A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE A TERMINATION AND
ABANDONMENT OF A UTILITY EASEMENT ON THE PROPERTY
LEGALLY DESCRIBED AS LOTS 4 AND 61, BLOCK 7 OF THE AMENDED
PLAT OF SECOND OCEAN FRONT SUBDIVISION, AS RECORDED IN
PLAT BOOK 28, PAGE 28 OF THE PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA, IN FAVOR OF CASABLANCA VILLAS LLC, AND
FURTHER ACCEPTING A NEW GRANT OF EASEMENT FROM
CASABLANCA VILLAS LLC, AS THE OWNER OF THE AFORESTATED
PROPERTY, ON LOT 4 OF THE AFORESTATED BLOCK AND
SUBDIVISION; SAID TERMINATION AND GRANT OF EASEMENT,
RESPECTIVELY, SUBJECT TO THE CONDITIONS SET FORTH IN THIS
RESOLUTION.
WHEREAS, Casablanca Villas LLC, a Florida limited liability company, is the owner of
real property located at 6363 Indian Creek Drive, Miami Beach; and
WHEREAS, a five foot utility easement is dedicated by plat in the rear of Lots 4, 61, 62 and
63 of Block 7 of The Amended Plat of Second Ocean Front Subdivision, as Recorded In Plat Book
28, Page 28 of the Public Records Of Miami-Dade County, Florida; and
WHEREAS, Casablanca Villas LLC having a Unity of Title for the above mentioned lots,
obtained on July 11, 2001, Design Review Board approval to construct a six story, 43 unit
condominium; and
WHEREAS, the utility easement on Lots 4 and 61 would obstruct the proposed building site
and consequently, Casablanca Villas LLC has requested the City to abandon and terminate said
utility easement; and
WHEREAS, as consideration for the City's abandon and termination of the existing
easement, Casablanca Villas LLC will concurrently grant the City and all applicable utility
companies an equal easement along the north property line of Lot 4, together with assuming all
costs and expenses for the relocation of existing utilities to this granted easement; and
WHEREAS, accordingly, the Administration would recommend that the Mayor and City
Commission authorize the MayOr and City Clerk to execute the attached Termination and
Abandonment of Easement, attached as Exhibit "A" hereto, and accept the new Grant of Easement,
as set forth as Exhibit "B".
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk
are hereby authorized to execute a Termination and Abandonment of a Utility Easement on the
property legally described as Lots 4 and 61, Block 7 of the Amended Plat of Second Oceanfront
Subdivision, as recorded in Plat Book 28, Page 28 of the Public Records of Miami-Dade County,
Florida, in favor of Casablanca Villas LLC., and further to accept a new grant of easement from
Casablanca Villas LLC., as the owner of the aforestated property, on lot 4 of the aforestated Block
and Subdivision.
The City's execution of the Termination and Abandonment of Easement, and acceptance of the new
Grant of Easement is subject and conditioned upon Casablanca Villas, LLC's full compliance, to the
City's satisfaction, with the required conditions and costs of relocation, as required by any and all
utility companies occupying the existing easement, and complete relocation and reconnection of the
City's Water and Sewer mains along the north property line of Lot 4 to Collins Avenue.

GRANT OF EASEMENT
This Grant of Easement entered into this /t 't day of 200 by
CASABLANCA VILLAS LLC, a Florida limited liability company, with its address at:
999 Washington Avenue, Miami Beach, Florida 33139 (hereinafter referred to as
"GRANTOR") and the City of Miami Beach, Florida, a Municipal Corporation with its
address at 1700 Convention Center Drive, Miami Beach, Florida 33139 (hereinafter
referred to as "GRANTEE") its successors and assigns.
GRANTOR is the owner, in fee simple, of the Real Property legally
described as:
Lot 61 in Block 7, of the AMENDED PLAT OF SECOND OCEANFRONT
SUBDIVISION as recorded in Plat Book 28, at Page 28 of the Public
Records of Miami-Dade County, Florida;
And
Lot 4 in Block 7, of the AMENDED PLAT OF SECOND OCEANFRONT
SUBDIVISION as recorded in Plat Book 28, at Page 28 of the Public
Records of Miami-Dade County, Florida;
In consideration of the sum of ONE and no/100 ($1.00) DOLLAR and
other good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, the GRANTOR hereby grants and
conveys to the GRANTEE, over, under and across the Easement Area,
more fully described in Exhibit "A', a non-exclusive Easement for the
installation, maintenance, construction and repair of a storm drain system,
the costs and expenses associated with same, the costs and expenses
associated with same to be paid by GRANTEE. The City of Miami Beach,
its employees, contractors, or representatives shall have the permanent

right and license for purposes of ingress and egress to and from the
Easement for the purposes enumerated herein.
GRANTEE, its successors and assigns, agree to indemnify and hold
GRANTOR, its successors and assigns, harmless from any and all liability,
loss and against all claims or actions based upon or arising out of damage
or injury (including death) to person(s) or property that GRANTOR, its
successors and assigns may suffer as a result of claims, demands, costs, or
judgments against it arising from GRANTEE's successors' and assigns'
installation, use and maintenance of the Easement.
It is intended that this Easement shall be recorded in the Public Records of
Miami-Dade County, Florida and that this Easement shall be construed
and shall be enforced in accordance with the laws of the State of Florida.
The Easement herein granted shall constitute a covenant running with the
parcel of Real Property described herein and shall be binding upon and
shall inure to the benefit of the GRANTOR and the GRANTEE, and their
respective successors and assigns.
The rights and benefits of the GRANTEE under this Easement shall be
freely assignable by the GRANTEE, in whole or in part.
To the extent that the Easement herein is no longer required by
GRANTEE, GRANTEE here by agrees to execute and record in the Public
Records of Miami-Dade County, Florida, appropriate documentation to
abandon and terminate this Grant of Easement.

