OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE

FOR NORMANDIE SUD, MIAMI BEACH, FLORIDA, FOR THE PURPOSE OF
PROVIDING TWENTY FOUR HOUR STATIONARY SECURITY GUARD
SERVICE, SUBJECT TO COMPLIANCE WITH APPLICABLE CITY OF
MIAMI BEACH AND MIAMI-DADE COUNTY REQUIREMENTS ;

AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, some of the citizens of the City of Miami Beach residing in Normandy Beach
have petitioned Miami-Dade County under Chapter XVIII of the Miami-Dade County Code, to
create a Special Taxing District to provide Stationary Security Guard Service for the Normandie
Sud Neighborhood; and
WHEREAS, the Normandie Sud Homeowners Association has requested the approval of
the Miami Beach City Commission for Miami-Dare County to hold a referendum vote of the
residents of the Normandie Sud Neighborhood, at no expense to the City of Miami Beach, to
determine whether a Special Taxing District should be created in Normandie Sud district; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City of Miami Beach, in general, and
the residents of the Normandie Sud neighborhood in particular, to allow Miami-Dade County to
proceed, as hereinafter set forth;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
Section 1. That the recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. That the creation of a Special Taxing District ("District") by Miami-Dade County for the
Normandie Sud Neighborhood, on the Isle of Normandy, Miami Beach, in accordance with Chapter
XVIII of the Miami-Dade Home Rule Charter and Sections 18-2 and 18-3 of the Miami-Dade
County Code, for the purpose of providing twenty-four hour Stationary Security Guard Service
("Service"), is hereby approved, subject to the requirements set forth herein.
Section 3. That the roi,hal creation of said District and the levying of annual special assessments to
support the Service shall require the execution of an interlocal agreement between the City of
Miami Beach and Miami-Dade County, wherein the City will furnish and install all capital
improvements necessary to complete the construction of a Security Guard House Facility("Facility")
for the subject district, including the necessary road improvements, water, sewer, electrical and
telephone connections, concrete pads, sidewalk, curbing and required drainage improvements, two
road closures (one to include an unmanned emergency vehicle access gate), vehicle traffic access
control system (barrier gates) and signing and striping as required by the Director of the Miami-
Dade County Public Works Department to ensure the safe operation of said Facility in the public
right-of-way.
Section 4. That upon the de jure creation of the subject Special Taxing District, the CityManager is
hereby authorized to expend an amount not to exceed One Hundred Seventy Six Thousand Dollars
($176,000) to furnish and install the aforementioned Capital Improvements.
Section 5. That the aforementioned inter-local agreement will provide that the County shall
reimburse the City for all costs of labor, materials and supplies necessary to provide the capital
improvements described herein.
Section 6. That title to the Facility shall remain with the City, or its assignees, and said Facility shall
be leased in perpetuity to Miami-Dade County for Ten Dollars ($10.00) per annum until such time
as the district is legally abolished. Insurance for such Facility shall be provided for as per the terms
of the interlocal agreement.
Section 7. That the Facility herein approved to be constructed shall be located within the public
right-of-way located on Trouville Esplanade, and the manned emergency gate shall be located at
Rue Notre Dame and traffic barricade shall be located at Rue Bordeaux.
Section 8. That Miami-Dade County shall be responsible for operating Traffic Control Devices to
enable guards to record the date and time of entry, vehicle make, model, color and license tag
number, it being understood and agreed that no visitor to the District will be denied access or entry
to the District under any condition.
Section 9. That the Traffic Control Devices shall be operated and maintained in accordance with the
provisions specified in an Interlocal Agreement between the City and Miami-Dade County.
Section 10. That the County shall be responsible for contracting a uniformed commercial Security
Guard Service, duly licensed and bonded and State of Florida approved, for the purpose of
providing service at the approximate location specified herein, twenty-four (24) hours a day, seven
(7) days a week, three hundred sixty- five (365) days a year, or in the alternative the same services
may be provided using uniformed off-duty police officers.
Section 11. That the approvals herein presented shall be further conditioned upon an affirmative
vote of two thirds of the registered voters residing in the Normandie Sud Neighborhood voting in
an election to be conducted according to Miami- Dade County Code and further subject to the
approval of the Miami-Dade County Commission.
Section 12. That this Resolution shall become effective upon the date of its adoption herein.

