A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AMENDMENT NO. 3 TO THE
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH, FLORIDA AND SAVINO & MILLER DESIGN STUDIO, P.A., FOR
ADDITIONAL DESIGN SERVICES TO INCORPORATE ADDITIONAL
RESILIENT AND SUSTAINABLE ELEMENTS, INCLUDING A STORMWATER
MITIGATION STUDY, CONVERSION TO SOLAR POWER, AND
IMPLEMENTATION OF PERMEABLE PAVING, INTO THE DESIGN FOR THE
FUTURE COMMUNITY PARK (FORMER PAR 3) PROJECT, IN AN AMOUNT
NOT-TO-EXCEED $126,781; WITH PREVIOUSLY APPROPRIATED FUNDING.
WHEREAS, on December 9, 2015, the Mayor and City Commission adopted Resolution
No. 2015-29234, authorizing the negotiation and execution of a Professional Services
Agreement with the firm of Savino & Miller Design Studio, P.A., ("Consultant"), to provide
professional services for the planning, design, bid, award and construction administration of the
Future Community Park (former Par 3) Project (the "Project"); and
WHEREAS, On May 19, 2016, a professional services agreement was executed in the
amount of$933,465.; and
WHEREAS, on September 5, 2017, the conceptual drawings and renderings for the
project were presented at the Design Review Board ("DRB") hearing, and the DRB
recommended the approval of the project with certain conditions and approved a Certificate of
Appropriateness; and
WHEREAS, on January 26, 2018, the City approved Amendment No.1, in the amount of
$32,295, for design services, to incorporate the reduction and reconfiguration of the lake;
removal of the parking lot from the west side of the property; increase the parking along
Pinetree Drive; and reconfigure the walkway and jogging path; and
WHEREAS, on March 7, 2018, the Mayor and City Commission adopted Resolution No.
2018-30222, accepting the recommendation of the Finance and Citywide Projects Committee
("FCWPC"), to continue with the current design of the park; and
WHEREAS, on May 16, 2018 the Mayor and City Commission adopted Resolution
2018-30291 approving Amendment No. 2, in the amount of $35,698, for additional
Architectural and Engineering Design Services associated with the site changes due to
Hurricane Irma debris removal operation; and
WHEREAS, the current park design has implemented sustainable and resiliency
approaches such as:
• Environmental Reports show that due to its previous use as a golf course, the site is
contaminated. Environmental remediation will be the first element to be addressed.
• Water filtering littoral zones surrounding the lake to improve water quality.
• Native plantings and beneficial lawns, reducing pesticide and fertilizer use, reducing
water quality impacts and increasing wildlife habitat.
• Balanced cut and fill, capping contaminated soils discovered during the environmental
site assessment.
• Low voltage LED lighting, permeable parking lot paving and local, recycled materials
where possible.
• The passive park will preserve landmark specimen trees and pastoral spaces; and
WHEREAS, in addition to the above measures, the following resilient and sustainable
strategies are being proposed to be implemented in the design of the park as part of this
Amendment No. 3:
• Study and model the capacity of the Park to store / slow / treat / re-use site and assist
with handling the stormwater run-off from the neighborhood via gravity flow and/or
pumping and piping, and impacts of the discharge into Collins Creek, Indian Creek and
Biscayne Bay.
• Possible implementation of alternatives for onsite water storage and re-use for irrigation
and the water feature, etc.
• Conversion to solar power including roof mounted solar panels for the tennis pavilion,
solar panels for pedestrian lighting, energy efficient lighting, etc.
• Use of recycled / renewable materials, water efficient bathroom fixtures, electric vehicle
charging stations and other sustainable elements.
• Implementation of permeable paving; and
WHEREAS, the consultant has prepared a cost proposal for implementing the above
strategies, in the amount of$126,781; and
WHEREAS, the Administration has reviewed the proposal and has found it to be fair and
reasonable and ; and
WHEREAS, the total contract amount, including this Amendment No.3, will be a not-to-
exceed total of$1,128,239.
WHEREAS, the funding for implementation of the above resiliency and sustainability
strategies have been included as part of the Par 3/Community Park request in the proposed FY
18/19 General Obligation Bond referendum.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission approve and authorize the Mayor and City Clerk to execute Amendment No. 3 to
the Professional Services Agreement between the City of Miami Beach, Florida and Savino &
Miller Design Studio, P.A., for additional design services to incorporate additional resilient and
sustainable elements into the design, including a stormwater mitigation study, conversion to
solar power, and implementation of permeable paving, for the Future Community Park (former
Par 3) project, in an amount not-to-exceed $126,781; with previously appropriated funding.

