SUBJECT: 2018 Halloween on Lincoln Rd
The purpose of this Letter to Commission (LTC) is to provide the Mayor and City
Commission with the special event plan for Halloween on Lincoln Rd for 2018.
The City of Miami Beach has implemented a detailed plan for Halloween on Lincoln Rd
in order to protect the expected 50,000 residents and visitors. This includes enhanced
Police, Fire, and Code Compliance staffing. The mobile command center will be
established in the parking lot between Euclid & Meridian off of Lincoln Lane South.
This year, The City of Miami Beach and the Lincoln Rd Business Improvement District
(LRBID) present Halloween on Lincoln Rd, Wednesday, October 31, 2018 from 5:00pm-
2:00am. All throughout Lincoln Rd there will be mobile bars in the curb cut out of each
block and entertainment stages that face north all along the side streets. Additionally, the
City, The Lincoln Rd BID, stores and restaurants will give out candy starting at 5:00pm.
The City will also show a wallcast movie "The Night of the Living Dead" at 8:00pm, at
Soundscape Park.
The traffic plan includes, a hard closure from Lincoln Lane South to Lincoln Lane North
of all Lincoln Rd cross streets (Pennsylvania, Meridian, Michigan, Jefferson, Lenox), with
a soft closure for resident and area business access (with ID or placard) and access to
available parking lots and garages from 16th street to Lincoln Lane South and from North
Lincoln Lane to 17th Street. The closure is in effect from 2:00pm to 3:00am.
Sidewalk café operators via notices distributed by Code Compliance and the Lincoln Rd
BID have been advised that there will be no expansion of any Lincoln Rd sidewalk café
site plan, any illegal site plan expansion shall be deemed to be a life safety violation and
subject operator to mandatory fines and enhanced penalties.

This event permit allows for the following:
* A hard closure from Lincoln Lane South to Lincoln Lane North of all Lincoln Road cross streets
(Pennsylvania, Meridian, Michigan, Jefferson, Lennox), with a soft closure for resident and area business
access (with ID or Parking placard presented) and access to available parking lots and garages from 16 Street
to Lincoln Lane South and from Lincoln Lane North to 17 Street. The closure is in effect from 2:00 pm to
2:00 am only. Closure will be managed by the Miami Beach Police Department, with Parking reservation of
meters within the hard closure per No Parking signage installed a week in advance. A 15' Fire lane must be
maintained at all times in each block. Closure of Lincoln Lane South and Lincoln Lane North from Pennsylvania
to Lennox, with access limited to emergency vehicles only.
* KCC Productions will provide DJ entertainment via four stages from 8pm to 1:00am, located between
Lincoln Road and Lincoln Lane South at Lennox, Michigan, Jefferson, Pennsylvania. The risers, generators and
support equipment will be staged in the reserved parking lanes south of the stage locations. KCC is
responsible for ensuring the installation leaves a full 15' Fire lane on each block at all times, provides ADA
compliance for all cables, and enclose generators with barricades to keep them inaccessible to the public.
While load-in and load-out KCC must move all elements back into the parking lanes to ensure the roads are
clear before 2:00 pm begins and after 2:00 am if not completely loaded out, when the road re-opens. KCC is
not using elements that require Building Department permits.
*Vendor bars have been approved to activate with participating businesses having provided liquor license and
liability. The approved bars must use plastic and aluminum only; no glass products are allowed. All liquor
sales on public areas must end with last call by 1:00am. Bars are allowed within their defined location. Tents,
tables, chairs, or no other structures are allowed. Plug-in to existing City power outlets is prohibited.
*Sidewalk cafes have been noticed and must not serve breakfast on 11/1/18 in order to allow City Sanitation
to properly clean Lincoln Road.
Estimated Attendance: 50000
City Services: Off-duty office notification 305-673-7823.
Event staffing includes off-duty Police officers handling all load-in and load-out activities and all public safety
and traffic needs for this event. Street closure includes hard closure from Lincoln Lane South to Lincoln Lane
North from Pennsylvania to Lennox, with soft closure/ local and parking access from 16th to 17th Streets up
to Lincoln Lane.The closure will be in effect from 10/31/18 at 2pm to 11/1/11 at 2am. The closure will also
load-in and load-out.
