Resolution 10218 RESOLUTION NO. 10218
WHEREAS the City Council of the City of Miami Beach deems
it to be necessary to increase the width of that portion of West
Avenue lying northward of its intersection with Sixth Street, and
WHEREAS, in order to increase the width of West Avenue, as
aforesaid, it will be necessary to acquire the fee simple title
to the following described parcel of land on the easterly side of
West Avenue, to wit:
A portion of Lot One (1) , Block Two (2) , FLEETWOOD
SUBDIVISION, bounded as follows:
BEGINNING at a point on the northerly line of
Sixth (6th) Street, said point being thirty-eight
and eighty-seven hundredths (38.87) feet easterly
of the intersection of the said northerly line of
Sixth (6th) Street produced westerly with the
easterly line of West Avenue produced southerly,
said distance being measured along the said northerly
line of Sixth (6th) Street;
From said Point of Beginning run northwesterly
nineteen and two tenth (19.2) feet along the arc of
a circular curve of fifteen (15) feet radius tangent
to the said northerly line of Sixth (6th) Street to
a point, said arc having a central angle of seventy-
three degrees, thirty-six minutes and thirty-nine
seconds (73°-36'-39' ) ;
Thence run northwesterly along a straight line
tangent to said curve a distance of fifty-one and
thirty-two hundredths (51.32) feet to a point on the
northerly line of Lot One (1) , Block Two (2) ,
FLEETWOOD SUBDIVISION, said point being ten (10) feet
easterly of the easterly line of West Avenue measured
along the said northerly line of said Lot One (1) ;
Thence run westerly along the said northerly line of
Lot One (1) a distance of ten (10) feet to a point on
the said easterly line of West Avenue;
Thence run southerly along the said easterly line of
West Avenue a distance of forty-five (45) feet to the
Point of Curvature of the circular curve of a fifteen
(15) foot radius forming the southwesterly corner of
said Lot One (1) ;
Thence deflecting to the left run southeasterly along
the arc of said circular curve forming the southwesterly
corner of Lot One (1) to the point of tangency of
said curve on the said northerly line of Sixth (6th)
Street;

Thence run easterly twenty-three and eighty-seven
hundredths (23 .87) feet along the said northerly
line of Sixth (6th) Street to the Point of Beginning,
containing 0.025 acres more or less.
As said Lot, Block, Street, Avenue and Subdivision
are shown on the Amended Plat of FLEETWOOD SUBDIVISION,
recorded in Plat Book 28, at page 34 of the Public
Records of Dade County, Florida.
and
WHEREAS the TRUSTEES OF MIAMI BEACH LODGE OF ELKS NUMBER 1601
have indicated their willingness to convey to the said City the
fee simple title to the said parcel of land for the sum of Forty-
four Hundred Dollars ($4, 400.00) cash; and
WHEREAS the City Attorney has prepared an agreement setting
forth the terms and conditions upon which said Owners will convey
the fee simple title to the said parcel of land, and
WHEREAS the City Council deems it to be to the best interest
of the City to acquire said land on the terms and in the manner
set forth in the agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH that the Mayor and the City Clerk be and they
are hereby authorized and directed to execute said agreement in
the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the City Manager and the City
Clerk be and they are hereby authorized and directed to carry out
the terms of said agreement for and in behalf of said City and the
disbursing officers of the City be and they are hereby authorized
and directed to pay out such sums of money as the City is obligated
to pay out under the terms of said agreement, from the funds of
said City available for such purposes.
