Resolution 10514 RESOLUTION NO. 10514
WHEREAS it has come to the attention of the City Council
of the City of Miami Beach that a duly constituted Committee of
the Legislature of the State of Florida is contemplating the
making of a recommendation to said Legislature at its forthcoming
session that various existing tax statutes be amended so as to
eliminate so-called "loopholes" and
WHEREAS the City Council has been advised and informed,
through the public press, and otherwise, that said recommendation
includes a proposal that Chapter 212.03, Florida Statutes 1959,
limiting the Sales Tax to six months of the rentals of apartments,
be amended by eliminating said limitation, thereby making said
Sales Tax applicable to all apartment leases and rentals, regardless
of the length or duration of such leases and rentals, and
WHEREAS said recommendation is to be presented as a "plug"
for an "existing loophole" in current tax statutes, and
WHEREAS said terminology is a palpable misnomer and a mere
euphemism for what is obviously a new tax, and
WHEREAS the Honorable Farris Bryant, Governor of the State
of Florida, has repeatedly and solemnly pledged his opposition to
any new taxes and has asserted his belief that new taxes are unnecessary,
and
WHEREAS the new tax to be so levied, in the event that said
recommendation be adopted, is discriminatory and grossly inequitable
in that it places an unbearable additional tax burden on persons of
limited income, and least financially able to bear the same, and
will of necessity have serious and disastrous impact upon the apartment
house industry of the State of Florida, the County of Dade, and the
City of Miami Beach, and would have serious adverse effect upon the
economy of the State of Florida,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, that the City Council of the City of Miami
Beach does hereby evidence its unqualified opposition and objection
to such recommended new tax; urges each Legislator to vigorously
oppose the same; and that the Honorable Farris Bryant, Governor of
the State of Florida, be respectfully requested to extend the aid
of the weight and influence of his high office in the opposition
to such new tax, and
BE IT FURTHER RESOLVED that a duly certified copy of this
Resolution be transmitted by the City Clerk to the Honorable Farris
Bryant, Governor of the State of Florida, to each member of the
Finance and Taxation Committee of the House and of the Senate of the
State of Florida, and to each member of the Dade County Delegation
to the Legislature of the State of Florida.
