RESOLUTION NO. 10681
WHEREAS, the City Council of the City of Miami Beach,
Florida, deems it to be necessary for the welfare of said City
and the inhabitants thereof to acquire, for highway purposes,
those certain parcels of land situate, lying and being in Miami
Beach, Dade County, Florida, described as follows, to wit:
Outlots numbered 1 to 7, inclusive, of FIRST
OCEAN FRONT SUBDIVISION, according to the amended
plat thereof, recorded in Plat Book 9, page 78 of
the public records of Dade County, Florida, which
said outlots constitute a strip of land lying westerly
of and opposite to Lots 1 to 7, inclusive, of said
subdivision, which said strip of land is bounded
on the east by Collins Avenue; on the west by Indian
Creek; on the north by the northerly line of said
Lot 7 produced westerly to Indian Creek and on the
south by the southerly line of said Lot 1 produced
westerly to Indian Creek.
AND
Outlots numbered 9 to 17, inclusive, of First
Ocean Front Subdivision, according to the amended
plat thereof, recorded in Plat Book 9, page 78 of
the public records of Dade County, Florida, which
said outlots constitute a strip of land lying westerly
of and opposite to Lots 9 to 17 of said subdivision;
which said strip of land is bounded on the east by
Collins Avenue; on the west by Indian Creek; on
the north by the northerly line of said Lot 17
produced westerly to Indian Creek and on the south
by the southerly line of said Lot 9 produced westerly
to Indian Creek.
AND
Outlot 19 of First Ocean Front Subdivision, according
to the amended plat thereof, recorded in Plat Book
9, page 78 of the public records of Dade County,
Florida, which said Outlot 19 lies westerly of and
opposite to Lot 19 of said subdivision and is bounded
on the east by Collins Avenue; on the west by Indian
Creek; on the north by the northerly line of said
Lot 19 produced westerly to Indian Creek and on the
south by the southerly line of said Lot 19 produced
westerly to Indian Creek.
AND
Outlots numbered 21 and 22 of First Ocean Front
Subdivision, according to the amended plat
thereof, recorded in Plat Book 9, page 78 of
the public records of Dade County, Florida,
which said outlots constitute a strip of land
lying westerly of and opposite to Lots 21 and
22 of said subdivision; which said strip of
land is bounded on the east by Collins Avenue;
on the west by Indian Creek; on the north by
the northerly line of said Lot 22 produced
westerly to Indian Creek and on the south
by the southerly line of said Lot 21 produced
westerly to Indian Creek.
AND
Outlots numbered 24 to 28, inclusive, of
First Ocean Front Subdivision, according to
the amended plat thereof, recorded in Plat
Book 9, page 78 of the public records of Dade
County, Florida, which said outlots constitute
a strip of land lying westerly of and opposite
to Lots 24 to 28, inclusive, of said subdivision;
which said strip of land is bounded on the east by
Collins Avenue; on the west by Indian Creek; on
the north by the northerly line of said Lot 28
produced westerly to Indian Creek; on the south
by the southerly line of said Lot 24 produced
westerly to Indian Creek.
NOW ;THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITE OF MIAMI BEACH, FLORIDA, that it is necessary that
the fee simple title to the above described property be acquired
for use and maintenance for highway purposes for the benefit
of said City and its inhabitants.
BE IT FURTHER RESOLVED that the City Attorney and
Attorney Ben Shepard be and they are hereby authorized and
directed to institute the necessary legal proceedings in the
name of said City in the exercise of its right of eminent domain
for the condemnation of said property for said purpose.
