Resolution 10127 RESOLUTION NO. 10127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AS TO THE NUMBER OF FREEHOLDERS LEGALLY QUALIFIED TO PARTICIPATE IN THE SPECIAL ELECTION HELD JUNE 2, 1959; AND CANVASS- ING THE RETURNS OF THE SPECIAL ELECTION AND DECLARING THE RESULT TO BE FOR THE ISSUANCE OF BONDS IN THE TOTAL SUM OF $5,942 ,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS, the City Clerk and Supervisor of Registration in the City of Miami Beach, Florida, has certified that the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in the Special Election held in said City on June 2 , 1959 , was 6965, and WHEREAS, this City Council has made a canvass of the returns of the certificates of the Clerks and Inspectors who held and conducted said Special Election held on June 2, 1959, such canvass having been made solely, exclusively and entirely from such returns, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that we do hereby find and declare that the total number of freeholders who were qualified electors residing in said City and legally qualified to participate in the Special Election held in said City on June 2, 1959 , was 6965 and that a majority thereof participated in said election, and BE IT FURTHER RESOLVED that we do hereby find and declare that the total number of votes cast in said election in favor of the approval of the bonds and the total number of votes cast in said election against the approval of the bonds were as follows : UPON QUESTION NO. 1 : `Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $75,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing storm sewers?" 4092 votes were cast, of which 3351 votes were "For Bonds" and 741 votes were "Against Bonds" . UPON QUESTION NO. 2: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $160,000.00 with interest at a rate to be hereafter determined, not exceeding 47 per annum, for the purpose of making improvements to the existing sanitary sewer system?" 4025 votes were cast, of which 3281 votes were "For Bonds" and 744 votes were "Against Bonds" . - 1 - UPON QUESTION NO. 3 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $150,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of lengthening the existing fishing pier at Biscayne Street in the Atlantic Ocean?" 3844 votes were cast, of which 1721 votes were "For Bonds" and 2123 votes were "Against Bonds" . UPON QUESTION NO. 4: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $200,000.00 with interest at a rate to be hereafter determined, not exceeding 47 per annum, for the purpose of constructing a pier at Lincoln Road in the Atlantic Ocean?" 3880 votes were cast, of which 1789 votes were "For Bonds" and 2091 votes were "Against Bonds" . UPON QUESTION NO. 5: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $100,000.00 with interest at a rate to be Hereafter determined, not exceeding 47 per annum, for the purpose of procuring a ladder truck and enlarging the 69th Street Fire Station?" 3876 votes were cast, of which 2801 votes were "For Bonds" and 1075 votes were "Against Bonds" . UPON QUESTION NO. 6: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $600,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a new building to house the Miami Beach Public Library?" 3897 votes were cast, of which 2435 votes were "For Bonds" and 1462 votes were "Against Bonds" . TJPON QUESTION NO. 7 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $1,100,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of paving that portion of Alton Road extending from Biscayne Water- way to 63rd Street and constructing a four lane bridge across Surprise Waterway at Alton Road?" 3874 votes were cast, of which 2688 votes were "For Bonds" and 1186 votes were "Against Bonds" . UPON QUESTION NO. 8: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $345 ,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or a part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assess- - 2 I ments made against abutting property, as authorized by law, for the purpose of paving (including sidewalks) the following highways: 73rd Street from Collins Avenue to Dickens Avenue; 76th Street from Collins Avenue to Dickens Avenue; 78th Street from Collins Avenue to Dickens Avenue; 79th Street from Collins Avenue to Dickens Avenue; 81st Street from Collins Avenue to Byron Avenue; 82nd Street from Collins Avenue to Harding Avenue; 82nd Street from Abbott Avenue to Byron Avenue; 82nd Terrace from Abbott Avenue to Byron Avenue; 83rd Street from Collins Avenue to Abbott Avenue; 84th Street from Collins Avenue to Byron Avenue; 87th Street from Collins Avenue to Harding Avenue; 87th Terrace from Collins Avenue to Harding Avenue; Abbott Avenue from 75th Street to 83rd Street; 84th Street from Hawthorne Avenue to Crespi Boulevard?" 