RECOMMENDATION
The Administration recommends adopting the Resolution.
ANAI YSIS
On December 9,2015,the Mayor and City Commission adopted Resolution No.2015-29234,authorizing administration to enter
into negotiations and further authorizing the Mayor and City Clerk to execute a Professional Services Agreement with the firm of
Savino & Miller Design Studio, P.A., (Consultant), to provide professional services for the planning, design, bid, award and
construction administration of the Future Community Park(former Par 3)(the Project).
On May 19,2016,a professional services agreement was executed in the amount of$933,465.
On September 5, 2017 the conceptual drawings and renderings for the project were presented at the Design Review Board
(ORB) hearing. The DRB recommended the approval of the project with certain conditions and approved a Certificate of
Appropriateness.
On January 26, 2018 the City approved Amendment No.1, in the amount of$32,295, for design services, to incorporate the
reduction and reconfiguration of the lake; removal of the parking lot from the west side of the property and increase the parking
along Pinetree Drive;and reconfigure the walkway and jogging path.
On February 23, 2018 the Finance and Citywide Projects Committee (FCWPC)approved the conceptual design and directed
staff to continue with the development and permitting of the project. The committee requested staff to prepare a list of project
elements that could be implemented within the current available budget and to explore Brownfield grants for the remediation
efforts.
On March 7, 2018, the Mayor and City Commission adopted Resolution 2018-30222, accepting the recommendation of the
FCWPC,to continue with the current design of the park.
On May 16,2018 the Mayor and City Commission adopted Resolution 2018-30291 approving Amendment No.2, in the amount
of$35,698,for additional Architectural and Engineering Design Services associated with the site changes due to Hurricane Irma
debris removal operation.
The Mid-Beach Community Park(fka Par 3)was previously a golf course and is being developed as a passive community park.
The design is 60%complete and has been presented to the community, Park Advisory Board and has received approval from
the Design Review Board (DRB).The design and permitting is anticipated to be completed by December of 2018.The
proposed scope include a central lake; open meadows and informal open play field areas; landforms; pavilion;tennis courts(6)
with restroom facilities; children's playground; dog park; boardwalk and pathways; security lighting; vita course and fitness
cluster; butterfly garden; linear water feature and parking lot. The passive park will preserve landmark specimen trees and
pastoral spaces.
The current nark design has inolemented sustainable and resiliency aooroaches such as:
•Environmental Reports show that due to its previous use as a golf course,the site is contaminated. Environmental remediation
will be the first element to be addressed.
•Water filtering littoral zones surrounding the lake to improve water quality.
• Native plantings and beneficial lawns, reducing pesticide and fertilizer use, reducing water quality impacts and increasing
wildlife habitat.
•Balanced cut and fill,capping contaminated soils discovered during the environmental site assessment.
•Low voltage LED lighting,permeable parking lot paving and local,recycled materials where possible.
•The passive park will preserve landmark specimen trees and pastoral spaces.
In addition to the above Treasures,the following resilient and sustainable strategies are being proposed to be implemented in the
design of the park as part of this Amendment No.3:
•Study and model the capacity of the Park to store/slow/treat/re-use site and assist with handling the storrnwater run off from
the neighborhood via gravity flow and/or pupping and piping,and impacts of the discharge into Collins Creek, Indian Creek and
Biscayne Bay.
•Possible implementation of alternatives for onsite water storage and re-use for irrigation and the water feature,etc.
• Conversion to solar power including roof mounted solar panels for the tennis pavilion, solar panels for pedestrian lighting,
energy efficient lighting,etc.
•Use of recycled/renewable materials,water efficient bathroom fixtures,electric vehicle charging stations and other sustainable
elements.
•Implementation of permeable paving.
The consultant has prepared a cost proposal(Attachment A)for implementing the above strategies, in the amount of$126,781.
The Administration has reviewed the proposal and has found it to be fair and reasonable. The total contract amount, including
this Amendment No.3,will be a not-to-exceed total of$1,128,239.
The funding for implementation of the above resiliency and sustainability strategies have been included as part of the Par
3/Community Park request in the proposed FY 18/19 General Obligation Bond referendum.
CONCLUSION
The Administration recommends adopting the Resolution.

This Amendment No. 3 to the Agreement, made and entered this_day of 2018,

The above recitals are true and correct and are incorporated as a part of this Amendment
No. 3.
2. MODIFICATIONS
a. The Agreement is amended to include and incorporate the additional Services, as
set forth in Attachment A, attached hereto.
b. In consideration for the performance of the additional Services, as set forth in
Attachment A, City shall pay the Consultant the total not-to-exceed amount of
$126,718.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 3.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 3 to be executed
in their names by their duly authorized officials as of the date first set forth above.

