable
expenses,and reasonable termination expenses.

A) Prepare landscape and irrigation construction documents for stand-alone
project within limit of work shown in Exhibit'A'.
B) Assist WA by incorporating permitting agency's review comments and re-
issuing drawings as revisions for final sign-offs by the agencies and
departments having jurisdiction. It is understood that the Client shall be
solely handling the effort associated with the permitting process through
the required permitting agencies.
C) Respond to bidder inquires.
D) Review shop drawing submittals.
E) Respond to RFI's submitted by contractor.
F) Perform a maximum of(3)site observations during construction to review
the progress of the landscape and irrigation installation.
Our Lump Sum fee for the basic professional services will be a total of Six Thousand

Dear Mr. Fortuno:
Pursuant to your request regarding a fee estimate for surveying and mapping services for the above referenced project,
the following amended proposal for same is hereby submitted for your consideration:
Scope of Services:
Specific Purpose and Topographic Survey of approximate 31.47 acres including ROW
• Extend up to the near edge of paved road on Meridian Ave.
• Extend up to the near edge of the paved road(valley gutter)of Michigan Ave.
• Include 100 linear feet of sidewalk on the north side of 11th Street at Jefferson Ave.
• The survey shall include the same level of information as the attached drawing received from client 1/16/18
including the frequency of the grade elevations shown at 20' intervals. In areas where the attached drawing
does not show the elevations at 20' intervals, the elevations shall be at no less than 40' intervals. The survey
shall also include the following:
• Locate structures, fences, paved areas, curbs, water meters, backflow preventers, and all other significant
aboveground features.
• Location of poles and overhead power lines.
• Location of manholes and catch basins including rim/grate, bottom elevations, and size, material and invert
elevations for all pipes.
• Indicate graphically on the drawing pipe direction from catch basins and manholes.
• Locate existing trees indicating common names,canopy,trunk&height If trees are not identifiable by our
surveying crew,owner is responsible for consulting with a botanist or a tree expert for species identification.
• Elevations at edge of pavement, top of curb, back of sidewalk at 40'intervals(except as noted otherwise)and
any additional low and high point elevations that may exist between the intervals and at transitions such as
driveways, ramps, etc. The elevations at the adjacent rights-of way shall start at the edge of pavement(lip of
gutter).
• Finished floor elevations of buildings.
• Topographic survey drawing at 1"=20'scale.Survey shall contain all the information gathered in the field.
• JBA will submit ten (10)signed and sealed copies of the survey plans along with one PDF and one AutoCAD
file on electronic media.
Time of Completion:
JBA estimates 20-25 working days'weather permitting and after NTP This proposal assumes site access is available and
work can be performed between the hours of 8:00 AM and 5:00 PM Monday through Friday.
Qualifications:
1. Rule of Law:All field and office efforts in connection with this project will be performed in strict accordance with
the applicable provisions of the"Standards of Practice for Land Surveying in the State of Florida", pursuant to
Rule 5J-17 Florida Administrative Code.
2. Requests for service not specifically enumerated in this Letter of Proposal will be addressed via separate
response if so required.
3. All survey work to be done in U.S.feet.

Payment Terms
JBA will invoice upon completion of job. Payment is due not later than 5 days after consultant receives payment from the
City of Miami Beach. Payment is not contingent on payment from a third party unless other written agreements or
guarantees are agreed to by both parties and attached hereto. No waiver shall be construed as a modification or
amendment to these payment terms unless expressly stated in writing by J. Benfill 8 Associates, Inc. Should at any time
during the project the Client find it necessary to discontinue the services described above. or if the parties mutually
decide to terminate this contract, the Client will compensate J. Bonfill and Associates, Inc. on an hourly basis for the
percentage of work completed plus reimbursable expenses. Lump Sum Fees are fixed for a period of three months from
the date of this proposal. If the work has not been initiated within this three-month period,J. Bonfill and Associates, Inc.
reserves the right to terminate or renegotiate this proposal. In the event either party is forced to seek legal advice or
representation to enforce any of the provisions of this agreement,then the prevailing party shall be entitled to an award
of reasonable attorneys fees and costs, including fees and costs for court ordered mediation and/or fees and costs on
appeal in Miami Dade County, Florida.
By acceptance of this proposal,the signing person represents and warrants to The Surveyor,that it is authorized to enter
and accept the proposal on behalf of and binds Wolfberg Alvarez and Partners.
If acceptable, a space is provided for an authorized signature.We will consider the return of the signed original letter as