Item Summary/Recommendation:
The Normandie Sud Homeowners Association initiated a request in 1996 for a guard gate and an
associated road closure and fencing of their neighborhood with the City and County. After reviews by the
City's Police, Fire and Public Works Departments and the County's Public Works Department's Special
Taxing and Traffic Divisions, the request was officially petitioned in November 2002 among the affected
property owners. The result of the petition was 55.8% in favor of the creation of a County special taxing
district. The Homeowners Association believes that support for the project is closer to 80%. The difference
is due to the count process utilized by the County.
The County process requires that the City Commission approve a resolution covering the following:
1. Authorize creation of the security guard special taxing district.
2. Agree to construct all capital improvements such as guardhouse and gates etc.
3. Acknowledge that no one will be denied access to the public roadway.
4. Authorize to enter into an automatically renewing perpetual lease agreement for the district's use of this
facility for as long as it is in operation.
5. Authorize an interlocal agreement.
The County agrees to reimburse the City for the construction costs in an amount not to exceed $176,000.
The Administration recommends adopting a Resolution approving the above mentioned items.
After City Commission approval, the Board of County Commissioners will hold a public hearing and
approve or disapprove the creation of the special taxing district. Following approval for creation of the
district by the county, a final majority vote by all registered voters within the proposed district, will ratify the
creation of the district. The Administration recommends approval of the Resolution.