3677 votes were cast, of which 2109 votes were "For Bonds" and 1568 votes were "Against Bonds" . UPON QUESTION NO. 9 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $77 ,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or a part of whicha special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assess- ments made against abutting property, as authorized by law, for the purpose of paving Stillwater Drive and North Stillwater Drive from Hawthorne Avenue to their westerly ends and for the purpose of constructing sidewalks on the north side of North Stillwater Drive and Stillwater Drive from the east line of Lot 62, Block 15, to the south line of Lot 1, Block 15, and the south side of Stillwater Drive from the south line of Lot 1, Block 16, to the north line of Lot 58, Block 16, all in Biscayne Beach Second Addition?" 3608 votes were cast, of which 1853 votes were "For Bonds" and 1755 votes were "Against Bonds". UPON QUESTION NO. 10: "Shall the City of Miami. Beach, Florida, issue negotiable coupon bonds in the amount of $185,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or a part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assess- ments made against abutting property, as authorized by law, for the purpose of paving the following highways : Crespi Boulevard from Hawthorne Avenue to 86th Street; 80th Street from Hawthorne Avenue to Crespi - 3 - Boulevard; 81st Street from Hawthorne Avenue to Crespi Boulevard; 82nd Street from Hawthorne Avenue to Crespi Boulevard; 83rd Street from Hawthorne Avenue to Crespi Boulevard; 86th Street from Hawthorne Avenue to Crespi Boulevard?" 3576 votes were cast, of which 1900 votes were "For Bonds" and 1676 votes were "Against Bonds". UPON QUESTION NO. 11: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $2,060,000.00 with interest at a rate to be hereafter determined, not exceeding 47 per annum, for the purpose of constructing a new water supply main from Miami to Miami Beach, including pumping stations, and the relocation of a portion of the MacArthur Causeway Supply Main and extensions to the water distribution system?" 3815 votes were cast, of which 2941 votes were "For Bonds" and 874 votes were "Against Bonds" . UPON QUESTION NO. 12 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $525,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a public park on the ocean front extending from Collins Avenue to the Atlantic Ocean and located between 75th and 87th Streets?" 3795 votes were cast, of which 2398 votes were "For Bonds" and 1397 votes were "Against Bonds" . UPON QUESTION NO. 13: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $165,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a community center and teen-age activities building in that part of the City lying north of 63rd Street?" 3783 votes were cast, of which 2479 votes were "For Bonds" and 1304 votes were "Against Bonds" . UPON QUESTION NO. 14: "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $400,000.00 with interest at a rate to be hereafter determined, not exceeding 47 per annum, for the purpose of constructing a bridge across Collins Canal and Dade Boulevard at Michigan Avenue?" 3736 votes were cast, of which 2188 votes were "For Bonds" and 1548 votes were "Against Bonds" . UPON QUESTION NO. 15 : "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $150,000.00 with interest at a rate to be hereafter determined, not exceeding 47 per annum, for the purpose of constructing a Garden Center?" 3855 votes were cast, of which 2369 votes were "For Bonds" and 1486 votes were "Against BondsC' . - 4 - and WHEREAS, a majority of the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in said Special Election, did vote therein, and WHEREAS, a majority of the votes cast on Questions Numbers 1, 2, 5 , 6, 7 , 8, 9 , 10, 11, 12, 13, 14 and 15 were in favor of the approval of the bonds, and WHEREAS, a majority of the votes cast on Questions Numbers 3 and 4 were against the approval of the bonds; NOW, THEREFORE, BE IT RESOLVED that we do hereby declare that the issuance of bonds in the aggregate sum of $5,942,000.00, as set forth and provided for in Questions Numbers 1, 2, 5, 6, 7 , 8, 9 , 10, 11, 12, 13, 14 and 15, as described in this resolution, has been duly and legally approved by the voters , as provided by law. BE IT FURTHER RESOLVED that the issuance of bonds in the sum of $350,000.00, as set forth and provided for in Questions Numbers 3 and 4, as described in this resolution, has not been approved by the voters .