Fire Department has staffed according to the event needs.
All City Departments have been notified.
Sanitation Clean Up: The approved permit holder is required to execute the sanitation plan previously approved by City staff as
part of this event permit. All arrangements for removal of garbage, single stream recycling, and other debris
are the sole responsibility of the permit holder, including but not limited to any of the surrounding areas,
throughout the duration of the event permit, including load in and load out. The permit holder may not dump
in City trash cans and/or dumpsters without prior and direct coordination with the Sanitation Department.
Single stream recycling container(s) must be present at all garbage collection areas. Single stream recycled
materials must be removed separately from trash and taken to an appropriate recycling center at the expense
of the permit holder. Glass containers and plastic straws are prohibited on all beachfront areas, unless stated
otherwise. Any Styrofoam and polystyrene'cod service items are strictly prohibited In any permitted event
uses. Any port-o-lets placed on public property must be cleaned and maintained at all times they are open to
event attendees and/or the general public. Port-o-lets must be locked and not accessible to the public after
event hours or when they will not be maintained. Any vendors responsible for maintaining,emptying and/or
delivering or removing port-o-lets, must follow all procedures of Vehicle Access Policy and have proper passes
displayed and police escorts. The event site and areas surrounding it must be restored to the condition upon
the start of the event permit. Failure of the permit holder to execute the sanitation plan will result in partial
to full default of the security deposit.
Sand sifting, provided by the City, Miami-Dade County or a private vendor, is required in the event area at
the conclusion of the event permit.
This permitted event is contained within private property. The permit holder is responsible for any sanitation
needs related to this event that impact public property.
Parking Plan: Event attendees will park in various municipal and privately operated parking garages and meter parking in
the surrounding areas.
One production manager vehicle is allowed to park behind each staging activation as designated on the events
site plan.
The lot between Meridian and Euclid south of Lincoln Lane South will be closed and utilized for the staging of
the City's command post and central communications Center.

Permit Conditions: **THIS PERMIT MUST BE POSTED IN A CONSPICUOUS LOCATION. Failure to do so may result in a citation.
NOISE/ EVENT ENTERTAINMENT:
**This Special Events permit does not override or allow for violation of the Miami Dade County Noise
Ordinance. Applicant shall abide by the Miami Dade County Noise Ordinance and City of Miami Beach ARTICLE
IV NOISE section of the City Code.
**DJ Entertainment from 8pm to 1:00am at four stages, located between Lincoln Road and Lincoln Lane
South at Lennox, Michigan, Jefferson, Pennsylvania.The Applicant has been advised that a special events
permit does not grant allowance to violate the noise ordinance.
**Stage entertainment must end by 1:00am
**Liquor sales for approved bars must end by 1:00am with sidewalk cafe last call at 1:00am as well. Glass
and Styrofoam is prohibited.
BUILDING PERMITS/CONDITIONS:
**There are no approved Building Department permits as part of this permit for both KCC and approved bar
vendors.
***Allowed temporary structures which DO NOT require a building permit - portable generators rated at 5000
watts or less(must be enclosed by a fence or barricade, must have sound muffled to abide by noise
ordinance; must include absorbent padding under it if on sand or grass; all cabling must be ADA compliant). A
30"or less riser(for production purposes only; the public is not allowed on it at any time); tents measuring
120'square feet total or less with three foot separation from each other or any structures If no electrical use
involved; ten feet if electrical use involved. KCC and approved bar vendors must adhere to these
requirements.
** Use of City power outlets is not permitted by KCC or bar vendors.
**Applicant/vendor is responsible for taking necessary measures to ensure public safety. All cables placed in
the public right of way must be covered in electrical sleeve jackets and must be ADA accessible.
**Any temporary structures not listed as part of this permit that are erected at the event site must have the
approved building permit and requisite special inspector forms posted on the structure and available for
inspection at all times. Failure to do so is a violation of this Special Event permit.