Item Summary/Recommendation:
When Second Oceanfront Subdivision was platted in 1924 for the portion of land between the Atlantic
Ocean and Indian Creek, from 57th to 68th Streets, a 5 ft. wide utility easement was reserved in the rear
of the lots between Collins Ay. and Indian Creek (Harding) Dr.. Casablanca Villas LLC, owns lots 4, 61,
62 and 63 of the Amended Plat Of Second Ocean Front Subdivision, and in January 2001 they submitted
and obtained a preliminary approval from the City's Design Review Board for a six story, 43 unit
condominium with 2 levels of parking on these lots. The L shaped building, extends from Collins Avenue
to Indian Creek Drive, across the two five feet utility easements in the rear of lots 4 and 61.
In order to construct the project, the developer will need the abandonment/termination of the utility
easement lying in the middle of the property. The Casablanca Villas LLC easement being on private
property owned in fee simple by the developer, does not require the vacation procedures for City public
right-of-ways. There are no City Code vacation requirements for easements on private properties. The
requirements as set by similar precedents for the abandonment, are that Casablanca Villas should
maintain all existing utilities, which they will have to accomplish by granting a new easement, and obtain
no-objection/agreement letters from the utility companies in addition to providing unity of title for the above
mentioned lots. These conditions were satisfied and Casablanca Villas is granting the City an easement to
accommodate the relocation/reconnection of existing utilities. All expenses will be assumed by the
development. The Administration has reviewed the request and recommends its approval.

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
Second Oceanfront Subdivision of the Miami Beach Bay Shore Company was platted in
1924 for the portion of land between the Atlantic Ocean and Indian Creek, from
approximately 57~ to 68th Streets. The plat had dedicated a 5 foot utility easement in the
rear of the lots lying between Collins Avenue and Harding Drive (now known as Indian
Creek Drive).
In January 2001, Casablanca Villas LLC, owner of lots 4, 61,62 and 63 of the Amended
Plat Of Second Ocean Front Subdivision, submitted for preliminary approval to the City's
Design Review Board, plans for a six story, 43 unit condominium with 2 levels of parking.
The L shaped building, extends from Collins Avenue to Indian Creek Drive, across the two
five feet utility easements in the rear of lots 4 and 61 (see attached sketch).
On July 11,2001, the Design Review Board approved the project. Since the developer did
not obtain a building permit by July 2002, he went to the Board and obtained a one year
extension on July 16, 2002.
In order for this development to proceed, the developer needs a termination and
abandonment of the easement lying in the rear of lots 4 and 61, and is granting the City
and utility companies a 10 foot wide easement along the north property line of lot 4.
ANALYSIS:
The City has an 8 inch sanitary sewer line and a 6 inch water main within this easement in
addition to Bellsouth and F.P.& L. utilities. The City reviewed the termination and
abandonment request of this easement and the grant of the new easement and required
the owner to provide the following:
1. A unity of title for Lots 4, 61, 62 and 63 of Block 7 of The Amended Plat of Second
Ocean Front Subdivision, as Recorded In Plat Book 28, Page 28 of the Public Records
Of Miami-Dade County, Florida.
2. Letters of agreements for the release/vacation of the easement in the rear of Lots 4
and 61 by the following utility companies: F.P.&L., BellSouth, TECO People's Gas,
and Charter Communications.
3. Engineering plans and commitment to reroute and relocate the City's sewer and water
mains lying within the easement to be abandoned, into the granted easement complete
with connections to the existing mains on Collins Avenue. The Termination and
Abandonment will be executed upon the final completion of the relocation work by the
developer and acceptance by the City.
4. Relocation of the water and sewer lines will have no impact on other users in the area.
Casablanca Villas LLC, the developer, has complied and submitted the above
requirements. This utility easement being on private property, owned in fee simple by
Casablanca Villas LLC, does not require the vacation/abandonment procedures for public
right-of-ways. Additionally, Casablanca Villas LLC, is granting the City an easement equal
in width to the abandoned easement, along the north property line of Lot 4, approximately
116 ft. long.
An abandonment of easement document will be provided to the developer for recording,
following completion of the relocation work as stated above.
CONCLUSION:
The Administration recommends that the Mayor and City Commission authorize the
vacation and abandonment of the utility easement in the rear of lots 4 and 61 of The
Amended Plat of Second Ocean Front Subdivision, as Recorded in Plat Book 28, Page 28
of the Public Records Of Miami-Dade County, Florida, in favor of Casablanca Villas LLC,
for the construction of The Casablanca Villas Condominium at 6363 Indian Creek Drive,
and acceptance of an easement along the north property line of Lot 4, for the relocation of
the existing utilities.

WHEREAS, the CITY wishes to terminate all of its right, title and interest in and
to the Easement.
NOW THEREFORE, in consideration of the sum of TEN AND NO/100 ($10.00)
DOLLARS and other good and, valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the CITY agrees as follows:
1. That the above captioned recitals are incorporated herein by this
reference.
2. That the terms, conditions and provisions set forth in the Easement are
hereby terminated, abandoned and released from the Real Property
described above and shall have no further force and effect.
IN WITNESS WHEREOF, THE CITY has caused these presents to be executed