Subject: Change Order Proposal for Environmental Consulting Services
Future Community Park (Former Par 3)

Dear Mr. Miller:
EE&G Environmental Services, LLC (EE&G) has prepared the following proposal to provide
technical support and environmental consulting services associated with the community park
redevelopment plan for the former par 3 golf course. Specifically this proposed Change Order
will deal with the new directive issued by the City of Miami Beach Capital Improvement Projects
(CIP) to re-evaluate options to incorporate resiliency into the park design. This will involve the
infux and storage of storm water from the surrounding neighborhood, which will have an impact
on the environmental conditions at the property.
The objective of the additional groundwater sampling around monitoring well MW-4
(northwestern portion of property) is to attempt the delineation and limitation of the extent of
arsenic-affected groundwater, which could open up more area on the property for the storage of
storm water.
1.0 PROPOSED SCOPE OF SERVICES
Task 1 —Peer Review, Meetings &Consultation
• EE&G's Professional Geologist (Craig Clevenger) and Project Professional (Thuysi Ho)
will participate in meetings, conduct research, evaluate testing data, provide
consultation, and prepare summaries/memos/reports on as ad-needed basis.
• EE&G will install three temporary monitoring wells around MW-4 on the northwestern
portion of the property. Wells will consist of 1.5-inch PVC casings, with 10-feet of pre-
packed, slotted well screen, set at an interval designed to intersect the groundwater
table interface.
• EE&G will collect groundwater samples from MW-4 and the three new wells. Sampling
will be conducted in accordance with FDEP's SOPs, as specified in Chapter 62-160,
FAC. Samples will be transported to a NELAC-certified laboratory for analysis of Total
Arsenic using EPA Method 6010.
EE&G's anticipated budget to complete the proposed scope of services is $15,500.00, which is
itemized on the attached Fee Estimate spreadsheet. Client will be invoiced on a time and
materials basis in accordance with the unit rates summarized in the attached spreadsheet.

PROFESSIONAL SERVICES AGREEMENT BETWEEN

AND
EE&G ENVIRONMENTAL SERVICES, LLC
This Agreement is made on August 30, 2018, by Savino Miller Design Studio, P.A. (Client")and
EE&G Environmental Services, LLC ("EE&G").
WITNESSETH
That for the considerations set forth below, the parties hereto do agree as follows:
1. Description of Services:
EE&G's Environmental Consulting Proposal No. 2016-3106, dated August 30, 2018,
attached and incorporated in it's entirety by reference.
2. Period of Performance:
90 Days
3. Basis of Compensation:
$15,500.00; Time and Materials— Not to Exceed without prior authorization from Client
4. Method of Invoicing:
Invoices will be generated monthly for services rendered to date. Payment-in-full is due
upon receipt of invoice.
5. Professional Retainer:
Waived
6. General Conditions:
a. Payments for invoices prepared by EE&G are due and payable upon delivery. EE&G
reserves the right to apply a 1.5% monthly finance charge on all balances over 30
days outstanding.
b. This Agreement may be terminated by either party hereto upon 15 days notice in
writing to the other party. Upon termination, EE&G shall prepare and submit a final
invoice for services rendered to the date of termination together with any termination
expenses incurred.

c. The parties hereto shall maintain in full force and effect comprehensive public liability
insurance with coverage limits which are reasonable in light of the work to be
undertaken, and workmen's compensation insurance as required by law.
d. Any drawings and specifications developed pursuant to this Agreement are
instruments of service, and as such the original documents, tracings, and field notes
are and remain the property of EE&G regardless of whether the work for which they
were prepared is executed.
e. In the event that legal action is instituted to enforce any of the terms of this
Agreement, the party, which does not prevail, shall pay the legal expenses of the
prevailing party, including attorneys fees.
f. The parties hereto each binds itself, its successors, executors, administrators and
assigns to the other party to this Agreement and to the successors, executors,
administrators and assigns of such other party in respect of all covenants of this
Agreement.
g. EE&G's liability for services to be rendered under this Agreement shall be limited to
$1,000,000, unless Client pays for the assumption of additional liability by EE&G as a
separate line item in Article 3, Basis of Compensation.
h. If applicable, Client agrees that EE&G shall not be responsible for liability caused by
the presence or release of hazardous substances or petroleum products at the site.
The Client will either make others responsible for liabilities due to such conditions, or
will indemnify and save harmless EE&G from such liability. The provisions of this
Article (6,h) shall survive any termination of this Agreement.
IN WITNESS WHEREOF,the parties hereto have caused the Agreement to be executed by their
duly authorized officers on the date first written above.

Functionality into current Community Park Design
Dear Barry,
Based on the time required to study, recommend,and design resiliency functionality and sustainable
elements that can be incorporated into the current design of the multi-use pavilion we request the
following additional services.
DESCRIPTION OF ITEMS REQUIRING ADDITIONAL SERVICES:
1. Review opportunities and make recommendations as to how the building can be designed to
derive power needs from solar panels.
2. Review opportunities and make recommendations as to the use of water efficient plumbing
fixtures in the restrooms such as:
a. WaterSense labeled and/or ultra-low-flow toilets
b. WaterSense labeled and/or ultra-low-flow bathroom sink faucets and accessories
a Motion sensor faucets
d. Gray water(from sinks)to supply water for toilets and to irrigate landscaping
3. Review opportunities and make recommendations as follows:
a. Use only low and no-VOC products for all painting
b. Specify energy-efficient vent fans(ENERGY STAR)
c. Specify white or light colors for the roof
d. Specify lighting fixtures that are energy efficient and use LED technology.
e. Specify lighting efficiency controls.

Designer— 16 hrs x$83/hr=$1,328