EXTENSIONS/PROVISIONS:
**This permit does not grant liquor extension beyond the allowed time frame of this permit or for any café
extension.
**All participants bars and restaurants have provided required liquor license and Insurance for both the City
and LR BID.
**This permit does not allow expansion of any existing sidewalk café permit's occupant content or approved
set up, as approved by Public Works. Existing occupant content must remain in effect in all areas.
** Artist vendor licenses have been noticed and relocated from the event area between 10/31/18 at 7am
through 11/1/18 at 12pm.
**Sampling of Halloween candy only is permitted by all Lincoln Road businesses and the Police Athletic
League. PAL will set up 10'x10' tent for sampling in the cut out on the west side of Meridian.
** Any sales of non-alcoholic beverages on public property must meet brand alignment of Coca-Cola
agreement with the City of Miami Beach. Any deviation constitutes a violation of this permit and must cease
immediately.
**Any commercial filming on public property; whether produced,coordinated or approved by the permittee;
within or relevant to the approved event area, must have an approved Miami Beach film permit. All drone
(UAS) uses are prohibited in event area, whether above public or private property, unless specifically
permitted by City film permit.
STREET CLOSURES/ LANE REDUCTIONS/ ROW PERMITS:
**Street closure and right of way permits approved by MBPD, PW. Applicant MUST maintain 46"pedestrian
access at all times unless otherwise stated on this permit. Refer to the City Services/ Public Safety section for
details.
**Unless otherwise stated in this permit, no closure, lane reduction or traffic holds are permitted Monday -
Friday from 7am to 9am and 4pm to 7pm.
SIGN-OFF'S/ NEIGHBORHOOD REVIEW:

TERMS AND CONDITIONS OF SPECIAL EVENTS PERMIT
AUTHORITY: This Permit is issued by the authority of the City Manager (the 'Permittor'), for the purpose of special
events on public property, or private property where such event would not normally be allowed, pursuant to the Special
Events Permit Regulations and Guidelines, as codified in City of Miami Beach Ordinance No. 2001-3302, as same may be
amended from time to time (the Guidelines).
PERMIT REQUIRED: This Permit is a public record and must be maintained and available for inspection at all times at the
location on which the Event occurs. This Permit may not be assigned, altered, and/or the terms of this Permit varied
from by the Permittee without the prior written consent of the City of Miami Beach. This Permit shall not be valid unless
approved and executed by the City Manager.
COMPLIANCE WITH PERMIT AND LAWS: Permittee agrees to comply with the terms and conditions of this Permit; the
Guidelines (as may be amended from time to time); and with all applicable Federal, State, and local laws, regulations,
ordinances, and rules. Non-compliance shall be subject to enforcement by the City, through and including, but not
limited to, City Police, Code Compliance Officers, Fire Inspectors, or such other authorities (whether City, State, or
Federal) having jurisdiction, and may further result in revocation of this Permit and/or cancellation, suspension, or early
termination of the Event. The Permittor, or an authorized representative, may modify, suspend, or revoke this Permit,
at his/her sole discretion, including, but not limited to, such cases where the Permittor finds that Permittee's activities
and/or the Event is contrary to the health, safety and welfare of any person, or that said activities are or will cause
damage to real or personal property.
INSURANCE: This Permit is granted subject to Permittee providing the City any and all applicable Certificate(s) of
Insurance, including general liability insurance, for bodily injury, death, property damage, and personal injury. All
Insurance Certificate(s) must name the City of Miami Beach as additional insured and policyholder.
INDEMNIFICATION: In consideration of the City's approval of this Permit, and the granting of the privilege herein,
Permittee waives all claims against the City of Miami Beach, its officers, agents and employees, for loss or damages
caused by, arising out of, or in any way connected with the granting of this Permit or of the Event. Permittee agrees to
indemnify, defend and hold harmless the City of Miami Beach, its officers, agents and employees, from any and all
alleged claims, loss, damage or liability caused by, arising out of, or in any way connected with the granting of this
Permit or of the Event.
