Resolution 10137 RESOLUTION NO, 10137
WHEREAS J & M Vending Company, Inc., a Florida corporation,
is the concessionaire holding those certain rights and privileges
known as "The Automatic Coin-Operated Cold Soft Drink Dispensing
Machines Concession at Certain Municipal Bathing Beaches and
Recreational Facilities" in the City of Miami Beach by virtue of
an agreement dated May 7, 1958, and
WHEREAS the said J & M Vending Company, Inc„ desires to
assign its said rights and privileges to Wholesale Vending Corpora-
tion, a Florida corporation, and in accordance with the provisions
of the said agreement dated May 7, 1958, has applied to the City
Council for consent to the said assignment, and
WHEREAS the said Wholesale Vending Corporation desires to
replace the current automatic coin-operated cold soft drink dispens-
ing machines with the newest model machines, and
WHEREAS thesaid Wholesale Vending Corporation has shown to
the City Council that a minimum of two years is necessary to
amortize the said newest model automatic coin-operated cold soft
drink dispensing machines, and
WHEREAS, by its provisions the aforesaid agreement terminates
on May 31, 1960 , and
WHEREAS it is deemed to be in the best interests of the City
to consent to the said assignment of agreement from J & M Vending
Co., Inc. to Wholesale Vending Corporation, and to extend the
period of the said agreement for one year to terminate on May 31,
1961, with the concessionaire paying to the City an amount equal
to 20% of the gross revenue taken from the latest model automatic
coin-operated cold soft drink dispensing machines,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the City Council consents to the
assignment of the said automatic coin-operated cold soft drink
dispensing machine concession at certain municipal bathing beaches
and recreational facilities in the City of Miami Beach from J & M
Vending Co. Inc. to Wholesale Vending Corporation,
BE IT FURTHER RESOLVED that the Mayor and the City Clerk be
and they are hereby authorized to execute in the name of and in
behalf of the City of Miami Beach the agreement to be prepared by
the City Attorney extending the said automatic coin-operated cold
soft drink dispensing machine concession at certain municipal
bathing beaches and recreational facilities in the City of Miami
Beach, until May 31, 1961, and setting forth the matters and
things herein expressed.