Adopt the Resolution.
BACKGROUND:
The Normandie Sud Homeowners Association initiated a request for a guard gate and an
associated road closure and fencing of their neighborhood in 1996, according to the Miami-
Dade County Special Taxing District process (see attachment "A"). After reviews by the
City's Police, Fire and Public Works Departments and the County's Public Works
Department's Special Taxing and Traffic Divisions, and following several modifications to
the initial proposal, the request was officially petitioned in November 2002 among the
affected property owners. The results of the petition were validated in a letter by the County
stating 55.8% being in favor of the creation of the special taxing district, and requiring the
City's authorization to the County for the creation of this special taxing district.
ANALYSIS:
The City reviewed the initial request submitted by Normandie Sud Homeowners
Association for the creation of the special security guard taxing district for residences on
Biarritz and Bay Drives, between Rue Granville and Versaille, and following input by the
City's Police, Fire and Public Works Departments and the County's Public Works
Department, proceeded with the County's process for the creation of this special taxing
district. Based on the evaluations by the above Departments and traffic impact studies as
required additionally by FDOT, the special taxing district was administratively approved for
processing pursuant to Chapter XVIII of the County Code.
An estimate was prepared based on preliminary conceptual descriptions for the required
improvements to the special taxing district, including a guard house, gates and fences.
The City's Capital Improvement Project Department in coordinating the construction of the
special taxing district with the proposed neighborhood improvements developed an
estimate of $225,360. This was later modified by the County to exclude any fencing and
included removal of a traffic signal which reduced the total project estimate to $176,000.
Any cost overruns during construction would necessitate a renegotiation with the County.
Based on this estimated cost the County and Normandie Sud Homeowners proceeded with
the petition process (see attachment "C" - petition letter). Of the 240 properties initially
included in this district, the County addressed 190 properties in the neighborhood with
current homestead exemptions. The petition was approved by 106 property owners, or
55.8%, and the County shall proceed with the request for creating the district and
presenting this to a public hearing by the County Commission following a Resolution bythe
City Commission authorizing this request.
The County process requires that the City Commission approve a resolution covering the
following (see attachment "B" - letter by the County):
1. Authorization to the County to create this security guard special taxing district without
restraining stipulations or conditions, and to levy special assessments in support of
this service
2. Agreement that the City will construct and install all capital improvements in the district
to include the guardhouse, two road closures (one to include an unmanned emergency
vehicle access gate), vehicle traffic access control system barrier gates, all necessary
road improvements, all utility connections, manual and electronically operated gate
system and gates within the public right-of-way, conduits to serve gates, required
sidewalk, curbing or drainage, signing and striping, and all other capital improvement
items for this district.
3. Full acknowledgement that no one will be denied access to the public roadway, but that
the operation of the gates will require that the public be delayed to enable security
personnel to record description and tag number of incoming vehicles.
4. Authorization for the City to enter into an automatically renewing perpetual lease
agreement for the district's use of this facility for as long as it is in operation.
5. All the above conditions will be included in the interlocal agreement with Miami-Dade
County.
As mentioned above, the County requires that the City will construct all the improvements
in the district, for which the County shall reimburse the City up to $176,000 upon
completion or as construction progresses. The reimbursement/payment schedule by the
County will be addressed in the interlocal agreement. The Administration has reviewed this
and identified funds from the undesignated general fund balance to be used for funding
these improvements until reimbursed by the County. The $176,000 funding for construction
and operating cost is assessed to the affected properties for subsequent collection by the
County within the first two years. As illustrated in the attached copy of the petition
(Attachment "C"), the lower assessment rate for the third and subsequent years would fund
only operating expenses. The County, through its Property Tax assessment and Special
Taxing District offices, will be responsible for all collection and administration of the
assessed taxes to pay for the annual operating expenses.
The Commission meeting consideration of this item has been advertised as a public
hearing, even though it is not a requirement of the process. As the support percentage was
officially only 55.8%, before this item was referred to the County, it was felt the
Commission should have an opportunity to hear any concerns in the affected area. The
president of the Homeowners Association has expressed that closer to 80% support exists
for the project and has offered to provide copies of the petitions that support that percent.
If available prior to the meeting, these will be forwarded to the Commission. The public
comment opportunity will still be available for those who may have some concerns.
Following passing of the attached Resolution by the City, the Board of County
Commissioners will conduct a public hearing and approve or disapprove the creation of the
special taxing district. As a final step, mailed ballots will be sent to all registered voters
within the proposed district, who must ratify the creation of this special taxing district by
majority vote.
CONCLUSION:
Recommend the City Commission adopt the Resolution approving and authorizing the
creation of a special taxing district by Miami- Dade County for Normandie Sud, Miami
Beach, Florida, for the purpose of providing twenty-four hour stationary security guard
service, subject to compliance with applicable City of Miami Beach and Miami-Dade County
requirements, and approving construction of a guard house facility, emergency and barrier
gates and necessary street improvements and modifications. Authorizing and appropriating
an amount not to exceed one hundred seventy six thousand dollars ($176,000) for said
taxing district improvements to be reimbursed by Miami-Dade County upon completion of
construction. Authorizing the Mayor and City Clerk to enter into an Interlocal Agreement
with Miami-Dade County, for the creation and operation of this special guard house taxing
district.

HOW IS A SPECIAL TAXING DISTRICT CREATED?

Official inco[porated homeowners' association, for the same area under consideration, requests a
petition package from Marie Helena Cohen, Chief of trte Special Taxing Districts Division, Stephen

describe desired improvements, di3trict boundaries and level of service. Fo~ districts of limited size
(water, scwer and road) where no as.~ocialion exists, the letter may by signed by 10% of the property
owners desiring the improvements. Petition reque~tors are urged to be very specific in their
recluirements (for example do not say street closures', specify closure to vehicular itel'tic, closure

petition package, tailored to the request of the comrnunity as well as Public Works Department's
concerns, and adjusted, for security guard districts, to reflect Police and Fire Rescue concerns.
This petition will provide a description of the propo=~ed improvements, as well as the range of