RISK: Permittee acknowledges that its use of any City of Miami Beach facilities and/or property for purposes of this
Permit and/or the Event, is at its own risk and expressly waives any right to make or prosecute claims or demands
against the City of Miami Beach for any loss, injury or damage which Permittee or its officers, agents, employees,
guests, invitees, and any other persons or entities related to or associated with the Permittee and/or Event may sustain
in the exercise of the permissions granted, or by reason of any defect, deficiency or impairment which may occur from
time to time from any cause or the utilities or other services furnished, or for any loss resulting from fire, water, wind,
civil commotion, riot, landslide, or acts of God. Permittee further understands and agrees that all City property and
facilities are offered in their 'as is' condition with no representation or warranty, express or implied.
REMOVAL OF MATERIALS: The Permittee shall clean up and restore the Event location and all City property and facilities
hereon and/or related hereto as they were prior to the Event taking place, including, but not limited to, the removal of
all temporary structures, equipment, trash and garbage removal, and any other restoration of City property and
facilities, as deemed necessary by the City. All such work shall be completed within the time specified in the Permit (i.e.
load-out date), unless the City agrees in writing, that this may be done at a later time. In the event the Permittee fails
to comply, the City of Miami Beach may remove and restore same, and Permittee shall pay any costs incurred.
Permittee agrees to pay the City of Miami Beach for damage to City of Miami Beach property and facilities resulting from
operations undertaken by Permittee.
VENUE: This Agreement shall be enforceable in Dade County, Florida, and if legal action is necessary by either party
with respect to the enforcement of any and all the terms or conditions herein, exclusive venue for the enforcement of
same shall lie in Dade County, Florida. CITY AND CONCESSIONAIRE HEREBY KNOWINGLY AND INTENTIONALLY WAIVE
THE RIGHT TO TRIAL BY JURY IN ANY ACTION OR PROCEEDING THAT CITY AND CONCESSIONAIRE MAY HEREIN AFTER
INSTITUTE AGAINST EACH OTHER WITH RESPECT TO ANY MATTER ARISING OUT OF OR RELATED TO THIS AGREEMENT
OR THE CONCESSION AREA(S).
Commencement of activity under this permit by a permittee or its agents, employees or subcontractors
constitutes acceptance of the terms and conditions of this permit. The permittee shall further ensure that
all employees, sponsors and guests of the special event comply with the terms and conditions of this
permit. All activity under this permit shall also be in compliance with all applicable federal, state, county
and municipal laws. This permit may be revoked at any time.

SUBJECT: LINCOLN ROAD SIDEWALK CAFES — HALLOWEEN 2018
Dear Lincoln Road Sidewalk Cafe Operators:
Please be advised that there shall be no expansion of any Lincoln Road sidewalk café
site plan, and sidewalk café operators shall only be authorized to conduct their
operations consistent with the approved sidewalk café site plan. In that regard, any
expansion or deviation from the approved sidewalk café site plan is hereby expressly
prohibited beginning on Friday, October 26, 2018 through and including November 1,
2018 ("Halloween 2018").
Please be further advised that any illegal expansion of a sidewalk café site plan or
operation on Halloween 2018 shall be deemed to be a life safety violation and a site plan
violation pursuant to Section 82-370 of the City of Miami Beach Code of Laws and
Ordinances. A notice of violation issued pursuant to Section 82-370 of the City Code
shall subject the sidewalk café operator to mandatory fines and enhanced penalties,
including an immediate order suspending the sidewalk café permit and operations,
consistent with Section 82-371 of the City of Miami Beach Code of Laws and
Ordinances.
This Notice shall serve as formal notification that the City of Miami Beach intends to take
all necessary enforcement action to ensure that no illegal expansion or deviation from
the approved sidewalk café site plan occurs on Halloween 2018. Furthermore, the City
of Miami Beach will have Police Officers and Code Enforcement Officers stationed
throughout Lincoln Road to ensure the health, welfare and safety of its residents and
visitors. and to ensure compliance with all applicable local, county and state laws.
