Resolution 10680 RESOLUTION NO. 10680
WHEREAS, the City Council of the City of Miami
Beach is gravely concerned regarding the policy of the
Metropolitan Traffic Court requiring compulsory Court
appearances for virtually all traffic offenses, parti-
cularly with the impact thereof upon tourists and con-
ventioneers, with resultant damage to their good will
to the City of Miami Beach and its resort and convention
facilities, and
WHEREAS, the Traffic Division of the Municipal
Court of the City of Miami Beach has through years of
experiences evolved a system of traffic court appear-
ances having reasonable relationship to traffic safety,
and
WHEREAS, the State Highway Code providing a point
system determining the suitability of an operator's quali-
fications for continuance of driving privileges possesses
ample deterrent effects upon hazardous driving practices,
and
WHEREAS, it is the firm belief and conviction of
the City Council of the City of Miami Beach and its
residents and citizens that mandatory Metro Court appear-
ances should be limited only to those traffic offenses
constituting a hazard to public safety,
NOW, THEREFORE, be it duly resolved by the City
Council of the City of Miami Beach that the County
Commission of Metropolitan Dade County evaluate the
said policy of the Metropolitan Traffic Court in the
light of its great potential for immeasurable harm to
the tourist and convention economy of the City of Miami
Beach, and thereafter use its best efforts to modify said
policy so as to limit compulsory Court appearances to
those traffic offenses which are flagrant in nature, or
of such degree as to manifestly threaten the public
safety.
