Resolution 10322 RESOLUTION NO. 10322
WHEREAS the National American Legion Convention
will officially convene in Miami Beach, Florida, on
October 15, 1960, and continue through October 20, 1960;
and
WHEREAS it is anticipated that this will be the
largest convention ever held in Miami Beach, and that over
60,000 persons from all states and territories of the United
States and many foreign nations will attend such convention
before and during said dates, and become better acquainted
with the State of Florida and Dade County, Florida, and
spend several million dollars with the citizens of the State
of Florida and Dade County, Florida; and
WHEREAS high officials and dignitaries of the
United States of America, foreign nations, and the states
of the Union are expected to attend such convention; and
WHEREAS the American Legion 1960 Convention
Corporation of Florida, a non-profit corporation of Florida,
was incorporated for the sole purpose of initiating,
sponsoring and handling said convention in its multiple
phases, and has enlisted the aid and support of all American
Legion Posts in the State of Florida, and of several hundred
citizens of this and other cities in Florida to aid it in
this great venture; and
WHEREAS it is the desire, purpose and intent of
this Council to aid, foster, cooperate with, and support
The American Legion 1960 Convention Corporation of Florida,
and the great convention which it is fostering, in every
way it can legally do so, and to direct and authorize its
employees and officers to act likewise; and
WHEREAS this Council hereby finds that the activities
and large influx of persons into the community during the
period from and including October 15, 1960 to October 20, 1960
constitute an emergency and may endanger the health, safety,
peace, property and public welfare and interest of this
community unless extraordinary powers are exercised, including
the delegation thereof during such period; and
WHEREAS, therefore, certain extraordinary authorizations,
permissions and licenses are hereby found to be necessary
and desirable, and in the public interest;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA:

A. That the Mayor of the City of Miami Beach,-
and the Council of the City of Miami Beach, hereby declare
October 17, 1960, the date on which the American Legion
Convention Parade will be held in the City of Miami Beach,
a partial holiday, and that all officers and employees of
the City Government, except those engaged in essential
service, be excused from service with full pay on that date,
at the hour of 2:00 o 'clock P.M.
B. That Morris N. Lipp, City Manager, and
Michael Fox, Chief of Police of the City of Miami Beach,
be and they are hereby authorized and directed to issue a
permit to The?'American Legion 1960 Convention Corporation
of Florida to conduct a parade on October 17, 1960 in the
City of Miami Beach; ; and that said City Manager and said
Chief of Police be and they are hereby authorized to issue
a permit to The American Legion 1960 Convention Corporation
of Florida to parade on such streets as may be subsequently
deemed desirable by said corporation, provided the same is
first approved by the City Manager and the Chief of Police.
C. That the exclusive permission be and it is
hereby granted to The American Legion 1960 Convention
Corporation of Florida to sell concessions and permits for
the period from and including October 15, 1960 to October 20,
1960 :
(1) Upon and on and in the sidewalks, streets,
highways and public places in the City of Miami Beach;
(2) For the purpose of selling the following
described articles:
in paper cups
Non-alcoholic beverageV, food, including
sandwiches, ice-cream, candy and gum, canes, banners and
other decorations, caps, hats, novelty badges and other
novelties, such as are commonly sold during National Conventions
of The American Legion and items bearing the registered
insignia of The American Legion;
(3) Provided, however, notwithstanding the
foregoing:
(a) That such sales of food and drinks
shall not be conducted without the prior approval of the
Dade County Public Health Unit and otherwise in accordance
with existing laws .
(b) No concession shall be sold, or
any permit granted permitting and licensing the sale of
any aforesaid item or items within 100 feet of any regularly
licensed business or merchant when the same is in competition
or in the same line of business with said regularly licensed
merchant or business. It is the sense of this Council, and
therefore established as a policy during the dates hereinbefore
designated, that permanent businesses already established
within the restricted area shall not be required to purchase
any concessions as provided for in this resolution.

(c) No such concession shall be sold
and no such permit shall be granted in violation of or
which would operate to abridge or divest the rights under
any existing contracts or concessions now effective between
the City and any person, firm or corporation who holds a
concession, contract or agreement with the City of Miami
Beach in any public park and any City Auditorium.
D. All heads of departments having jurisdiction
be and they are hereby authorized and directed to issue,
without fee, to The American Legion 1960 Convention Corporation
of Florida, any permits or licenses that may be reasonably
necessary to carry out the provisions of this resolution.
PASSED AND ADOPTED this 6th day of April, 1960 .
